cost of the product or to deliver twice as much product. The company stated the consumer chose the extra product offer.The company stated the consumer then changed their mind after delivery and wanted the 50% off of the product which was not granted.  The company stated the consumer issued the first complaint 7 days after the product was delivered and spread.The company stated at the consumer's own admission, a landscaper spread the material.The company stated if the material was contaminated, a landscaper would have noticed it right away. The company stated the martial they offer is recycled wood, the product is not certified play mulch.The company stated they did receive the consumer's certified letter and they have since issued a refund to the consumer for the cost of the mulch, $301.70.The company states the refund was sent last Friday. The company stated they will not issue any other refund above the $301.70.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

I'll begin by directly responding to the company's reply:"The company stated the consumer ordered the product early in the season, the product was not even being produced yet." - E-much offered mulch for sale online, with no blackout date information; if the product was not even being produced yet, I would expect a company not to sell that product. The company stated as a courtesy for the inconvenience, they did offer the consumer either 50% off the cost of the product or to deliver twice as much product. The company stated the consumer chose the extra product offer. The company stated the consumer then changed their mind after delivery and wanted the 50% off of the product which was not granted."  -- This is incorrect. I contacted E-mulch several hours before delivery, stating that I could not accept 20 cubic yards of mulch on my property, after consulting with my landscaper. I was told this could be accommodated."The company stated the consumer issued the first complaint 7 days after the product was delivered and spread." -- This response is unclear; my first complaint was that the product was not delivered. The second complaint was that the product was contaminated with construction debris. This complaint was made more than 7 days after delivery, due to the weather. It was not until later inspection that I noticed the debris."The company stated at the consumer's own admission, a landscaper spread the material." -- This is correct. Nowhere does E-much state that having an agent spread the material absolve responsibility for product quality and safety."The company stated if the material was contaminated, a landscaper would have noticed it right away." -- I agree. Thus, I included a statement from my landscaper stating that he did, in fact, notice the material was contaminated, though not until the job was nearly complete. I have re-attached this statement."The company stated the martial they offer is recycled wood, the product is not certified play mulch." -- Nowhere on E-mulch's product promotion material do they state the product is recycled wood. In fact, on the CURRENT web page (that is, it has not been updated since my complaint), the company promotes its product as A fresh, double shredded play surface mulch that is impact resistant & wheelchair accessible. Perfect for playgrounds, trailways or natural ground cover [italics are my own]. Though I am aware it is not certified play mulch, I would not describe recycled material as fresh, nor would I call this mulch appropriate for playgrounds."The company states the refund was sent last Friday. The company stated they did receive the consumer's certified letter and they have since issued a refund to the consumer for the cost of the mulch, $301.70." -- To date I have not received a refund directly from the company, though I have opened a dispute with my credit card company and they have issued a provisional credit pending further investigation; if e-Mulch claims that they've issued a refund, this is falsehood."The company stated they will not issue any other refund above the $301.70." -- E-mulch has caused damage to my property and is fortunate that no one was injured from their product. I will pursue legal action to remedy damage if the company is unwilling to make the property whole.
