Review: My name is [redacted] and I run the [redacted] store website [redacted] where I sell jewelry I hand craft.

During the 2013 [redacted] Gem and Mineral Show (early Feb, 2013) I purchased over 2 kg of aura quartz crystals from [redacted], owner of Washington Gem and Mineral Co (paid for via credit card). Well over a kg of that material was highly defective with the color peeling off of it in large sheets like paint. It was very different from the aura crystals I had purchased from this business in years prior in that the color would rub right off it with slight friction. These aura crystals were not suitable for jewelry making and not what I agreed to purchase. This defective material resulted in several merchandise returns where my customer's funds were immediately refunded by me electronically.

By my receipts and records Washington Gem and Mineral owes me a $424 refund for this returned defective merchandise which they have not replaced. This is not to mention the $270 refund they owe me for 540 grams of additional defective material I still have in my possession and am afraid to send them (my plan has been to bring this to them in person at the next gem show-if they show up- and attempt to obtain a refund or exchange of non defective merchandise at that time). In reality they are also liable for the expense of the returns and the damage to my business and otherwise excellent reputation for delivering quality jewelry (which would have to be a civil suit if I wanted to compensation- all I am asking for is a refund for the returned defective merchandise).

I made [redacted] aware of the problem with the defective merchandise in March of 2013 via phone. In April of 2013, 886 grams of the defective material was shipped back to him at the address you have on file for Washington Gem and Mineral (I have all tracking numbers with proof of delivery). Over the phone [redacted] repeatedly agreed to replace the defective material with material of normal quality.

Six weeks later he shipped me a few hundred grams of the exact same defective crystals (they were physically the exact same crystals I had returned to him- I could tell by their shape). They came back to me with a thick heavy semi-opaque and cloudy coating of secondary color over them. They did not resemble their original appearance when I agreed to purchase them and I made the business owner aware of this immediately by phone and returned them back to him.

I was promised prompt shipment of replacement aura crystal points in the same weight as my original return- 886grams. At that point I asked him to just refund me my money but he promised he had very nice aura points that he would ship immediately. THIS WAS JUNE 19th.

It is now September 5th. I am without the crystals I need to make jewelry and earn my living. I have had over 10 phone conversations with [redacted] where he repeatedly promised me that he had replacement material with him and would be shipping it out immediately. I have received nothing. My recent September 5th consensually recorded phone conversation with [redacted] resulted in him shipping me more defective material which I have once again shipped back to him. I told him I have been waiting for six months and I am done waiting and I want a refund of $424 today and a refund for the remaining 540 grams of defective material still in my possession. Via phone he promised to issue a refund upon return of this latest package but based on the track record here I have my doubts. He refused to name an amount for the refund.

There is a credit card payment transaction from last February in excess of $800. I have all those records (his hand written receipt showing his charges and the credit card transaction receipt) and have both emailed them and physically sent them to [redacted] so that he has all records needed to issue a refund.

I am a business person. I cannot imagine treating anyone with the level of dishonesty and negligence this business owner has exhibited. He has strung me along for several months when I am in need of materials to make jewelry so I can earn a living. Please help me- I have tracking numbers, emails, paper and electronic receipts, even a recorded phone call where [redacted] consented to continue talking while I recorded us. In that conversation he admits that I am owed this merchandise. Please help me. I have a very small (BUT HONEST) internet business and I need these funds back to purchase inventory.Desired Settlement: $424 plus $270 for a total of $694

Hello. I just want to update you that Washington Gem & Mineral Co owner [redacted] issues me a $424 refund yesterday, something I have been trying to get from them since early spring. So they responded to my complaint. Thank you.
