As I noted in my letter of May 5, I represent VRK Group LLC ("VRK")We have your follletter of May and I have been asked to reply furtherIn my earlier communications, I admittedly endeavored to be somewhat diplomatic in describing Ms [redacted] 's comments and my client's impressions with respect theretoHowever, we want to appreciate that this is well beyond a mere frivolous complaintThis is a complete fabricationAs I will explain, there is simply no merit whatsoever to Ms [redacted] 's allegations and contentionsIndeed, my client's principals and I have already discussed the potential of a lawsuit against her for defamation and tortious interferenceWe hope that you will not callously accept her accusations and that you will not make public any of her threats or reports (recognizing it's potential impact on the reputations of not only VRK but, more importantly, [redacted] and [redacted] ***), at least not without a thorough and complete investigation of this matterOf course, we would welcome any such investigation.Our collective impression of this entire scenario is that it is part of a plan and scheme by Ms [redacted] to generate some form of disagreement or schism between [redacted] ("***") and VRKThose entities have worked very well together with respect to this home and, both individually and collectively, have been extraordinary responsive to [redacted] 's requests, inquiries and outright demands (no matter how expensive or down right foolish they have been)All of her concerns have been addressed and have been addressed timelyIn fact, the real estate agent representing [redacted] in purchasing the home in question became so frustrated with her client and so tired of dealing with her client that she told my client, after the sale closed, that she wanted nothing further to do with this matterHer conclusion was apparently that her responsibilities ended when buyer undertook her final walk through at closing and accepted the homes as built for herHowever, prior to that time - and completely contrary to [redacted] 's claims that it took Mr [redacted] days to reply to her - we have literally scores of communications on these issues.Ms [redacted] 's comments about drainage are equally and inflammatoryShe writes, for example, that my client "to this day, has made not attempt to resolve any outstanding issues." It is frankly difficult to even address such a blatant mis-statement of factHow does she explain all of the communications and proposals which were exchanged? How does she explain weeks and weeks of letters? How does she explain that fact that my client has hired consultants and independent experts to investigate and has proceeded precisely as those experts have advised - all at some significant expense to either VRK or ***? How does she explain the expenses which were incurred -post closing- if she claims that she has been ignored for weeks and months at a time? Escrow closed at the end of February, [redacted] 's three reports were written from mid-April yet Ms [redacted] claims that she was ignored for days.VRK and [redacted] have worked closely on this home: VRK as owner/investor and [redacted] as general contractor [redacted] has ensured that all construction was completed in accordance with industry custom and practice and applicable code requirementsIt has been paid in full for it's efforts, as evidence by the attached letter from one of it's principle.We hope that you will recognize that this entire complaint process is a ruse by a disgruntled homeownerEveryone who has become involved has concluded that there is no merit to her complaints and demandsWe hope that you will not be taken in by her fabricationsWe ask that you not further disseminate her defamatory comments about my clients, its principals and its contractorsWe expect that you will not further spread the callous accusations without a complete, thorough and independent investigation.Thank you very much for your understanding and courtesies.Very truly your, [redacted] ***

Please be advised that I represent VRK Group LLC ("VRK")One of my client's principals recently received the attached letter from Revdex.comAlthough there is a reference to a specific complaint, I was informed that nothing was attached and that the entirety of the information received by Mr*** was
the one page cover letterIn any event, my client's suspicion is that the referenced complaint was submitted by a Ms*** *** as VRK recently sold a home to Ms***Over the course of the couple of weeks since closing, Mr*** has asserted certain concerns with respect to the homeMy client and its general contractor have been extraordinarily thorough and responsive to those concernsIn fact, when Ms*** raised drainage issues, as an example, VRK hired *** *** *** to investigate*** is one of the most respected environmental and geotechnical consultants in the communityAt significant expense to the seller, the property had been properly designed and constructed, and that her concerns were unsupportableIn similar fashion, my client responded to each and every issue raised by Ms***Ultimately her lists of concerns was reduced to three itemsAll were addressed and all were resolvedThe last letter to Ms*** was written only yesterday as I was asked to confirm that everything had been resolvedThat letter is attached heretoWe hope that you will conclude that the report presented to you is entirely without merit and that you will therefore close your file in this matter.Very truly your,*** *** ** *** ** ***

I am rejecting this response because:On multiple attempts to reconcile outstanding items with VRK, LLC from our real estate transaction it was not until as final email was sent on April 2016, almost days after close of escrow that a response was received from Mr***This email indicated a complaint was to be filed with Revdex.com, experts were going to be hired and further pursuit at reconciliation would followPrior to this, myself as well as my realtor as well as the contractor involved were unable to obtain any response from Mr***-representative for VRKFurthermore, the items that were investigated and worked on at my home were at the sole and independent decision of *** *** ***No direction or authorization nor payment transpired between VRK to *** *** *** *** *** made an independent decision to attempt to resolve any outstanding issues to the best of their abilityTo this day- VRK has made no attempt to resolve any of the outstanding items, nor pay to resolve them as their stance has always been these items have been resolved, to which I disagreeI have hired an independent Geotechnical Engineering firm which denies ***'s claims there are no drainage issues- their work is incompleteOn numerous occasions I have asked drainage concerns including water under the foundation of the property, doors not closing properly, dry wall cracking and pooling water in the front of the home be addressedIt is also my understanding Mr*** declined to have proper drainage installed around the property due to cost reasons sacrificing the safety of my homeFurthermore, ***'s firm has been heavily litigated in the Rancho Murieta neighborhood therefore their expertise is questionable in this aspectFinally ***'s report specifies the drainage issues they address are solely on the West side of the propertyIt never speaks to the North and East sides of the property-therefore it is incompleteIn addition the Community Services District has taken a stance on the drainage concerns stating proper authorization and clearance by VRK was not obtained from them for the installation of drainage, therefore the culpability lies with VRK. Furthermore the dirt in the plumbing issues again was interrogated by *** *** *** under no direction or authorization of VRKThe "dirty water" was solely interrogatedA potential source was identifiedThis item was not fixed, there was no solution proposedAgain I have hired my own expert to interrogate the system as this unresolved issue effects the health and safety of my family as wellFinally in regards to the paint issue- again this issue was addressed by *** *** *** independently, under no direction, authorization or payment from VRK. I respectfully decline these issues have been resolved, nor that VRK has made an effort to resolve themI am more than happy to provide video and picture documentation for review however these can not be attached to this document.*** ***

I am rejecting this response because: Mr. [redacted], Please feel free to contact [redacted] the realtor who represented both myself as well as VRK in this transaction to verify my complaint as well as her position on this matter. Her phone number is [redacted]7 or her email is [redacted]. I respectfully disagree with the response provided. I have hired my own panel of experts whose reports are pending as we speak. These reports will refute the information and opinions provided. Review: Home was purchased from VRK, LLC. Outstanding items 60 days after escrow closed- water drainage issues left unresolved including water underneath home, dirt in pipes from showers, faucets and tub as well as unfinished painting issues. Attempted to contact company on numerous occasions, failed to stand by their product and address water safety issues as well as water drainage issues.Desired Settlement: Drainage to be fully engineered by Geotechnical firm and installed accordingly. Water quality assessed and resolution achieved. Painting completed.
