Where to begin.....? [redacted] has been a long time (however infrequent) customer at Waterloo Auto Service, aka Waterloo Quick LubeI've changed oil and performed minor repairs on or different vehicles for him over the yearsThe vehicle in question, a Buick LeSabre, has only been to my shop times in as many yearsWe changed the oil in it 10/10/@ 302,miles; again 12/18/@ 329,miles; and the last time 12/01/@ 339,miles.12/01/2016-While performing an oil change on this vehicle, the technician in the pit noticed something odd about the filter when he removed it, and he showed it to ***, my mechanic, who was walking by the front of the vehicle at the timeApparently the oil filter had a significant amount of sludge in itHe also said that the oil was slow to drain, but they waited the extra time for the oil to stop draining before continuingI was later told that they even poured a quart of new oil straight through the engine until it ran out the bottom just to make sure there was no blockage, and it seemed there was notI was not involved in this service, as I was busy with something else out in the parking lot at the time, and [redacted] was standing out there talking to meThey finished the service and told [redacted] he was readyAfter the car is filled with oil and started to check for leaks, it is necessary to pull the dipstick and check to make sure it has enough oil in itI don't know why my technician didn't alert me or [redacted] to the appearance of an over-filledengine, but he did notWe know he put in quarts of oil by the digital readout on the oil gun usedin the bulk oil distribution.I had never known that [redacted] was a veteran until this dayI asked him about it because we offer a 10% military discountHe sort of down­ played his status but had been bragging about getting VA settlements for veteransSo before my tech cashed him out, I added his military status to his customer information in our system so he would get the discountNOTE This is the last time I physically SPOKEto ***After [redacted] left, my techs said [redacted] had mentioned that he had been having to add coolant to the car but couldn't see any signsof a leak.12/2/2016- [redacted] brought the car back to our shopHe parked in the lot and the tech who worked the underhood part of the oil change the previous day met him at the shop doorI don't always interact personally with every customer unless they request to talk to me, which he did notI was obviously busy with some other task and presumed that my tech could handle whatever the issue was.Apparently my tech informed [redacted] at this time that there had been some sludge in the engine and maybe that's why the dipstick read over full, but assured him that we had put in the correct amount of oilAt this point I still hadn't even heard that there was a problem, but now is the time I should have been brought into the conversation, however I was notI don't even know how long [redacted] was there that day, but a short time later I noticed him driving out of the parking lot and up the street.12/13/2016-came in to work to find a handwritten note on my desk that [redacted] found stuck in the doorjamb in my office door when he arrived at workThe note reads "Urgent! ***, I've sent you two e mails about my "overfilled" oil change from two weeks agoI need to hear from you [redacted] ###-###-####"Now I've been informed that there was a problem.I am at the shop approximately hours per weekI normally don't conduct business via e-mail since we're a vehicle service oriented businessOur business phone number has been the same sinceI communicate with my customers in person or verbally on the phone, and most thinking peopleknow what our business hours areAnyway, I go check the business e-mail and find the two e-mailsin question.First e-mail message from ***--12/09/2016@ 10:PM Second e-mail message from ***--12/12/2016@ 3:PMBasically the same message both times At the bottom was a note that the car is in his driveway, with an address and vague directions on how to get there, in case I wanted "to check the oil or engine." There was a suggestion that I could get it to my shop to flush out the engine and get it running again.12/13/2016-call [redacted] via the telephone number he wrote on the note and in the e-mailsNo answerIt goes to voicemailI left [redacted] a message letting him know that I don't communicate via e-mail and that he needs to call me so we can get the problem resolvedNo responseI was going to set up a time to send a wrecker to meet ***, get the key to the car, and bring it to my shop so we can find out exactly what the problem is:12/14/2016- [redacted] called and left a message on the answering machine at the shop @ 4:AMThe messagewas 3:long.In this messagehe says the same thing he said in the e-mailsTowards the end of the message he says that "there's so much in there with water too"OKAt this point I'm wondering why there's water in there tooWe didn't put water in his crankcaseHe's been adding coolant not knowing where it was goingFor all intents and purposes, this is irrelevant at the momentAfter hearing his message, I again called ***'s phone Again, no answerI don't remember if I left a message this time or notStill, no response.12/16/2016-called ***'s phone again Again, no answerI left another message that we can't solve the problem if he won't talk to meNo response.12/22/2016-received a copy of a letter via USPS that contained a FedEx fax coversheet dated 12/21/At the top was written Fax Failed! The letter was written to the KFOR In Your Corner TeamI've enclosed a copy of that letterHandwritten on the front of the letter was a note saying"***: You need to deal with my son [redacted] on thisHe bought that car for his mother my wifeI'm going to hospital probablyHRY [redacted] ###-###-####"In this letter he states that I told him in a voice message that he was responsible for getting the car to my shop and he would have to pay for an overhaulThat was neither said nor impliedMoving on.12/22/2016-called ***'s phone numberNo answerIt goes to voicemailI left a messagefor [redacted] to call me or come by so we can talk to try to get this problem resolvedNo response.12/29/2016-received via USPS a copy of a Logan County districtcourt document showing [redacted] as Plaintiff, and Waterloo Quick Lube and Auto Service as DefendantThe document claims we owe him$1,for engine damageIt was not signed by a Deputy Clerk (Notary Public), Court Clerk, or anyone with any authority Handwritten on the paper is "Courtesy Notice Before Formal Filing." And "***, This will be filed formally any time after 1-11-unles you try to make it right."12/29/2016-called [redacted] again after receiving the court threatNo answerIt went to voicemailAgain, I left a message for him to call meNo responseI also called ***'s phoneNo answerIt went to voice mailI left a message for someone to call meNo response.1/6/2017-checked the business e-mail accountThere was an e-mail from ***The subject line reads: Oil Dip Stick Picture Showing Over Filled! Plaintiff's Exhibit# [redacted] Vs WaterlooAttached is a picture of an oil dipstick with a bunch of oil on itThe body of the e-mail says Filing Date of Law Suit 11-13-Two Views of the Same Stick After Waterloo Quick Lube Oil Change...1/6/2017-Again, I call ***'s phone and ***'s phoneNo answer on eitherThey both went to voicemailAgain, I left messages telling them BOTH that they can play games with court threats and e-mailed pictures all they want, but the problem cannot be resolved if they refuse to speak to meNo response.1/9/2017-received via USPS a x color photograph of the oil dipstick with a bunch of oil on itIt is the same picture from the 1/6/e-mailThe picture had postage on the back, with no envelope, and writingOn the back were the addresses and handwritten Court Exhibit A with an arrow pointing to the other sideOn the front is written, on the outer edge of the photograph, at what I presume to be the top "Plaintiffs Exhibit #A [redacted] vs Waterloo Quick Lube Estimate 4-Quarts overDown the left side is written "Nothing To Discuss" with an arrow pointing to the pictureOn the bottom is written "$Now or $Law Suit & you get the car" Filing Date Friday 1-13-2017SoHere's my takeon this situationI was morethan willing to do my part to determine the cause of the problem and try to resolve it [redacted] has a car with 339,miles on it According to our records, there were 26,298miles between the first and second oil changes we performed, and 10,miles between the second and the last oneI don't know the history of the in between times He stated that he's been adding coolantto the car but didn'tknow where it was going.He said, in the voicemail on my office recorder that "there's so much in there with water too"I have that voicemail recorded onto my cell phone.Don't misunderstandI'm not saying that there's no possibility we messed upMy technician has been thoroughly reprimanded for not bringing the issue to my attention at the time when [redacted] came backWhat I am saying is that I believe there is an underlying problem that caused the car to not startI'm thinking head gasket, intake gasket, or something else allowing water/coolant to enter the crankcase and the engine seized because the water/coolant washed the oil from the crankshaft and it spun a main bearingHowever, I can't possibly know exactly what the problem is if I'm not allowed to check the car.I believe that [redacted] and his son [redacted] thought they could scare me into just giving them $1, because we were the last ones to work on itIt looks suspiciously like attempted EXTORTION! It will still be there with the keys in it, unlocked, during day light hoursThey don't even need to knock on my doorJust haul it away..,They turn right out of their parking lot and take the first right on BryantThey go north on Bryant to Post Oak Lane and turn leftAnd then stay on Post Oak to the first right, Red Oak Lane, and then proceed to dead end at Red Bud left to Charter Oak CircleWe are there on the left at that intersection with the Buick sticking almost out to the streetmiles minutes.. Wish they could have done that sooner.. Please understand my darling wife *** for years and I are open heart surgery patients, multiple heart attacks and all the limiting side effects***'s phone messages were pretty harsh and confrontativeI try to avoid as much of that as possible. My son did not want to be bothered at work, so the communications gap occurredThat was my fault, I assume.We have their admission that they did not properly drain it and his reprimanded employee let me drive away with a greatly overfilled engine If that car were a late model Mercedes, this would be a whole different scenarioI was an "insignificant" customer. We have since tried to drain the engine hours, but it still would not hold more than quarts when we added fresh oilBut, a well established mechanic and my sons said there is no water in the crankcaseA quart of engine cleaner could have probably solved this problem before they stuffed Quarts on top of quarts or more still in there.. When they pick that Buick up, it is at their expense, including all diagnosis and repair costs! I will expect a repaired car or $1500. I am not responsible for storage or transporting that vehicleThese are not unreasonable demands! That Buick has a great interior and good exterior with minor damageIt was still running reasonably when they over filled it.As pertaining to my military record and Veterans Discounts etcI am an Honorably Discharged Disabled Veteran with One MedalI was active duty for about Months USMC Officer Candidates School Quantico, VAI was injured in trainingI was a Viet Nam VolunteerBefore Deployment, I was discharged for Medical Conditions, namely "Allergies." Again, no answer. I left another message that we can't solve the problem if he
won't talk to me. No response.12/22/2016-1 received a copy of a
