I have received this complaint I will explain this again [redacted] is trying to make me sound like a incompetent contractor and after all of this time I'm not understanding how this is even possible or make any type of since out of this matter .He talks about hiring adequate labor to install the composite floorboards correctly As I stated before there are two ways to install the floorboards and the hidden fasteners is there easiest of the two The composite screws are no cheaper and by no means any easier or faster to install Also as for the mold issue that's not true The spiral staircase was approved by the city of Cedar Park and the homeowner as well And yes during the bidding of this project there was a lot of changing on Mark's side which is understood when a homeowner is trying to improve there home it normally takes place And during this time I did have to adjust my cost to cover these changes .As for the header joist it is the first member installed on any deck or balcony This is untruthful I did lag bolt this member to the house before adding any floor joist or floorboards for that matter .The Inspector never told me that also the miss measurement on the staircase is not truthful the height of the balcony was determined by the second floor and the owners pool contractor poured the concrete patio under the balcony So therefore I had to compensate for these two measurements As for the termite damaged 6xpost All material came from Home Depot and was all special order including the post All joist and post are Pressure Treated material therefore water nor termites will harm this type of material [redacted] is not being truthful with these statements and I no longer wish to contact or be contacted by this owner This is a attempt to harm my company and my reputation by making statements which is Defamation of Character I will not set back and let these untruthful statements be talked about my company or myself I will be contacting my lawyer and will pursue with this case if this is posted on my Revdex.com site There is no truth to these statements and again I do wish things didn't have to turn out the way they did I had no other option but to stop all construction and leave the property I'm a very reputable and honest person if I had taken this homeowners money and not finished the job then yes I would have been in the wrong But as I stated before the first thing I did was contact the bank and told them to destroy the check that had my companies name on it The first check I did receive went to materials and labor to build the balcony I Did Not profit from this project in anyway whatsoever

I am rejecting this response because:***, I reject the business' latest response because: *** *** DBA ***s Custom Woodworks knows the truthfulness of my complaint and the accuracy of my details on the eventsHe should also know that I have photos, emails and other evidence and statements from professionals who will confirm the mistakes that were made by this companyI welcome *** to call his attorneyI have tried thus far to be as reasonable as I can to get him and his company to stand behind the contractual agreement made with meHe continues to refuse to make the situation right and continues to pretend that his choices and actions were somehow someone else's faultThe flawed support timber should have been returned and not used in the constructionI absorbed the cost to have this corrected after he walked off the job and refused to return my callsThe deck screws he chose were not designed for use with the PVC Wrapped composite boards that were usedThey did significant permanent damage to the boards installed the way he chose to do itI absorbed the cost to have them removed, replaced and reinstalled correctlyThere is a specifically designed manufactures deck screw for these boards which is meant to be used on the solid planks and the hidden fasteners are intended to be used on the grooved planksThe grooved planks where purchase so it is clear that *** either knew what fasteners were expected to be used or lacked significant knowledge of the materials and the manufactures installation optionsHe simply chose to do the job on the cheap with off the shelf screws not designed for these boardsThe labor costs to use the hidden fasteners and the cost of the hidden fasteners are no doubt Stephen's motivation for ruining these boardsThis is a sound and clear set of factsThe other issues already mentioned in previous response which demonstrate the companies lack of competence and experience also created cost which I had to absorb to complete the project I welcome the opportunity to present this information before a judge or other arbitrator who can easily see that not only did I lose money hiring *** ***, I continued to lose money correcting his significant mistakesThe project did not change from inception to completion from its original design, size, length square footage nor did the expected materials changeThe only thing that changed was the quality, competency and professionalism of the men who completed the project and the cost created by the rework to correct Stephen's significant mistakes Thanks *** ***

To whom it may concern , I did start this project in Cedar Park. The customer didn't fund this project it went through a bank . On every job we do we ask for 1/2 down and 1/2 after competition. The first half is to purchase materials and pay labor during construction. And in this case the...

floorboards where composite and took 2-3 weeks to receive. The bank did give me a check which I ordered the framing materials and did build the balcony and installed all composite floorboards. The costly mistake was with how we installed the floorboards. There are 2 ways they can be installed 1 - hidden fasteners or 2- they can be face screwed . Before we got started on his project I was building a 1,000 square foot composite deck in Lago Vista which this customer had decided to use the hidden fasteners which are very easy to install "a lot easier than screwing each floorboard down but once we close to being done the owner and I noticed that the floorboards where wavy and would slide back and forth so he decided to have me face screw the whole deck down . So I thought it would be a good thing to have the complainant come out to see this project since we hadn't started yet and show him the two options of attaching the composite floorboards to the joist . He was not able to come out I think due to his work but his wife did come out and meet with me and I explained everything to her . So I did build the complainants balcony and screwed the floorboards down . Which like I said its a lot more time consuming to screw each board down but it's a way better product. And that afternoon I received a phone call from him telling me that he doesn't like the boards screwed down he wants to have me remove all floorboards and order new and use the hidden fasteners. The cost of the floorboards and fasteners was around $3,500.00 - $4,000.00 so we did agree to do this . I reordered the composite and hidden Fasteners then a day later he wanted to change the spiral staircase for one that was way over what I had in budget for this So at this point I sent the banker a email telling her that I would not be continuing any more work at this residents and to void out the check that she had for my company . Just like I explained to the banker it was going to cost me thousands over budget to make this customer happy and he knew what he was doing to my budget I explained to him that it made no sense for me to have to pay out of pocket for him a new addition to his house . I did contact my lawyer before I did anything and was told there is just as many laws to protect us contractors as there is to protect the homeowner. Also if I had taken the customers money and did nothing I would have been in breach of the contract but as I told my lawyer all I liked was a little handrail and a set of stairs and I was done . 75% of this project was completed when I stopped due to thousands of dollars worth of changes . I really wish this had not happened I've been in business for 20 years and have had no problems at all with my clients. Thank you for your time .. I am rejecting this response because:This response further examples this companies lack of integrity, experience and professionalism. The story in this response is inaccurate. The gross incompetency in bidding as well as implementing the project are the only reasons this company was unable to complete the project with integrity and professionalism within budget.The materials to be used for the project including the TimberTech planks and fasteners were spelled out specifically in email during the project bidding process. I have emails which show the bid rising from his original bid to account for these materials. These details as well as the expected railing materials from Iron Fortress were also provided to each and every company which bid this project. I have emails outlining when and by how much each of [redacted]'s Custom Woodworks' bid rose to account for the desire to use these materials.My wife did visit a single job site on which [redacted] was a sub contractor in order to evaluate his abilities and workmanship. The desire was to obtain actual satisfied customer references. She relayed to him at that time that the project details and material to be used have already been discussed and were agreed upon in his bid and that any change in expectation should be handled directly with me. [redacted] and I discussed this prior to the project beginning and after the project started. The expectation from the start was/is that the TimberTech hidden fastener's be used with the TimberTech planks. [redacted] however chose to use a standard composite screw which was never intended to be used with a PVC wrapped composite plank. Again this reflects his inexperience with the materials and incompetency is handling these very expensive composite planks. This is a concern I had so I was explicit from the start with Stephen. However he still chose to cut corners purchasing these off the shelf composite screws and not hiring the adequate labor resources to lay the planks correctly according to the specifications of the manufacturer using the hidden fasteners. This resulted in a voided warranty, bubbled PVC at each of the screw sites and penetration through the PVC which would allow moisture into the composite material which would result in composite mold and eventual failure.Every inch of this planking had to be removed and replaced and installed correctly. After realizing such a huge mistake I began looking closer at the projects plans delivered to the city for obtaining the permit and I was shocked to find additional significant issues. The spiral stairs he proposed would not meet building code, he wasn't aware that the header joist needed to be lag bolted to the house (the inspector had to point that out to him), he miss measured the height of the stairs by more than 2 feet and he also used a termite damaged piece of 6x6 as one of the primary support beams. I confronted [redacted] about each of these mistakes and he admitted that he had screwed up and was very apologetic and seemed to be willing to address his mistakes initially. This was until he was able to do the math and discover that even with my agreeing to chip in more money to complete the project he would be better off financially if he walked away with what was left of my money rather than complete the project. At this point he skipped an appointment with me and stopped returning email and phone calls. A week of silence passed and he sent me an email outlining how he claimed I changed the project. This is simply not true. The square footage, location, shape, size and materials of this project have remained the same from inception to it completion. He simply could not estimate the cost, install the planks correctly, measure accurately, evaluate materials delivered or professionally handle dealing with the building code.I expect that my money be refunded as this time as this is a clear failure to perform on the part of [redacted] DBA [redacted]'s Custom Woodworks. I certainly hope no one else falls victim to this businesses incompetence as I have. I'm still paying interest on the failed part of this project and had to pay thousands more to correct and complete this project.
