Ms. [redacted] is correct.  Due to a clerical error in our local Abney Lake office, her apartment was put on a vacant status, instead of an on-notice status.  When the apartment went on the vacant status our staff did what they normally do and when to the unit, changed the locks and removed...

trash from the apartment.  When Ms. [redacted] came to the office, the staff responded by going with her to her apartment where a plant, chair and tv remained in the unit, so clearly our staff did not dispose of everything that Ms. [redacted] owned.  Since the other items that were thrown out were still on site, our maintenance supervisor went to the dumpster and retrieved Ms. [redacted] property.  Ms. [redacted] picked through what she wanted and told us to dispose of the rest.  Ms. [redacted] then went to the office and signed a statement (see attached) that she had gotten everything that she wanted form the apartment and that [redacted] would be back to pick up the remaining chair, plant and TV.   Our Manager didn't suggest that the deposit was being refunded because of this issue, what the manager told her was that we would prorate the rent for the days that we took possession before the lease was up and refund that amount to her.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that the response would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.They are lying. I did not retrieve all my items because I had more of my mothers things, pictures , shoes and an 1000 tv stand my father had bought me. Those things were not in there. The only thing left in my apartment was my moms tv and plant they told me the only way my father could come back and pick those up for me was if I signed that paper so Kevin told me that was the only way my father could get in was if I released the apartment back over. As I said before these are things I can't get back. After Kevin apologized he then said he would issue out my full security deposit of 400 dollars! Nobody returned my phone calls and never the less the bottom line is they should have never been in my apartment before my lease was up! I lost also important documents w2s check stubs a lot of things that were not in the dumpster but inside my tv stand because it had a lock on their !! I'm very [redacted] and also hurt because I have been faithful to them over the years now they are trying to get over on me .

The pest issues were resolved.   Every resident is mailed out a statement showing the total due on the 1st day of the next month.  These are delivered by USPS on or about the 22nd of each month, so Ms. [redacted] should have known the exact amount due.  More over, Ms. [redacted] could...

have logged into our online payment platform which also shows the amount due.  The late fees are specified in the lease agreement and are charged at 9 AM the morning of the 6th day of the month, if not paid in full.  We do offer an OOPS program that will waive the late fees once in a 12-month period.  I did tell Ms. [redacted] about the program, she just needs to go to the office and sign the form.  As for her car being towed, she never got an extension from the corporate office and our staff does not tag and tow cars.  We have a third party that patrols our parking lots and tags vehicles that are not in compliance with the lease.  This third party towing company does not know who the vehicles belong to, they simply tag them if they are parked in violation of the lease agreement.  No one is harassing Ms. [redacted] and no one is retaliating against her.

Review: On June 21st I made an money order to Abington Apt for an unit holding fee of the amount of 100.00. Because I get housing assistance (section 8) we have to wait on their processing. Unfortunately my housing assistance caseworker told me that Abington apartments wasn't affordable enough for me to live there, so they denied the rent. As Abington apartment policy the holding fee is refundable, I have called and spoken to several different mangers concerning this prolonged period of time. I have call [redacted] out in Chicago,IL ( CEO of Company) [redacted] in Indianapolis,IN ( Regional Director) and [redacted] in Indianapolis,IN ( Abington Apts Manager) all three have not returned my phone call or have contacted me to see if this matter has been resolved and I am tired of all the promise not being met.Desired Settlement: If possible because of all the confusion I would like to pick a check up at the Regional Director office for amount of 150.00 because of the inconsistent matter I had to endure and still enduring because three months has passed and l still have not received anything, and this is causing confusion and frustration on myself because of them.

Ms. [redacted] did pay a deposit of $100 and is entitled to a refund. We sent her check out on 8/28 and we received it back and Ms. [redacted] claims not to have received it. I spoke to Ms. [redacted] that our policy is that a check has to be "lost" for 30-days before we will pay the fees to stop payment and issue a new check. A replacement check was sent to the same address in Ms. [redacted] complaint for $100 this week.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me. I was told by the Regional Director that an check was supposed to be issued last Thursday and haven't received anything.I would like to know the exact date the new check was issued. I have been looking for it all week in the mail.I have enclosed the money order receipt to show you how long this matter has been going and long over due.
