Mr [redacted] ’s truck was sent to our shop to be diagnosed after leaving the shop in HaydenIdaho in that aforementioned letter from Mr [redacted] That shop didn’t damage his engine,however they did miss that there was a problem with his engine blockThe truck was shipped toour shop and the initial tear down was doneUpon tearing down the engine and having theblock tested by an outside machine shop, the conclusion was made that there was a pin hole ina cylinder wall The question was then posed of how to proceedAfter which Mr [redacted] informed me thathe didn’t have the money to build a new engine at that pointAnd a firm answer wasn’t given tostart work on the vehicleWe cleaned up the parts that were taken off of the vehicle and storedthemThe truck was then parked outside the shop until Mr [redacted] could get ready for the build.Parts were purchased for the build but no money was offered to be sentAround the middle ofDecember after Mr [redacted] tried to get [redacted] to pay for the money we were told that acheck was on the way to the shopThis was to help with the buildMr [redacted] had said in e-mailit was getting sentHowever we never saw any money to get the build startedMr [redacted] wasgiven in estimate, which wasn’t implied was a final billThe estimate was assuming that someparts would be salvageable out of the engineupon inspection it was deemed they were not After the truck was brought to our shop was the mention changing turbosThis wasrecommended not to be used in this application as it was a turbo that wasn’t built for theapplicationThere were as many steps taken with parts to help make the turbo lastHowever Mr [redacted] wanted it installedThe failure occurred when Mr [redacted] had the vehicle at a repair shopand it was on a chassis dynamometerWhich is to test the power of a vehicleThis is used forrace applicationsFailure from abuse isn’t covered under any manufacturers warranty New glow plugs were installed into the engineThe downpipe was difficult to connect tothe existing exhaust system which was done incorrectlyBut Mr [redacted] didn’t have the budgetto install a new exhaust system so it could be made to workThe exhaust wrap was clampedonThere isn’t one clamp only to use to complete that taskThe coating on the pipes wasprotected as much as possibleThe factory pipes have hoses or wires that come in to contactwith themIt isn't uncommon to have a few rub marks Mr [redacted] picked his truck up from our shop around months after he told us he wouldhave the money to pay for the truck when completeAfter many talks on the phone and Mr [redacted] trying to get a better deal a number was agreed uponThen is when a date for the truckto be picked up was tentatively setI had informed Mr [redacted] that we would like to put a fewhundred miles on the truck to make sure all was well before he left our shop with itHowever hehad purchased a ticket and had a shuttle deliver him to the shopWe hadn’t yet had time to testthe truck for the mentioned milageHad we been able to test drive the vehicle we would havefound that the injector cup wasn’t sealed and could have fixed it before the vehicle left the shop.This is what caused the fuel and [redacted] to mixMr [redacted] informed me of the issue as he wasdriving across the countryI offered to find a shop for him to go toHowever he stated he didn’twant to stopAfter continuing to drive for thousands of miles it caused the water pump to havepre mature failureI had made no attempts to avoid helping Mr [redacted] outI had parts sent tothe shop he chose to take his truck to in an effort to help him outEven though it clearly states inthe warranty that work must be done at our shop The invoice for the vehicle still has a balance of $owedMr [redacted] assured usthat the money would be paid upon pick up of the vehicleHowever he was at the shop with no ride home the distance he had traveled and we allowed him to take his vehicleWe wereassured that the balance would be taken care ofThere was no attempt at the vehicle beingbrought back to Irate Diesel’s shop so that the repair could be madeI had offered to repair theinjector cup and check over the truck The truck may have been washed had we had the time to go over the vehicle before Mr [redacted] showed up to pick up the truck on a rushed time lineHowever we also aren’tresponsible for washing vehiclesIt would have been a courtesy had the time been allowed.We (Irate Diesel) take pride in our workHowever when a customer is demanding avehicle on a short timeline after months have gone by of non payment and not having a definiteanswer on payment it is hard to start and complete workOnce a build of this size starts there istypically a deposit madeWhich we allowed Mr [redacted] to forego due to the extenuatingcircumstancesBut once told that all would be settled before leaving the shop and having thefinal bill before arriving to pick up the vehicle and failing to do so those words were broken.There is still an outstanding balance on the vehicleAnd no warranty work was ever denied tobe completed on the vehicleMr [redacted] chose not to come back to the shop We also have several emails of conversationsHowever no illegal voice recordings weretaken of Mr [redacted] , So we cant provide those as he canWe can forward over the email chain ifneeded as well as final invoices if neededIrate Diesel feels that all attempts to remedy thesituation were madeWe helped Mr [redacted] get parts when he took it to an outside shop forconvenienceEven though he still owed money and it was clearly stated in the warranty termsthat Irate Diesel didn’t have toWe do our best to be as fair as possible with everybody we dobusiness withPlease let us know if any other documentation is Ms***, the agent representing Mr***, on more than one occasion told Mr*** that we encouraged the owner, Ms***, to bring closure to the transaction, but we cannot force the
owner/agent, *** ***, to sell her property
The broker, *** ***, has been kept abreast of this transaction, and has spoken to Ms*** on several occasions, encouraging her to bring resolution to this transaction Additionally, Mr*** met with Ms*** several times regarding this transaction, and Mr***, in fact, repeatedly asked for a meeting with Mr*** Mr*** offered through his agent, Ms***, to meet or talk with Mr*** at any time
Mr*** has been informed that *** & Cocan immediately release his $earnest money deposit upon the signing of a Release of Contract between Buyer and Seller This is pursuant to State of Virginia Real Estate regulations His desired settlement request was given to Ms*** upon receipt Ms*** is willing to meet with Mr*** to bring resolution

I am rejecting this response because: The response from MrK*** includes completely statementsThis dealership continues to lie to oversight agencies and to customers about their actions (and inaction)We still do not have license plates, or title to the car, or any proof that MrK*** has taken any action to resolve the matterHis response to Revdex.com, blaming the delay upon the title agency and/or DC DMV, is untrue, which makes us doubt that a resolution is nearSince filing original complaint, we learned that dealer had filed our temporary tags under a name in order to avoid scrutiny from state of VirginiaHence we were driving a car for a month that was not listed with DMV as being owned by us.Recent history of this matter is as follows: - On December 1, 2015, because our third set of temporary tags was about to expire, we called dealership four times, leaving voicemails for Kurt K***MrK*** called back on 12/01/and said he had no update, but he would look for the fileHe promised to call back on morning of 12/02/Following his call, we sent an email to Kurt K***, Donna S*** (title officer), Roger F* (sales manager) and Kevin A*** (salesperson from whom we purchased car in September Our email reminded them in writing of our situation, and reminder MrK*** that he'd promised to call back the next morning (12/02/15) with a substantive updateWe asked MrK*** to acknowledge receipt of email and to confirm that he would be callingNo response.- On 12/02/15, MrK*** did not call usWe emailed all parties at Autonation twice, and called four timesNo response from anyone.- In the afternoon of 12/02/15, we filed a complaint with the Virginia Motor Vehicle Board (VMVB)The VMVB investigated and responded within an hourUpon looking up our car's VIN, they found that the dealership had obtained our third set of temporary tags by falsifying records submitted to Virginia DMVVA DMV does not permit more than two sets of temp tags to be issued for a carSo the dealership had switched the name of the purchaser for the third set of tags, using my wife's middle name as her last name*** *** *** is her nameInitial set of temp tags was correctly obtained for *** ***Third set was falsely obtained by submitting paperwork to DMV stating that it was for a different purchaser named *** ***- VMVB analyst contacted dealer on 12/02/and stated that dealer could be subject to penalties for these actions, and asked dealer to explain current status of submission of information to title agencyDealer admitted that as of 12/02/15, they had never submitted a request for title and plates for our vehicleNeither to the title agency, nor to the DC DMC- Evening of 12/02/15, Donna S*** contacted us and asked us to send another copy of our proof of auto insuranceWe have sent dealer proof of auto insurance three times (in September at purchase, in October during our request for update on license plates, and in November during our request for update)We sent dealer proof of auto insurance for a fourth time within thirty minutes of receiving requestDonna responded via email that, "ok, we will now submit all info to request title and license plates."Hence, dealer has admitted to us and to VMVB that until December 2, no action had been taken to obtain title or license platesMrK*** knows this, and his response to the Revdex.com, that the delay has been due to the agency they use, or to the DC DMV, is an outright lieWe will not accept a resolution to be filed with the Revdex.com that includes blatant falsehoods.If his response to the Revdex.com had been, "We apologize, we have not done our job, we have not made any attempt to be honest (or even in contact) with the customer, and we are only now after months beginning the process to obtain plates," then we would accept his responseBut his response is false, and therefore unacceptable, as up to this point we have seen no sincere attempt at resolving the issue on their partThe only factual information we received has come from the VMVB, upon their investigation into the matterAnd only after being threatened with penalties by the VMVB (for submitting temporary registration for the car under a name) did the dealer respond to our emails and phone callsWe still have not received a direct response from MrK***, either via email or phoneAnd we still have not seen any proof of the paperwork finally having been submitted to their title agency or to the DC DMVWe still do not have title to the car, nor license plates

[redacted],Thank you for your correspondence regarding [redacted]'s 2003 [redacted].  On July 9, 2015 we, AutoNation [redacted] Dulles, performed an oil change, transmission fluid service, and brake fluid service on [redacted]'s [redacted].  The mileage at the time was...

153,343.  The visit for primarily for routine service.  About two months and exactly 2,987  miles later, we received the unfortunate news that his [redacted] had broken down.  [redacted] and Auto diagnosed the failure as a lack of engine oil, which caused internal engine failure.  The vehicle was towed to us for verification.  During our diagnostic, we found that the vehicle would not start and there were multiple trouble codes on the dash.  There was little to no oil in the engine, however, there were no external oil leaks.  A visual inspection of the engine valvetrain revealed excessive sludge build up inside of the engine.  In my professional experience, if the vehicle did not have the correct amount of oil, or no oil at all, the failure would have happened within 5 miles rather than almost 3,000 miles.  Essentially, the vehicle would not have been able to be driven off the lot.  The sludge build up revealed that the vehicle's maintenance was neglected at some point of the vehicle's life.  Whether it was during [redacted]'s ownership or the previous owner, we can't confirm.  The lack of oil was caused by internal oil consumption.  We do not believe that the vehicle failed due to our neglect.  It is within our best interest to assist [redacted] by all means possible.  We value his business and want to work together to resolve this matter.  Although we are not directly responsible for the engine failure, we are willing to replace his engine at internal cost plus mechanical labor.I will personally contact [redacted] to assist in ever way I can.    Kurt K[redacted] GM

I just spoke with my property manager and staff and now have a full understanding of this situation.  Ms. [redacted] paid a deposit to the agent  on the day she was shown the building since she did not want to lose the apartment.  Ms. [redacted]'s deposit is held by the building owner in...

their escrow account.  We asked the owner to return Ms. [redacted]'s deposit immediately.  They informed us that they write checks on the first day of each month and we shared that information with Ms. [redacted].  
I spoke with the Property Manager and all five supporting staff; everyone had spoken to Ms. [redacted], her husband and her mother whenever they called and we did explain that the owner held the deposit, not Wilkins and Company Realtors.
RESOLUTION:
Ms. [redacted] picked her check up at Wilkins and Company Realtors, yesterday, April 28, 2014 at approximately 3:00 pm.
I regret that the owners of the property failed to return her deposit as soon as we requested it.

[redacted],Please see attached photos.  After removing the engine valve cover for further review, we identified that the engine has excessive sludge build up and tarnishing, which is caused by a long period of neglect.  The photos prove that our last service did not cause the issue at hand. Had we been aware of the internal condition of the engine, we would have advised against performing any unnecessary services.  We would be more than happy to refund [redacted] for the oil change service that he had performed on July 9, 2015. It is still within our best interest to assist [redacted] through this situation.  We are willing to extend our offer of replacing the engine at internal parts cost plus mechanical labor.  Regards,Kurt K[redacted]
