VMS Data LLC has conducted an extensive investigation regarding this disputeWe have pulled all notes, emails, phone records, and spoken directly with [redacted] Ownership and upper management on several occasions in attempts to resolve this dispute[redacted] upper management, ***, requested a refund months after the product was completed and received by the clientVMS Data LLC denied the refund and requested [redacted] schedule a time with us to sit down and professionally resolve this dispute.The product was purchased on 8/01/Documents were reviewed by [redacted] for weeks and agreed to our terms and conditions by electronic signature on 8/15/2017.The standard product construction period is Normally 2-monthsVMS Data LLC was able to complete the majority of the construction by 9/07/Only weeks and days later, way ahead of scheduleThe website officially went Live online on this day.Revision requests were made and completed all adjustments ahead of schedule by 10/03/VMS Data LLC then burned the purchased website programming onto a DVD and certified mailed the product to [redacted] via FedEX, as promised within our contract agreementThe product was received with signature by [redacted] on 10/10/2017.I started my investigation with an open mind, once I completed the dispute investigation I contacted [redacted] via phone within business day from time of the request.She explained the reason for a refund request was that VMS Data had poor communication and did not complete promised work, [redacted] was very professional and pleasant I went through all of our notes with ***, including specific dates and times of attempted contact for VMS Data LLCVMS Data LLC's records showed an ample amount of communication attemptsI then forwarded our FedEX confirmation and additional documentation to her email to show the work had been completed and receivedShe claimed to have no knowledge of receiving the disk, she also claimed that the signature FedEX collected came from an unknown representative of [redacted] ***I offered to recreate and resend the website several times, In which [redacted] firmly declined, stating "We purchased another from someone else, we don't want it anymore."She then admitted she didn't check herself to see if the work had been done, she was acting on "hear say" from someone elseAt this time she reconsidered the full refund they were asking for and stated only a partial refund would sufficeI then explained to her that I felt her Revdex.com review was misleading and was misrepresenting what had actually happened between both companiesShe ended the phone call with "If we receive payment we will consider removing the review or even changing it." I explained to her that it's her right to review our business as a client, however, it is unfair to leave a misleading review on nonfactual informationAfter the phone call, I received an email from [redacted] stating, 'I have already put in motion a retraction of my review on the Revdex.comI feel I made the review in haste and did not give you enough time to respond." [redacted] requested that I call back before I make a final decision on the refundThat they have more they want to add to the case.I contacted them back immediately and entered a conference call between [redacted] and ***, the owner of [redacted] *** [redacted] explained he wanted a full refund because the website was not bringing him a number of jobs he required and that forced him to move to another company for solutionsHe expressed that we still haven't completed the work [redacted] was extremely unprofessional and used inappropriate language and threatsI explained to [redacted] there was an obvious conflict in the reasons they are unhappy with our services, and we feel the communication barrier lies within [redacted] ManagementI then explained we still have a copy of the programming he purchased and re-extended my offer to resend the website they purchased to ***, in which he accepted I then asked [redacted] to review the documents I sent to [redacted] proving the work had been completed and receivedHe said this was the first time he had seen them as well After I submitted our evidence to [redacted] disproving [redacted] ***'s claims, he resorted to inappropriate behavior and threats of slanderAt which time I professionally ended the conversation.VMS Data LLC has fulfilled all promises outlined within the documentation attached and has done so within a timely and professional manner We feel [redacted] is attempting to find capital, In which they have targeted VMS Data LLC and began searching for any possible reason they could return their 6-month-old purchase, including the use of slander and threats.VMS Data LLC understands that business can get messy and disorganized and is willing to work with [redacted] to come to a mutually pleasing agreement excluding a cash refund

I do not agree with their conclusionsWe are asking for a refund because we already have another company handling our website and marketing needsThe biggest issue we had was towards the end of our business with this company(which we had to go to another company to get a proper working website) was that the changes we requested were picture changes, some of the language on the site, as well as the layoutWe had an issue with that from the beginningWe were told they only had a specific type of layoutI have received conflicting info from the employeesThey said they could change some of the layout images and wording, but that they basically looked the sameI was only offered a different layout a week and a half ago when I initially called to ask for this refundThey had admitted at the time of the c [redacted] that our business with them ended poorly( on their end)Also the individual (Manny) whom was making our site had locked them out on there end and they were unable to make changesI was told this on the phone on more than one occasion when I tried to call in to reach Manny who had been terminated for stealing from the companyThis was also admitted by John H***I believe this was ultimately the reason they were not getting back to me and responding to our change requestsIt was at this time we brought in our marketing manager Margarite C [redacted] to initiate the domain transferA couple weeks went by without any help from VMS DATA to make the changes we wantedIn this day in age we cannot run our business effectively without a websiteWe do not want to continue working with them in regards to the website

VMS Data strictly adheres to all state and federal laws when contacting business' and made contact with this business within all legal perimeters All VMS Data representatives are scripted and required to identify themselves are VMS Data representativesAfter further investigation, this call
originated from our customer service department and was not a solicitation of services Our evidence shows this complaint does not hold water and is misleading and false

This business called us from a spoofed number and misrepresented themselves as googleThis is a known scam that google warns aboutBusiness name was not displayed on caller IDCompany has a very nefarious reputation, a cursory internet search will reveal scores of dissatisfied individuals who have dealt with this businessCaller stated he wanted to " update our free google listing." We have been hounded for years by individuals attempting such scamsThey want to bait us in with lies that there is a problem with our listing and charge hundreds of dollars for a service anyone can doOur complaint holds merit

"We are asking for a refund because we already have another company handling our website and marketing needs."If you purchase a pair of shoes and walk around in them for month, then decide you'd like a pair of sandals more, that doesn't mean you can take the shoes back months later and get a full refund.Even if you decided to go to another company, *** *** *** still hired my business to perform a precise job, and any dealings you have with other 3rd party companies are irrelevant to our terms and conditions and refund policesThe job was well defined in written terms, and agreed upon by *** *** *** Unfortunately those terms are binding and *** *** *** will have to settle for something other than a cash refund.VMS Data LLC has extended an offer to correct all issues *** *** *** has stated in this dispute, complimentaryHowever, our offer was received and discardedVMS Data LLC has accepted your motion to no longer do business with us. Any further dispute in regards to a cash refund, VMS Data LLC is prepared to present our hard evidence and defense in small claims court.We Wish the best for *** *** *** and hope for a prosperous future for them

[redacted],I understand you are frustrated with telephone calls, however, I feel the basis of your complaint is built from that frustration and not factual evidence. I have a question for you, IF someone mislead you and said we were google, AND they called from a spoofed phone number, why would you choose to leave a complaint on VMS Data's Revdex.com listing?It seems obvious that my representatives, whom are scripted, did in fact represent themselves as VMS Data.  We do in fact make outbound customer service calls, however, in no way do I feel that is grounds to slander my company and the hard work we do to help businesses across the US.  Yes, our services are internet based, and yes, google listings are something you are able to do on your own. I can unclog my own toilet but when I don't have the time or patience to fix it, I'll call a plumber.  Yes, I can rent a rug doctor and clean my own carpets, however, if I own a hotel or string of apartments, I'd rather call a licensed and insured professional who guarantees the job will get done correctly. VMS Data offers online solutions to save business' time and money. Our services come guaranteed and are fulfilled with integrity. As far as calling from a spoofed number, my phone number has been the same for 5 YEARS! The same number is posted on my ads, my website, my listings, and has not ever been changed. If the phone number did not show for this specific case, it would be an error possibly with your carrier.If you could please contact us directly to resolve this complaint.  It would be our pleasure to review this call recording with you.
