1) Attached is the letter that I sent to Mr [redacted] on september 7th (after the job was completed and paid in full), which includes my reasoning to this complaint2) Attached is also an inspection report that was completed by a Professional and licensed Wood Flooring Inspector, which CLEARLY states that the flooring was installed properly and any creaking was due to excessive wax that was used in the flooringWhich is a manufacturing defect, not an installation issue3) Attached is the contract that Mr [redacted] signed, stating "Wanot Flooring has NO WARRANTY on customer products including installation services that include any broken transition pieces or moldingI specifically state this in my contract because there have been incidents in the past from warped floors or products being defectiveVery Similar to this situationMr [redacted] is threatening to sue my company because he has no one else to go afterSince [redacted] wouldnt return his product due to the water damage from the ceiling that ruined the floor and is blaming me for faulty installationI have 100's of referrals and have completed jobs successfully after Mr***s floorsI have names and numbers of all clients that will act as my defense if this situation boils over to courtThis issue is clearly not due to faulty installationCharges including lawyer fees, trauma, and more will be places if this issue gets set to court In the flooring invoice that Mr [redacted] signedThe 2nd line reads "this contract may not include additional labor and material which may be required should problems ariseBased on Mr***s evaluation, he believes problems did arise and a Professional Inspector was sent over to his home for evaluation of the floorsThat inspector cost $300, which is Mr***'s responsibility and which he never paid forWanot Flooring paid for the charge and is still awaiting payment from Mr*** The total amount of the job was Mr [redacted] dispute amount is Which makes absolutely no sense, 10,is not a reasonable amount for flooring installation, since wanotflooring charged totalWanot Flooring is NOT responsible for carrying costs as well as that has nothing to do with the service that was completed or the contract that Mr [redacted] signedFinal payment and signature on 8/28/1, INDICATED your acceptance of the work performed ***SUPPORTING DOCUMENTS REDACTED BY Revdex.com***

Here is response to Wanot Flooring
I never called any inspector and nor any payment was part of any contract..I have made all the payments as per the contract for the installation of the floorI considered you professional and I made all the payments per the contract.Wanot flooring did not even bother to correct faulty floor installation,Wanot flooring claims it is the floor (he called his friendly inspector and on top of he ask me to pay for it), but the letter from the *** *** after inspection, clearly indicate it is installation and not the woodYou have completely refused to take any further action to correct creaking noise issue from the floor you installed, despite giving you more than days. This force me to the whole floors.Just to update you, I HAVE NOT " FAILED to pay", but I don't owe you any money, I have paid you full amount for the floor installation, I owed, even you finished your projectBut It was my bad luck that I trusted you and hoped you would do the job as professional installer.You brought the inspector to defend your self in court, but NOT at all to address the issue of creaking noiseThen you are asking me to pay the inspector for you.Even *** *** brought there inspector to find issue, they paid themselves.If you tried to damage my credit or any try to do any harm, those commulative damages would be in addition to the following damages.So you are given final notice to pay pay us by Nov 7, 2015, which clearly is the installation issue, as per *** *** report. The full re-installation cost of the hardwood, $10500, House carrying cost of the house for days=$(house carrying cost is $8800/month Xmonth)The more you delay, the more this cost would add.I would be taking the matter to Revdex.com, deptt of licensing and then finally to courts
Here is actual eventsJust to clarify you, here are actual eventsWhen you first day you installed the half floor Aug 26,, I told that it is creating noises/squeaking, on Aug 2015,@ 11:51AM, per textYou said those not from floor installation.. At that time there was not any drop of water on the floor.Text Aug 2015,@ 11:51AM "Alex, Thanks for putting the floorI observed that the squeaks/noise in floorJust wondering if you could make that it does not squeek and gaps in planks end surface or surface when joining together"I texted you again, that these are creaking noises are from the floor/jointsI paid you the full payment, to clear the bills not to remove you from the liabilities of the floor installationAlso you have the warranties for the floorI was supposed to fly to california on Aug 28, , I paid you full ($2909) in good faith, even before you finished your work, that you would take care of any issues with warranties. At that time there is no water drop on the floor.Text Aug 2015,@ 8:28AM "I think those click noises are from click joints of hardwoodI would be leaving by 9am"I texted again Aug 28,2015, 3:PM, I again asked you via text that why floors is making creaking noisesYou said give floor a couple of weeks to settle.. At that time there is no water drop on the floor.Text Aug 2015,@ 3:PM "Just wondering why the floor makes clicks, is it possible that tongue and groove might not be positioned properly or if you have not cleaned the subfloor before installing" I again asked on Sept 1, 2015, 9:AM, via text that why floors is making creaking noisesYou said might it is not padding.. At that time there is no water drop on the floor.Text Sept 2015,@ 9:AM "Just wondering why the floor makes clicks and making noise, is it possible that tongue and groove might not be positioned properly or if you have not cleaned the subfloor before installingPls come on Saturday and have a look at the issue" I again asked on Sept 2, 2015, 12:PM, via text that pls plan to fix the creaking noise in floorYou said you would come on Saturday... At that time there is no water drop on the floor.Text Sept 2015,@ 12:PM "Please plan to fix the floor creaking noise on Saturday, when you come for molding "I again asked on Sept 3, 2015, 4:PM, via text that floor is making creaking noise, we are not all happyYou said this is nothing to do with installation.. At that time there is no water drop on the floor.Text Sept 2015,@ 4:PM "Alex, the floor is making creaking noise, we are all NOT At all happy with floorPlease /come and fix it on Saturday 9/5"Sorry for putting your name as AlexI again asked on Sept 3, 2015, 4:PM, via text that floor is making creaking noise and the underlayment could be the reason per *** ***You said call the manufacturer.. At that time there is no water drop on the floor.Text Sept 2015,@ 4:PM "I talked to *** ***, they say it could be underlayment, you installed*** *** want piece of lament, I would give it to themcreaking noise is major issue me and I want it resolved."You came on Saturday, you started reviewing the floor on 9/5/At the same time my contractor was working upstairs putting the washroom fixture and testing for the waterthere was some water drops from upstairs while my contractor was working testingMy contractor immediately stopped the water test and no more water came from top floor.ON 9/7/you sent letter that since it water damaged the floor, so it is creaking the noise.It clearly indicates, that the floor has been creaking/noise from the first day of the installation, I have given you enough notices to fix or pay the damages, But you have never addressed it.
Here is how *** *** letter concludes,
"During the inspection the inspector observed and noted, there was no expansion spacing at least in spots of the installationThere were many spots where the spacing was at least 1/8th of an inch or lessThere were no T-moldings in doorway areasThe acclimation period prior to the install was also incorrectA mildew resistant sealant was not used in the kitchen
On the day of the inspection, the relative humidity in the home was 63% (high) and the temperature was degrees (normal)Also, there were moisture test taken although they were within the recommended levels they were on the higher range of those levels."
The more you delay the more damages would be added up in claims.*** ***, report noted in the report conclusion, that it is the installation and not at all the manufacture issue.Sincerely,

I specifically state this in my contract because there have been incidents in the past from warped floors or products being defective. Very Similar to this situation. Mr. [redacted] is threatening to sue my company because he has no one else to go after. Since [redacted] wouldnt return his product due to the water damage from the ceiling that ruined the floor and is blaming me for faulty installation. I have 100's of referrals and have completed 6 jobs successfully after Mr. [redacted]s floors. I have names and numbers of all 6 clients that will act as my defense if this situation boils over to court. This issue is clearly not due to faulty installation. Charges including lawyer fees, trauma, and more will be places if this issue gets set to court.
In the flooring invoice that Mr. [redacted] signed. The 2nd line reads "this contract may not include additional labor and material which may be required should problems arise. Based on Mr. [redacted]s evaluation, he believes problems did arise and a Professional Inspector was sent over to his home for evaluation of the floors. That inspector cost $300, which is Mr. [redacted]'s responsibility and which he never paid for. Wanot Flooring paid for the charge and is still awaiting payment from Mr. [redacted].
The total amount of the job was 2909. Mr. [redacted] dispute amount is 23700. Which makes absolutely no sense, 10,500 is not a reasonable amount for flooring installation, since wanotflooring charged 2909 total. Wanot Flooring is NOT responsible for carrying costs as well as that has nothing to do with the service that was completed or the contract that Mr. [redacted] signed. Final payment and signature on 8/28/1, INDICATED your acceptance of the work performed.
