Complaint: [redacted] I am rejecting this response because: Regards, in Lou of my going into this restaurant previous times I have had to alert the waitress and speak to the cashier about the receipt lowered because I was not happy with the way the food came outThey greatly did lower the bill on their behalfBut on this occasion recently, the owner was rude to my boyfriend who went into speak on my behalf of me getting sick and may have exaggerated but where is this manager when there is the cluase that reads, "The customer is always right.?" The owner only took down my name and offernd me no sustitudeMy boyfriend did pay for the meal and there were items ordered extra on that same ticketThe waitress was not rude but the way services are there, we could of gone somewhere elseI was a party and a guest with my son of one and my boyfriend and his fatherI felt that this owner was completely refusing to refund some or even one of the meals that I did end up getting very sick from that day soon after eating in the restaurantI believe that the owner should have some hospitality training when it comes to us as customers making a formal and verbal complaint instead we we're treated rude upon coming back in that very next morning to speak with the ownerMy boyfriend did pay for the mealsBut a fabrication on me getting sick is unjustified by the ownerHe wasn't there when I was throwing up the mushroom egg omlete that was made by employees that did not wear gloves or facial masks and the grill that was scattered with food for the different orders on that day because it was very busyI conclude that this is not a fabrication and that I was truly sick and just as a customer should do in talking to the manager/owner, the owner should of handled it better and I request a full refund for the mealI understand that they will not serve me or have had prior issues with me on eating at their facotlity but that is beside the pointI am still a human being and as a customer, the owner didn't do his jobHe was rude and inconsiderate and I was only trying to speak for myself and my boyfriend because I got very sickI would like to conclude that if there are any results in this matter that a full refund be made to [redacted] ***, Phonenumber # [redacted] A response should be to him in this matter because he did pay on the food being purchased for a full refund [redacted] [To assist us in bringing this matter to a close, the consumer must give a reason why they are rejecting the responseIf the consumer does not provide a reason the complaint will be closed Answered]

After visiting with the owner of Nash & Associates about landscaping work we wanted done, we didn't hear from them for weeksThen one day I opened my front door to see a crew of men tearing my front yard apart! They were cutting tree limbs and had a machine on my lawn digging out the grass I yelled, "What are you doing?!" The guy in charge said, "I rang the doorbell, but no one answered, so we just got to work." After telling him to stop immediately and get his boss on the phone, I was told this mistake was MY fault There was never a contract signed to do workAll we ever got was a bidThere was no contact from Nash for weeks, except the morning that they just showed up and ruined my yard(We had hired someone else during those weeks to prune our trees, so Nash had been cutting off branches from a tree that didn't need it anymore.) The worst part was being blamed by the owner that this was all MY faultNo apologyNo offer to make things rightNothing They literally took the grass they had just torn out and put it back on the groundUnbelievable!

[redacted] presented on 11/for lethargy since 11/and history of chewing the corner of an [redacted] a week prior [redacted] had vomited carrots twice on 11/and vomited twice (his food) on 11/Owner was concerned he may not have had a bowel movement eitherThe examining doctor (DrA [redacted] ) felt ***’s abdomen to be distended, tense and seems to be painful upon palpation and recommended x-raysRadiographs indicated “the exact nature of the gastric contents is unknown, the possibility of foreign/indigestible material might be considered given the history providedRecheck radiographs after a –hour fast in the hospital might be considered to assist differentiation between food and foreign/indigestible gastric contents.” The doctor discussed possible exploratory may be necessary if the material wasn’t moving He gave her the option for exploratory that night He also presented and estimate for IV fluids and repeat radiographsOwner elected to take [redacted] home and return for repeat radiographs the following day [redacted] re-presented 11/for progress exam and repeat radiographs The doctor (DrW***) palpated his abdomen to be “soft but full” and noted in her record “foreign body” for gastrointestinal findingsRadiograph report the stomach contains a “moderate amount of liquid and granular opaque material The degree of distention is essentially unchanged from the previous study The small intestine is fluid and gas filled without evidence of distentionThe persisting distention of the stomach strongly supports a diagnosis of gastric outflow obstruction Surgical intervention is likely indicated An ultrasound examination or upper GI study could be performed to confirm the diagnosis.” The doctor recommended surgical intervention, ordered blood work and introduced the client to the surgeon for the day (DrO [redacted] ) The bloodwork indicated [redacted] had hepatopathy (Elevations in liver enzymes/etc) so the surgeon recommended abdominal ultrasound to assess for portosystemic shunt or microvascular shunt The ultrasound was performed late in the day, so the decision was to have [redacted] be on IV fluid support overnight for a surgical exploratory on 11/23, which the [redacted] ’s were in agreement with this plan As the ultrasound would not be performed until late in the day the surgeon introduced Mrs [redacted] to the surgeon who would be scheduled the following day(DrD [redacted] ) The ultrasoundographer also recommended surgical exploratory with biopsy of the liver for futher clarification of ***’s disease Throughout, the owner was kept apprised as to the diagnostic findings, the costs and the medical and surgical plan appropriate for ***Mrs [redacted] was well aware of the plan to have [redacted] rehydrated overnight and taken to surgery the following morning [redacted] did well overnight, was alert and comfortable in the morning He was prepared for surgery early on 11/He was already prepared and moving into the surgical suite when Mrs [redacted] came into the clinic to see him unbeknownst to DrD [redacted] to visit *** Unfortunately, [redacted] did go into cardiac arrest shortly after beginning the exploratory Cardiopulmonary resuscitation efforts began but were unsuccessfulDrD [redacted] called the owner who came in to visit with *** DrD [redacted] answered Mrs [redacted] ’s questions with regards to why it was important to remove the gastric foreign material in order to move [redacted] forward with careMrs [redacted] had asked DrD [redacted] to tell her what was actually blocking ***, so DrD [redacted] re-opened [redacted] to find a large amount of carrots (presumably from 11/or earlier) causing a gastric outflow obstruction/blockageOwner elected to take [redacted] to [redacted] (who performed his cremation) where her family could stay in a comfort room Regarding the estimate and costs: Her first visit with DrA [redacted] on 11/was $(exam, radiographs, antiemetic, SQ fluids) The surgical estimate ranged from $3470-$which indeed included several days of hospitalization, gastrotomy, enterotomy, neuter, microchip, antibiotics, pain injections, antiemetics, miscellaneous treatments, some of which were not performed and therefore not charged to the owner)The [redacted] ’s qualified for [redacted] for $and paid $with a ***At the close of the case, Sunset refunded $to the [redacted] ’s ***The actual charges for [redacted] included abdominal radiograph follow-up, abdominal ultrasound, on day hospitalization, miscellaneous injections, IV catheter, blood work, surgical suite fee, surgical nursing fee, surgery supplies, fluid administration and fluid pump, anesthesia, CPR injections, liver biopsy and pathology, cremation services (private with ashes returned); all services that were performed in the best interest of [redacted] and with sensitivities toward the [redacted] ’s Unfortunately, we are not always in control of the outcome of sick patients [redacted] was less than ideal surgical candidate due to his hepatopathy however it was medically necessary to surgically remove the gastric outflow obstruction before we could truly understand his liver dysfunction and address that part of his disease

Complaint: [redacted] I am rejecting this response because: I have been promised this refund several times prior to this and it is always the same reply when I inquire as to why I have not received it; "the check is (or will be) mailed and you will receive it by next week". I have no trust in this reply anymore as it has gone on for six weeks. We are aware of the problems this customer has noted in her complaint and at this point there is nothing further we can do as the vehicle has passed all diagnostic testing according to Mercedes-Benz standards. As of 12/9/16, this vehicle had 111,miles on it Here is an overview of
what has gone on with the vehicle since November 2015: 11/9/- Transmission electrical control unit damaged from fluid leakUnit was replaced and also damaged wires were also repaired 12/7/- Transmission converter also damaged from control unit failure, replace by dealer. Customer only charged for part as a goodwill gesture for customer retention. Vehicle left the dealership operating to Mercedes-Benz specifications 11/10/- One year later customer returns for hesitation and poor performanceService Department found evidence of rodent infestation, electrical issues, and clogged filters. It was recommended replacement of the battery, air filters and inspection and possible replacement of spark plugs for proper engine performance. Dealer recommend customer contact insurance company for possible claim coverage from rodent damage. Please see attached photos of rodent damage. Recommended repairs denied by customer Also, advised customer Mercedes Benz warranty for parts are one year, and dealer’s warranty for labor is daysControl unit and converter installed by dealer tested and passed 12/9/- Inspected customer car again at customer request for transmission concern. Performed diagnostic inspection of transmission, no faults foundProvided customer with finding and reviewed past findings including loss of heating system. I am rejecting this response because: I'm writhing this letter because I'm not satisfied so I reject this letterThe reason why I'm rejecting this letter is because intercar charge hours labor to remove and replace an engine when it's suppose to be hours labor time my third party warrenty company was not going to pay for hours labor time When it's suppose to only take hours labor time when they told me that it take hours and my third party warrenty company was not going to pay it I told intercar that I'm going to take my car elsewhereIntercar told me if I decide to take my car elsewhere intercar was going to charge me $for diagnosing my engine I had no choice but to leave it there when I needed my car for workThe third party warrenty company only paid for the hours labor time and I had to cover the rest out of my own pocketI ask the for a detailOn 10/14/in an email from Linda Daniels they said " if I'm "If you are not in agreement with our starting price as quoted and cannot sign the paperwork, then please make immediate arrangements to have the vehicle towed off our property."this is when I decided that I didn't want them to do the job with intercar but they made it very expensive for me to have my car towed off there propertyI well like to get reimbursed for the extra hours intercar needed to repair my vehicle Sincerely *** ***

The [redacted]’s qualified for [redacted] for $2300 and paid $960 with a [redacted]. At the close of the case, Sunset refunded $568.81 to the [redacted]’s [redacted]. The actual charges for [redacted] included abdominal radiograph follow-up, abdominal ultrasound, on day hospitalization, miscellaneous injections, IV catheter, blood work, surgical suite fee, surgical nursing fee, surgery supplies, fluid administration and fluid pump, anesthesia, CPR injections, liver biopsy and pathology, cremation services (private with ashes returned); all services that were performed in the best interest of [redacted] and with sensitivities toward the [redacted]’s.   Unfortunately, we are not always in control of the outcome of sick patients.  [redacted] was less than ideal surgical candidate due to his hepatopathy however it was medically necessary to surgically remove the gastric outflow obstruction before we could truly understand his liver dysfunction and address that part of his disease.

response is a lie. Customer is not satisfied and if Mike M** is not going to redo the job himself to our satisfaction then I would like a full refund.

We used Nash and Associates to do our design and installation of all landscaping, front and back, concrete work and outdoor kitchen. Cody was very professional and the end result is simply captivating! We even had an open house to show off the yard. Some of our neighbors even asked for cards. We had a few changes during the project and the guys from Nash made them with no fuss. These guys have been doing this a very long time and if your looking for a real landscape architect and a installation crew they are going to provide the best quality in the area!

Repair orders from [redacted], clearly states additional diagnostic time was needed and that customer denied further diagnosis.  It also clearly states there is observation of rodent damage.  Intercar's original statement stands.  If this customer would like to pursue further action I will provide them with the name of our legal counsel.

The complaint is accurate, however we did go back and correct the situation ,and it was approved by customer.
