Initial Business Response / [redacted] (1000, 8, 2016/06/28) */ Re: Case [redacted] We are responding to the above customer's case upon receiving your letter, and we find ourselves confident to say we have applied and done everything that was in our hands to assist and satisfy Mr. [redacted] .... Reeves Fence Services signed a contract for work to be performed on the above customer's residence which involved fence and pergola. At such time customer was told, of specific HOA approvals and permits would be needed an approved before any work could be performed. We applied for Mr. [redacted] 's permit at his Town's Building Department the process for his permit took longer than normal, the town was contacted and asked status: we were then informed by the building dept. that they had no HOA approval received from his subdivision. Mr. [redacted] was contacted and he requested HOA to send approval once more. After another week had gone by, we then proceed to request status again; and we were told it was not ready and we would be contacted once permit was approved by his building dept. A few days later we called, and left 3-messages to obtain status of permit, but never received a response. Once permit was issued, the job for his fence was scheduled and completed, within all this confusion and delays, Mr. [redacted] was being informed of the status on the permit, and the town's delay. The town of [redacted] Building Dept. is under new process of permitting issue in charge people, it is becoming extremely out of organization, and service to contractors is being poor and rude. We at Reeves Fence Services have no control on The Town's actions and work ethic organization. Reeves Fence Services completed the fence and billed Mr. [redacted] for the fence job only, which was specified on the invoice sent to him. We did not hear back from him until a few days later, and he stated not being happy he was billed for the fence job completion. It was never mentioned by him having issues with his fence, when the fence was completed. His complaint was for a rail end caps on his gate upright, which was missing off the frame. At that point, [redacted] responded back to him and mentioned to him Reeves Fence Services was having email and server computer problems, Mr. [redacted] was contacted and informed that our installers would be going back on the same day to correct the problem. Mr. [redacted] the complaint of a section not being done to his request, which was changed by himself from the original contract versions, as our crews were working on the site, he commanded our installer to do his request himself, he then complaint it as not to his satisfaction. He then emailed and stated he no longer wished to have the 2nd part of his contract on the pergola job performed, he then mentioned he wished to cancel this part of the job; although we were in the process of scheduling the install for this portion of his job. Reeves Fence Services did everything we could to assist and completed hisjob. However, there are certain thinks that were out of our hand. Is this case the HOA Building Department permitting issues and approvals. Moreover, Reeves Fence Services is confident and content as we did everything possible to keep his job moving forward and to keep him satisfied; He still seems not to acknowledge, or take in consideration that permitting and HOA circumstances are our of our control. Therefore, we have billed only for the fence job completion since there is no more pending work to be performed. For the most part, [redacted] Fence ignored our calls and emails until we contacted the BBB. We should have read the other complaints online before we made our decision to go with [redacted] . Not being able to deliver the product in a timely fashion as promised was most disappointing. They did come back and put the last two fence caps on, but did not come back to reinstall the removable section to the correct spot. We sent our final payment in to them and want nothing more to do with them. Please see the letter that was sent. Thank you for your help.

Mr. [redacted]'s issues were brought to our company's attention by our customer, Mrs. [redacted] late on the afternoon of her fence installation, Oct 12, 2015. Mrs, [redacted] informed Maria, our sales representative, that Mr. [redacted] said that our...

crew damaged
his sprinkler head. She also informed Maria that she wasn't sure the sprinkler system was functioning prior to the fence installation as she hadn't seen it work all summer. Maria told Mrs. [redacted] that we would contact Mr. [redacted] in the morning to discuss his complaints.
The next morning, before Maria could settle into her desk, Mr. [redacted] called complaining about our crew allegedly stepping on his property and damaging his
sprinkler head. He also complained that no one had called him from our company. Maria tried to explain to Mr. [redacted] that she learned of his issues late the day before
and hadn't had time to call before he called. She also told him she would inform her boss and that she would have her boss contact him. Mr. [redacted] was very hostile with
Maria arid it took her several minutes to relay this information. Maria discussed the situation with Mr. Reeves and he (Reeves) told her that he would meet with Mr. [redacted], along with the crew chief, to look at the damage and plan a course of action the next day; and for her to call Mr. [redacted] to tell him, which she did. Again, Mr. [redacted] was hostile but agreed. At no time during Maria's conversations with Mr.
[redacted] was she rude, nor did she tell him that we sublet the fence work to another company. Here, Mr, [redacted] is completely mistaken about the facts.
The next day, two days after the fence installation, Mr. [redacted]'s neighbor, our customer, called our office and told Maria that an irrigation company was at Mr.
[redacted]'s, doing repair work on his sprinkler system. The neighbor spoke with the irrigation crew and they said that the repair would be approximately $ 75. Maria relayed this information to Mr. Reeves and he told her to call Mr. [redacted] and tell him that we would pay the $ 75 for the repair. We have not received a bill to date.
There are some points that need to be made in this situation. First, Mr. [redacted] was
home all day the day of the installation, yet he did not go and speak with our crew concerning his sprinklers or that they were on his property. Had he done so, I am quite sure that this entire issue could have been avoided. Instead, Mr. [redacted] berated our employee, who had no first-hand knowledge of the damages allegedly caused by the

installation of our customers fence. Second, Mr. [redacted] wants to make it seem that we have ignored his complaints_ This is simply not true. Mr. [redacted] never told us about any leaks to his sprinkler system. All he complained to our office about was the sprinkler head did not function properly and our crew walked on his property. Our company was not aware of any leaks until we received the letter from the Revdex.com.
While it is possible that damage to the sprinkler head may have occurred during the fence installation, Mr. [redacted] has offered no proof that our crew caused the damage. What we know is that our crew did work next to Mr. [redacted]'s property. As to the extent of damage, Mr. [redacted] has preferred to contact everyone other that our company to discuss the situation.
What Mr. [redacted] is asking for, a "cart blanche on sprinkler repairs for next spring, is not going to happen. What we require now is proof, in writing, from a neutral party, that the damage to the sprinkler head is a direct result of our work. That has not been given to us as of this date. Once we receive this proof, then we will pay for the repair to the one sprinkler head that is in question. Mr. [redacted] may have issues with his sprinkler system that are unrelated to our work. We will not be held liable for those issues. We believe this to be a fair solution to the situation.

No I do not accept the response. First of all my sprinkling system was not repaired. The system was shutdown for the winter . [redacted] in highland Indiana installed my system and tests my system yearly. They turned my system on in July and tested it. Report was sent to the town of Dyer by [redacted] I have a separate water meter that records gallons used on the system . Also my water bill shows 2 readings one for the house and one for the sprinkling system. I have my water bills to prove the system was working. Maria was the one that said the job was sublet to another company. This is why I went to the town of Dyer to see who the permit was issued to. She also told me that she was to busy with other customers. Like I didn't matter. Also she made a statement that she took pictures of the sprinkling heads where they were digging. So they knew that the sprinkling system was there. Those posts should have been dug by hand because of that. I gave Carolyn [redacted] a estimate copy from [redacted] It says right on the copy it is a estimate. Also it states south side of fence close to porch area line was cut during fence installation. System to be rechecked after repairs to insure no other problems. I would suggest Reeves to get a copy from the Romanos. Because they won't call me. The Ramon's bbq daily. The. sprinkling system is on 3 to four times a week. If she can't see it working she needs a pair of glasses. My property was damaged no one could careless. The leak is underground needs to be dug up and checked to see exactly what needs to be Repaired. One of the sprinkling heads where they dug was having problems going down. Until the under ground leak is repaired then they can check the sprinkling head. It is really a shame the way I have been treated when I did nothing wrong to anyone and they are trying to make me the bad guy.
Shame on you and the disrespect of my property. You damage someone's property you pay to fix it.
