scheduled walkthroughs during the week prior to move-out, usually ending two days before the move-out day itself. It seems as though this resident did not schedule a walkthrough with us during that week. The amounts for damage assessment charges (which are fairly standard for this market) are also detailed in the move-out packet provided to residents, so the total should not be surprising to a resident or guarantor. In response to the parent's claims that the space was cleaned, we can only assess damages on what is seen when we enter the unit compared to any notes on the unit condition form received at the beginning of the lease term. Also, all units were walked on the day of move-out. No damages were assessed after that time. The employee that walked the unit noted the damages listed above, and charges were assessed. Unfortunately, we had some issues with data transferal last year and many pictures were lost. Accordingly, when the charges were disputed, we of course reduced the total considerably. The final balance (which came to less than 33% of what we deemed reasonable compensation for damages) was less than the charge for a bedroom full paint, just one item for which the resident was charged. I am responding to this complaint made by [redacted] in regards to the non-refundable puppy deposit that was placed on August 19, 2017 towards the next available puppy, due to the fact that I cannot control the amount of puppies or sex they will be when they are born and their wanting a male puppy...
which there was not a male available from this particular litter and puppies are placed in the order of deposits. Due to their misunderstanding I am willing to terminate the contract and return the $500 non-refundable deposit to them. I contacted [redacted] after receiving a certified mail notice wanting to know what the letter was in regards to since the post office hours would prevent me from picking up the letter for a couple of days. I told him I did not have the initial $500 deposit to send to him, at that time. However, the $400 had been set aside and could be sent. My reputation is very important to me so in order to maintain my good reputation I contacted my attorney asking her advice about a document to release both of us from any further obligation. At this time my attorney said she would draft a letter which I sent out the same day as receiving. It was sent by Priority Certified Mail and delivery was attempted on the following Monday. When I had not heard back from the [redacted]s I proceeded by sending a Cashier's Check with the $400 additional payment, again by Certified Priority Mail. In an attempt to resolve this matter as requested by the [redacted]s, I am willing to refund their non-refundable deposit however, as I stated to [redacted] of not having the $500 available at the time I had to receive my check in order to comply with their request, at which time I told him I am on Social Security (these are once a month checks).
