I never discussed the price nor scope with [redacted] so this complaint shouldn't be from [redacted] to warren welding, rather it should be from [redacted] to JLB construction (***) whose contractor license was suspended, [redacted] had asked warren welding to change the origional scope that was discussed between warren welding and [redacted] days prior in any case as a summary to this project-A bid was never given rather it was an estimate, the estimate was for a single days worth of work not for the project, the estimated days worth of work to complete was for a simpler design, the design and scope was asked to be changed by [redacted] and [redacted] during the fabrication process, the work was being performed on a time and material basis not a fixed price, [redacted] signed off on the time and material sheets for billing confimring the hrs worked and costs, there was no communication between [redacted] and warren welding negotiating the scope and price, rather it was between jlb and [redacted] JLB construction ( [redacted] ***) called us to come out and take a look at some custom brackets that needed fabricationi came out and spoke with [redacted] the owner of jlb and gave him some ideas to complete the taskat the time the design was not concrete but we discussed an idea to take a few plates I would make in shop and bolt them to the existing beams and weld in placei made it very clear that there was no way of knowing how long the full scope would take to complete and it could easily take a few days but with the idea I had in mind it would take about a day to completei then later sent an email with the estimated price for a days worth of workthis was by no means a bidthe email said "about $900" was for the design we had in mind and for a single days worth of workso the value of was an estimate towards days worth of workit was well understood between warren welding and jlb that this was an estimate not a bid and the work would be performed on a time and material basiswhen we arrived to perform the work [redacted] and [redacted] the owner of the home gave directions and asked us to perform the work differently than originally discussed, adding complexity and finish that in turn incurred extra time and they were both told soso our ESTIMATE of a day work for the work for one day was no longer anywhere near accurate as the design and scope was completely changed by [redacted] and [redacted] while the work was being performed, not at the time of estimatingeach day we worked [redacted] signed off on the hrs worked and materials purchasedonce the project was completed and invoice sent I then became aware for the first time that I was being paid by [redacted] rather then jlbat that time I spoke with [redacted] to discuss the bill and attempt to negotiate a price and come to a resolutionhe told me he would speak with [redacted] and I never got a call back, rather a few days later I received a partial payment and no agreement was made between [redacted] and warren weldingWe are now in the process of filing a lien on the home and taking jlb to court if the open balance that was signed off on is not paid in full plus the costs of lien and legal fees

welding and [redacted] days prior.
in any case as a summary to this project-1. A bid was never given rather it was an estimate, 2. the estimate was for a single days worth of work not for the project, 3. the estimated days worth of work to complete was for a simpler design, 4. the design and scope was asked to be changed by [redacted] and [redacted] during the fabrication process, 5. the work was being performed on a time and material basis not a fixed price, 6. [redacted] signed off on the time and material sheets for billing confimring the hrs worked and costs, 7. there was no communication between [redacted] and warren welding negotiating the scope and price, rather it was between jlb and [redacted]
JLB construction ([redacted]) called us to come out and take a look at some custom brackets that needed fabrication. I came out and spoke with [redacted] the owner of jlb and gave him some ideas to complete the task. at the time the design was not concrete but we discussed an idea to take a few plates I would make in shop and bolt them to the existing beams and weld in place. I made it very clear that there was no way of knowing how long the full scope would take to complete and it could easily take a few days but with the idea I had in mind it would take about a day to complete. I then later sent an email with the estimated price for a days worth of work. this was by no means a bid. the email said "about $900" was for the design we had in mind and for a single days worth of work. so the value of 900 was an estimate towards 1 days worth of work. it was well understood between warren welding and jlb that this was an estimate not a bid and the work would be performed on a time and material basis. when we arrived to perform the work [redacted] and [redacted] the owner of the home gave  directions and asked us to perform the work differently than originally discussed, adding complexity and finish that in turn incurred extra time and they were both told so. so our ESTIMATE of a day work for the work for one day was no longer anywhere near accurate as the design and scope was completely changed by [redacted] and [redacted] while the work was being performed, not at the time of estimating. each day we worked [redacted] signed off on the hrs worked and materials purchased. once the project was completed and invoice sent I then became aware for the first time that I was being paid by [redacted] rather then jlb. at that time I spoke with [redacted] to discuss the bill and attempt to negotiate a price and come to a resolution. he told me he would speak with [redacted] and I never got a call back, rather a few days later I received a partial payment and no agreement was made between [redacted] and warren welding. We are now in the process of filing a lien on the home and taking jlb to court if the open balance that was signed off on is not paid in full plus the costs of lien and legal fees.

Complaint: [redacted]I am rejecting this response because: The change from the estimate should have been communicated and no where on the attached estimate does it say it's for only a day's worth of work.  There was never any discussion that the very minor design change would result in extra cost.
Sincerely,[redacted]
