Initial Business Response / [redacted] (1000, 10, 2015/12/02) */ Vortex Whirlpool Systems first heard about the consumer's complaint September We are a manufacturing company located in Southern Calif and sell only to Dealers They buy our products and sell to consumers They do any service or warranty on the spas and swim spas Once a product is sold to the dealer we can not legally remove the product from the consumers house or pay them for that product It all has to be done through the dealer Since our first notice of this complaint we have reached out and visited numerous times with the husband of the wife filing this complaint The consumer states that the blowers on their swim spa continually turn on and off even when they are not using it We have offered to drive from Southern California to their home, which is approx or more hours away, to work on their spa at no cost to the consumerThe swim spa that they purchased has an electronic circuit board which filtrates the swim spa 2x a day It will also come on every minutes for seconds to purge the lines This is a function and there is nothing wrong with this system They have told us that they do not want us to fix their spa or even look at it All they want us to do is pick up their spa and pay them their money which we legally can not do We have visited with our dealer numerous times and asked them to please try and work this issue out with the consumer We have told the dealer that if they give the consumer their money back and remove the spa we would buy the spa back from the dealer We are very happy to help work this issue out but there is only so much we can do as this is a huge issue between the dealer and consumer At no time have we slandered the consumer's name or charged them for warranty repairs Any warranty charge that came to them was through the dealer or an independent service company Our responses to the attorney general have been nothing but positive in regards to the consumer and our willingness to help straighten this issue out between the dealer and consumer We are still very willing to send one of our service technicians to their home to fix their spa at no cost to them Every time we have visited with the consumers husband he has been very congenial and apologized that they have dragged Vortex into this mess between themselves and the dealer We have explained all that we can do for them on our end and that we are continuing to visit with the dealer to get this issue handled in a professional way and get a close on this issue We continue to receive emails and facebook posts from the wife who continues to accuse us of fraud, being deceptive and slandering her name At no time have we done any of these things We are a family run business that has been in business for over years We are always willing to work with the consumer and the dealer If you have time I recommend you call Bill at Hot Tub Super center and visit with him in regards to this issue Initial Consumer Rebuttal / [redacted] (4200, 14, 2015/12/02) */ (The consumer indicated he/she DID NOT accept the response from the business.) Since our first notice of this complaint we have reached out and visited numerous times with the husband of the wife filing this complaint. The consumer states that the blowers on their swim spa continually turn on and off even when they are not using it. We have offered to drive from Southern California to their home, which is approx 12 or more hours away, to work on their spa at no cost to the consumer. The swim spa that they purchased has an electronic circuit board which filtrates the swim spa 2x a day. It will also come on every 30 minutes for 30 seconds to purge the lines. This is a normal function and there is nothing wrong with this system. They have told us that they do not want us to fix their spa or even look at it. All they want us to do is pick up their spa and pay them their money which we legally can not do.
We have visited with our dealer numerous times and asked them to please try and work this issue out with the consumer. We have told the dealer that if they give the consumer their money back and remove the spa we would buy the spa back from the dealer.
