First, I would like to address statements made by *** in her complaintShe alleges that we guaranteed this puppy, *** *** ***, to be free of hip and elbow dysplasiaThis is untrueIn theUnited States, a dog is required to be over years of age to have itships and elbows
certified by the Orthopedic Foundation for Animals (OFA)Wedid not and do not advertise thisAs you will see in our guarantee (Exhibit 1),we do guarantee that "If this puppy develops debilitating/crippling hipdysplasia up to two years of age (confirmed by good quality x-rays from alicensed veterinarian), barring any conditional issues (including but notlimited to overweight, overworked, trauma, etc), we will replace yourpuppy." A puppy is too young to be certified free of dysplasia by theOFA. *** *** chose to purchase a puppy importeddirectly from Germany for $plus sales tax, per her sales invoice datedDecember 18, (Exhibit 2) She chose not to purchase a puppy born here fromimported parents for $plus sales tax, which were availableShe chosenot to purchase a less expensive import puppy for $plus sales tax, whichwere available at the timeShe saw this puppy and had to have it. Whenshe drove up from Vancouver, she was ready to do whatever necessary to takethis puppy home immediately We showedher less expensive puppies however she stated she "had to have him." The dog she chose to purchase, comes from a longline of German Shepherd dogs from Germany with certified hips andelbows. We do significant research of the bloodlines, in which thepedigree goes back generations, the German Kennel Club, "the SV"'sown website goes back 7, and more generations.We do this to make sure the dogs are korklasse 1a with the highest possible hipand elbow ratingsIn German Shepherd breeding in Germany, no dogs are allowedto be bred without their hips and elbows being certified firstOf the dogs in *** *** *** lineage, 85% of these dogs have hips and normalelbowsis the excellent rating given in Germany. 15% ofthese dogs have the passing ratings of Fast Normal, Noch Zugelassen or Ausland.According to the German Kennel Club, "the SV" in Germany states thatFast is Very Good, Noch Zugelassen is Good and Ausland literallytranslates, "Out of Land"This means the dog'ships were rated in a foreign country and approved by the SVThis is notour opinionThis is what the SV in Germany statesNo dog can be bred inGermany without passing hip and elbow certificationShe chose to buy that puppy at that price when lessexpensive pups were available because he was imported from Germany.According to the documentation (Exhibit 3) *** ***provided us in April 2014, her dog was NOT diagnosed with elbowdysplasiaHe was diagnosed with PanosteitisPanosteitis isa result of a diet too high in protein causing the dog to grow to fast or aresult of an infection. (Exhibit 4) We never denied a diagnosis.There was no diagnosis made. In the radiologists review of the x-rays diagnosingthe Panosteitis, the radiologist states that poor positioning may have made itappear that there was mild elbow incongruityThe radiologist recommended further xrays. ***stated, in writing to *** that if it was due to poor positionsthe vet who poorly positioned the dog should be responsible for the xrays,not her(Exhibit 5) This is not denying a diagnosisA diagnosis was not made.*** *** chose to wait an entire year before following up with anyadditional x rays. I would also like to point out that Mrs***chose to deny any pain medication and fever reducers for her dog when he wasdiagnosed with PanosteitisThis in the notes from her own veterinarian. (Exhibit 6) *** *** alleges in her correspondence with us that she has never heard of conditionaldysplasiaThis is untrueIt is clearly stated in our guarantee which she readand signed at the time of saleAt the time of sale, we also, verbally and inwriting, covered "protecting those growing bones" as laid out inour puppy care instructions. This is not her first dog from usSheis familiar with our contract and guaranteeAgain, Mrs*** states that we denied the diagnosisgiven on May 26thThis is untrueWe told her in writing that our veterinarianagrees with her veterinarian’s diagnoses that her dog has Fragmented MedialCoronoid ProcessHowever, there are multiple differentfactors that can cause Fragmented Coronoid Process. The American Collegefor Veterinary Surgeons does state that Fragmented Coronoid Process can be aconditional diseaseAccording to the American College for Veterinary Surgeonsconditional causes of FCP can be diet, exercise, trauma, excessive calcium inthe diet, to high of protein in the diet and high caloriediets""There are also multiple studies showing the repetitive"loading" putting the bodies entire weight on the front end ofthe dog; IE: jumping, landing from jumps, getting out of vehicles, hitting fly ballboxes, chasing balls, Frisbees and such with jumps & associatedlanding along with sharp turns, too long of runs on hardground-concrete-and asphalt etcare a key factor and cause of FCP.Elbow dysplasia is a generic term meaning arthritis of the elbow joint(Exhibit 7) Fragmented Medial CoronoidProcess is a type of elbow dysplasiaIn (Exhibit 8), the Handbook of Small AnimalOrthopedics & Fracture Repair states that trauma is a cause of FCP*** has been adamant in her correspondence that because there is jointincongruity, it must be geneticAccording to the veterinary article (Exhibit7) joint incongruity is due to an injury to the growth plateThe definition of genetic is the biology that deals with the heredity andvariation of organismsHeredity is defined the natural process by which physical and mental qualitiesare passed from a parent to a childTherefore, this cannot be a genetic or hereditary problem as *** *** has alleged.For it to be genetic it must be seen in the father, the mother, thegrandparents, great grandparents and/ or the siblingsThe father has Fastelbows which is the very good elbow ratingThe mother has elbowswhich is the excellent ratingThe lineage and the siblings all have proven recordsin Germany.We are not and have not “hidden behind a contract” asMrs*** allegesWe have attempted to work with Mrs***We haveoffered to make resolutionShe has refusedShe demands a refund and paymentfor her veterinary billsAs per the original contract, there are no refundsMrs. *** also states that there is no cure for elbow dysplasiaThat isuntrueThere are many proven surgeries so the dog may live a life(Exhibit 9)All attachments have been emailed to the Revdex.com as I am unable to upload them through their website

Complaint: [redacted]I am rejecting this response because:[redacted] and Von Waldberg Shepherds are doing all possible to twist the truth in their favor.  He isn't a man who stands behind his product or service, only is present when there is money to collect.  Puppy was never guaranteed, but his parents and lineage were, and this is usually enough.  In this case, it proved that [redacted] doesn't research the ancestry of the imported pups.  He only sells them for high dollar amount. I was never offered to see another puppy, again [redacted] is lying.  I wanted to buy the chosen puppy, but that wasn't influenced on whether they showed me other pups or not, which, for the record, they didn't offer me anyway.  This is irrelevant. Once again, [redacted] is making the most ridiculous, childish excuses, putting the blame on me for choosing the “most expensive puppy”.  It is irrelevant that [redacted] is blaming me for not choosing a less expensive puppy.  It isn't my fault that the expensive puppy I chose has a inherited disease, it is [redacted]'s ignorance and lack of concern.  If he is offering sick puppies, without telling the customer, it isn’t the customer’s fault for choosing from an array of sick puppies. In April 2014, at 6 months of age, puppy was suspected to have dysplasia, more x-rays were recommended by vets.  After speaking with [redacted], he brushed it off as unnecessary, that puppy definitely doesn't have dysplasia, and suggested not to waste my money.  As a responsible breeder he would have encouraged me to go all the way through with the diagnosis.  But again, at the time I didn't know what a money-grabbing individual this is, as he obviously didn't want to deal with replacing the puppy at the time.  I thought he was honest, and had the best interest in mind for the dog and my family.A year later, when diagnosis only confirmed what was suspected a year ago, [redacted] still rejects the vets findings saying that dysplasia isn't hereditary, but caused by poor diet and trauma--something the vets deny.I have spoken to other customers who have had the same terrible experience with [redacted] and Von Waldberg.  Again, he brushes it off as hearsay, but it isn't hearsay when I have spoken with them in person.  I have also spoken with other kennels in the industry, they all agree on one thing--[redacted] doesn't have a reputation as an honest, reputable breeder/importer.  People must know about this man and his business practice, before they jump in and put their heart and soul into a sick puppy.Sincerely,[redacted]
