I, [redacted] owner of [redacted] Construction Llc, did enter into agreement with [redacted] to do a roof repair/replacement at her property for the sum of $1,500.00.On the day we started this project(12-22-2014, ***, [redacted] husband came to the jobsite to be able to give me a down payment for $I did in fact swipe his credit card for the $750.00as we agreedAfter swiping his credit card on “The Square” on my cell phone, I showed [redacted] the amount on the screen, showing $He signed the screen and he leftAbout days later, I looked at my business bank account balance and saw that I had been mistakenly credited $7,for the $down paymentI emailed them that there had been an error in the“Square’s” amount that they were chargedI asked them in an email whether they wanted a cashiers check for the remaining balance of $6, [redacted] replied that she would like the monies credited back to husbands credit card and even sent the link to process the refund on the “Square”I went to the link she sent, tried to issue a refund but couldn’t figure it out, got frustrated, gave up and went to bedThe following evening, on 1-02-after work I tried to issue a refund again and succeeded in doing soThe amount was $5,I emailed or texted her what amount had been refunded and that I had to collect some other money to be able to give her the refund in fullI gave the balance of the refund in the amount of $on or about 1-12-This is an unfortunate incident that I had no control over because of using the “Square”I tried to get ahold of someone at “Square” but got no responseHow could something like this happen? I certainly hope that this incident doesn’t tarnish my implicet reputation

@ 1:23pm, *** writes:"Julia, I was able to refund ***'s credit card in the amount of $5,and Square should add $to that amountTotal refund at this ***e should be $ $5,Leaving a balance of $I SINCERELY apologize for this errorI still don't know how this happenedSquare has not returned my email regarding this errorI need to collect funds due me from another job, which I believe should be FridayI will refund the balance at that ***eI am so sorry!!!!!! ***" Then, on Friday 01/02/@ 7:39pm, I received a voicemail message as well as an email from *** stating:"Good evening *** I requested the Square to refund ***'s credit card in the amount of $5,They informed me by email, they withdrew $5,from my acctplus their percentage feePlease let me know the amount they credited ***'s credit cardI'll tell you, they are driving me crazyThat is not the amount I requestedI will refund balance to ***'s credit card on MondayI would like to be able to do the venting work needed at your house, which I was given the lead from Friend Trusted websitePlease allow me to work off some of that money owedI could come look at it Saturday morningI hope you don't hold this mishap against me for future workThank you, Sincerely, ***"Basically, it seems that he has already spent the money he charged us in error and is now waiting to get paid from another job in order to make restitutionToday is 01/05/nearly weeks after the initial erroneous charge was made to our credit card and no refund has been issued - we are also incurring interest in his charge and our monthly credit card payment has gone from $to over $We have issued a complaint/dispute with our credit card company in the mean***e.Please let me know if you need anything further from me.Thank you,*** ***

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me. 
We accept the response from [redacted] Construction LLC but will respond that we maintain that the accounting/business practices were unprofessional. While the charge to our credit card may have been a digital error (and possibly not malicious) they/he still received our funds and spent them knowing of the discrepancy. Once the error was made note of, the monies should have been refunded IMMEDIATELY, not 25 days later (when it was finally paid off in full.) Nor do we believe that any contractor who unjustly holds money from a customer should try to barter further services as repayment for those funds owed. Also, refusal of [redacted]/the company to answer calls, emails and text messages only made matters exponentially worse. While we were lucky that our credit card company was able to assist in temporarily rectifying the overcharge, this transaction with [redacted] Construction LLC may have resulted differently (i.e. possibly having cost us the sale of our home and the purchase of our new property.) All of these concerns factor into our decision to never use or recommend [redacted]/[redacted] Construction LLC for future home renovations or repairs.[redacted]

I emailed them that there had been an error in the“Square’s” amount that they were charged. I asked them in an email whether they wanted a cashiers check for the remaining balance of $6,317.48. [redacted] replied that she would like the monies credited back to husbands credit card and even sent the link to process the refund on the “Square”. I went to the link she sent, tried to issue a refund but couldn’t figure it out, got frustrated, gave up and went to bed. The following evening, on 1-02-2015 after work I tried to issue a refund again and succeeded in doing so. The amount was $5,154.25. I emailed or texted her what amount had been refunded and that I had to collect some other money to be able to give her the refund in full. I gave the balance of the refund in the amount of $989.50 on or about 1-12-2015. This is an unfortunate incident that I had no control over because of using the “Square”. I tried to get ahold of someone at “Square” but got no response. How could something like this happen? I certainly hope that this incident doesn’t tarnish my implicet reputation.

Review: After several weeks of communicating through email and phone (and once meeting in person for an in-home es[redacted]ate,) I, [redacted], met with [redacted] (owner/operator of [redacted] Construction) at my home, the afternoon of Saturday, December 20, 2014. During that [redacted]e, I signed a copy of the es[redacted]ate/contract for repair/replacement of our flat-roof extension on our garage - in the amount of $1,500.00. We were asked to put half-down for materials and labor. We opted to use our credit card for payment (after accepting a 3% finance charge to do so.) Unfortunately, [redacted] found himself unable to properly process the $750.00 charge, using his Square app on his Android phone. We mutually agreed that my husband, [redacted], would meet him at a later date, when he could figure out the charging process. Around noon on Monday, December 22, 2014, my husband [redacted] met Mr. [redacted] at our home. The process of repairs was half-way done at this point. Again, Mr. [redacted] attempted to process the credit card charge. We were told that the charge was successful and work was completed that day. Several days later, I contacted [redacted] in order to schedule a [redacted]e to meet him to process the remainder of the repair costs. When he responded, we scheduled a [redacted]e with mention, by him, that there had been an error in processing the initial payment, with my husband, the day prior. We suspected that the charge hadn't gone through and that that would be rectified upon our next meeting. Several communications and canceled appointments by [redacted] (for a family occasion and, later, due to illness) we discovered that, instead of $750.00 being charged to our credit card, the amount of $7,950.03 was posted to our account. Upon finding this out, I contacted [redacted] by email (as it was late at night.) The following day I received a reply acknowledging the error and his intention to correct it (once he had enough funds in his account.) I made him aware that we are in the process of purchasing a home and desperately needed the refund to be credited to our account - as our bank was monitoring our credit for our home loan. [redacted] said he would handle the refund the following day. I even went out of my way to search online instructions on using the Square app refund process and emailed it to [redacted], also with the option that he could drop off a cashiers check for the amount - and we could refund our account on our own. Again he confirmed that he would handle the refund. Since, we have lost communication with [redacted] - he refuses to answer the phone or return voicemail messages, emails or text messages. We are on a severe [redacted]e-crunch and need this refund issued as soon as possible. The initial repair es[redacted]ate was for $1,500.00. There was an additional, agreed-upon charge of $85.00 for unforeseen labor and materials cost, as well as the 3% finance charge for using our credit card (totally $47.55.) The total owed to [redacted] Construction is $1,632.55. Our credit card was billed $7.950.03. We are owed a REFUND of $6,317.48. We have a copy of the es[redacted]ate and copious amounts of saved electronic communications between ourselves and [redacted] that can be furnished upon request. [redacted]e is of the essence with regard to this refund, any assistance you could provide would be more than helpful.Desired Settlement: A refund of $6,317.48 made to our US Bank credit card account ASAP.

[redacted]" Then, on Friday 01/02/2015 @ 7:39pm, I received a voicemail message as well as an email from [redacted] stating:"Good evening [redacted] I requested the Square to refund [redacted]'s credit card in the amount of $5,300.00. They informed me by email, they withdrew $5,154.25 from my acct. plus their percentage fee. Please let me know the amount they credited [redacted]'s credit card. I'll tell you, they are driving me crazy. That is not the amount I requested. I will refund balance to [redacted]'s credit card on Monday. I would like to be able to do the venting work needed at your house, which I was given the lead from Friend Trusted website. Please allow me to work off some of that money owed. I could come look at it Saturday morning. I hope you don't hold this mishap against me for future work.
