To Whom It May Concern:
Correction -this whole situation is regarding a FREE review of an IRS letterThere is no paid serviceinvolved so his statement of "Purchase Price" is incorrect*** *initially retained us for year only,after which he intended to return to
self-preparing his own returnsHe then retained us again tocorrect his previously filed self-prepared returnHis business with us concluded on March 14th, 2016when he sent in a late final payment for work completed in December Payment was for anamendment of his Form (individual tax return), which he forwarded to us to solve after hehad received and for months ignored repeated letters from the IRS reporting substantial underreportingof income
Prior to that, we did his tax return and ended up not charging him for it although we completed itcorrectly, simply because he asked us beforehand about an IRA withdrawal effectHe said he wasasking about there being any tax on IRA distributions, and when the question was relayed to me Ithought he was asking if there was any penalty, so I answered a different question than he says heaskedTo clarify, his return was prepared correctly, he suffered no economic or time loss, and hestill had his fee completely waived in an effort to give him excellent customer service even though therewas no expectation of further business from him
Throughout completion of those returns, he had wide mood swings and angry outburstsHe wouldalso forget parts of conversations, and "remember" things that had never been discussed
In April, another staff member, Cindy, called him questioning whether we needed to file an extensionfor him, as she did all clients who have not submitted information to us by AprilShe was responded towith rudeness and yelling about- we're still not sure what the outburst wasHe was ranting about uscosting him $9,She gently concluded the conversation, asked us about our past dealings with him,and proceeded to educate usCindy has a unique background- she works with a halfway house, is ahospice worker, and is active in her church working with difficult personalitiesShe explained that someof the men she worked with had cognitive disorders that prevent them from fully understanding what'sgoing onThey form a scenario where they're the victim, then literally filter out all information thatdoesn't support that scenario, without even realizing itShe said they are very frustrated, as the filteringresults in a lot of things simply not making any sense, and this translates to angry outburstsShe saidthey lead difficult, anxiety-ridden lives, so patience and calmly re-explaining in different ways untilunderstood were the proper response
informed her that he was no longer our client, as he planned to continue self-preparing his returns, sothe matter was resolvedShe could go ahead and delete him from the list that carried over from theprevious year and that would be the end of it
We were quite surprised when he called in MayHe asked if we could look over a letter from the IRSregarding stating he owed about $900, when our amendment showed he owed $in additionaltaxes (not to include penalties and interest)This is starting to happen more often -IRS may notremove All the penalties for leaving large amounts of information out of the original return, as theyused toExcerpt from our engagement letter: "Our standard tax preparation fee does not includeresponding to inquiries or examination by taxing authorities You understand that you will be charged anadditional fee if we are asked to assist or represent you in a tax examination OR INQUIRY." However,Brittany was polite, professional, and stated that she couldn't tell what it was about from him reading itto her, so to please mail a copy to us and she would get back to himHe agreedFrom the attachedrecords [OMITTED BY Revdex.com's INSTRUCTIONS, BUT AVAILABLE] we know that he mailed the IRS letterabout two weeks prior to June 3rd, which was May 20thYou can also see that due to the amendment wedid for him, we saved him $15,There are also attachments showing that he called ***spersonal cell phone on May 26th, one week later, and *** responded by text, through which she and*** had previously communicated frequently, that she was at her "daily hospital appt" and wouldreturn his callShe is currently being treated for blood clots and at that time had multiple medicalappointments dailyTherefore, her hours were drastically reduced during April and May, and the firsthalf of JuneWe discovered from her cell bill (attached) he called again May 27th and June pt, but he leftno voicemails
Then the following timeline occurred, supported by the attached printout of my cell phone bill:
• June 3rd, he called and left a message with the receptionist to have someone call him• June 3rd 3:pm - I returned his call and left a message on his voicemail, giving him my cellphone number and asking him to call me directlyNo return call from him was ever received.• Monday, June &th 10:am - I received this e-mail from the receptionist: "He is being veryaggressive and threatening when he callsHe would like a call back from someoneHis numberis "• Monday, June 6th 11:am - I called ***'s cell phone again and left another voicemail for him,stating I would not tolerate any client treating our staff like that, he was not our client [aspreviously agreed] and was to call my personal number ONLY if he wanted to discuss itMy staffthen mailed out the copy of his IRS letter to him, explaining that nothing could be determinedfrom the letter as it was simply a reduction of taxes, penalties, and interest, and reiterating thatsince he hacfthreatened our staff we could no longer work with himThis was for free; therewas no charge involved at allAgain, *** was originally trying to extend a courtesy to him• Monday June &th 11:am -I called again and left my direct cell phone# again, just to makesure he had it.• Tuesday, June 7th- *** filed this complaint
POSSIBLE RESOLUTIONS:
A*** can call IRS and get his answer directly, free of charge.BI personally can call IRS and get his answer, BUT will first require:aA signed engagement letter, clearly stating the scope of this assignment, and that he isto deal with our firm only through me, or Cindy(Due to his past aggressive behavior,he is no longer allowed contact with the rest of my staff.)bA signed termination letter, stating that he understands that no further services will beprovided after we obtain the IRS explanation of their charge and their statement, verbalor written, that they won't waive it.cPrepayment for hours of work and promise to pay as we go if it takes longer(Heinformed us after we completed his last returns that he didn't actually have money topay us, and IRS has removed tax preparer bypass of their whole Hold system, so it'soften over an hour and/or repeated calls just to get through to themIRS is nowseverely understaffed, and even simple matters can take an extremely long time to haveanswered fully.)
