The car I bought was said to need tires and brakes but the shop I took it to says it isn't repairable due to terrible corrosion. Its not roadworthy.
The website says this car is in excellent condition and does note some corrosion and rust spots on the car due to bring up north. I looked at the car and the sales guy said it needed tires and brakes... I asked his honest opinion because I was getting it for my daughter. He let me drive it but it was pretty rough due to the tires being dry rotted and the brakes scrubbed. There was a *** right next door so I gave him a cashiers check at 10am on Saturday May 30. I dropped the car off next door for them to work in due to not having available appointments. About 2 1/2 hours later they called me with concerns and asked me to come down there. I called the owner right away to see if I could return the car but he simply said they were trying to sell me a bunch of stuff because that was their job. I went to the shop and they showed me many things and said everything under the car was so corroded that it was not safe for the road and they did not feel they could make it safe... it should be sold for salvage only. The manager said it's the worst he has ever seen and could not take on the liability of trying to repair it it isn't roadworthy. They said it isn't even safe for me to move it and it would need to be towed. I went back over to the dealership and asked again if I could void this transaction I could not get the car repaired to be drivable and he said he couldn't. The owner was in the hospital and could only make that decision. The car was left at Tires plus (and is still there) as we tried getting in touch with the owner to see if we could return the car. We have had no luck and now are filing a civil suit. I feel they were less than honest selling this car -which if it was repairable I could understand it was "my mistake" for trusting the sales person and I'd just have to fix it. However, to sell a car that isn't deemed drivable due to safety issues that are beyond repair according to a professional shop is just wrong. I can't even sell the car to someone else knowing that it is in such bad condition underneath. The dealer did offer to let me trade it in for less than I just paid and get another car that is worth $3500 that he wanted $7000 for and I just can't do business with someone that isn't honest and put that much money plus want I lost in the "trade" into a car not worth it. Any transaction should be able to be canceled within 24 hours..... definitely within 3 hours!

Desired Outcome

I would like to resolve this and return the car and get my money back without taking out a civil suit but I will not just accept what has happened without a fight if that is what it takes.

We were upfront and honest in the transaction referred to by Ms.. There were 49 pictures on our website of the vehicle, many of which were close ups of the corrosion/rust, to ensure that anyone that looked at the ad would know there was substantial corrosion on the vehicle. A direct quote from the ad on our website states, "This car has lived the bulk of its life up North...So it does have rust....and is priced accordingly." "The exterior is as pictured, and undercarriage has corrosion." Furthermore, Mrs *** was told no less than 3 times before she purchased the vehicle that if the exterior matched the interior, the car would be $8,000-$9,000. Mrs. was the one who pressed the issue of trading the vehicle back in and proceeded to pick another vehicle out. She determined it was not to her liking and left. While talking with Mrs., her mother was sitting in the lobby as a previous customer walked in. Mrs.' mother, unsolicited and without being engaged by anyone, proceeded to tell our previous customer to leave...as if she knew what was best for them, and do not purchase anything from Wallace Automotive. On June 1, 2020 Mr. came into our store wanting to return the vehicle. When he did not get the answer he wanted, he strongly inferred litigation if he could not return the vehicle immediately. No more than five minutes later, Mr. stated he had already been in contact with his attorney about the matter. It was at this point, communication was ceased. We have always done whatever possible, to go above and beyond in making sure our customers are satisfied. We couldn't have been anymore transparent before and after the sale. This is why we made certain to lay out the facts of this vehicles current condition, before posting it for sale.

I adamantly asked to return the car and cancel the sale but that was denied. I only then asked if we could just cancel this transaction for that car and purchase another car... the salesman is the one who offered a trade in but the car wasn't worth the money I was putting in it and it was twice what I had budgeted. The pictures on the website show some rust spots and a fender scrape on the exterior of the car body. There are pictures from under the hood but it doesn't show the rusted parts under the hood nor is there any of the undercarriage. The website says their cars are inspected and mechanical issues are fixed before putting the car on the lot for sale and the documents are in the office but they would not show them to my husband when he went to talk to them and asked to see them. In good faith I trusted the great description of the car and the need for tires and brakes and felt it was still a good buy. The mechanics that looked at the car have serious concerns with the cancerous rust of the whole undercarriage and question even the safety of trying to put it back on the road. They felt it was to high of a liability to even attempt repairs and the car should be for salvage only. I have no choice but to go to court if we can't return the car. I cannot afford to buy a car and have no use for a car that can't be driven.
