I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.THE POOL WAS INSTALLED IN THE FALL.EVEN ASKED THE GENTLEMEN INSTALLING IF THIS WAS THE PROPER PLACE TO PUT ITSINCE THEY DO THIS FOR A LIVING.THE DRAINAGE WAS INSTALLED DAYS AFTER COMPLETION OF POOL.NEVER WAS USED FOR 1ST SEASON.THE FIRST OPENING OF POOL THE COMPANY WAS CONTACTED OF THE SITUATIONWE WERE TOLD THIS WAS A BUSY TIME FOR HIM AND THAT WE WOULD HAVE TO WAIT UNTIL FALLFALL CAME WE WENT TO THE POOL PLACE IN PERSONWAS TOLD THIS WOULD NEED TO BE HANDLED IN THE OPENING OF THE YEARWHEN WE OPEN WE WERE TOLD SAME THING AGAINFALL WENT TO OFFICE MADE HIM SET A DATE FOR SPRINGTHE COMPANY WAS CONTACTED FRIDAY PRIOR TO THEIR ARRIVAL DATE TO COME FIX POOL.WE WERE TOLD TO HAVE THE POOL COMPLETELY DRAINED AND READY FOR REPAIRDID ADVISE HIM WEATHER SHOWED RAINHE STATED THEY WOULD BE OUT TO START WORKINGWHEN 2ND CAME WE RECEIVED A CALL STATING DUE TO RAIN THEY WHERE NOT COMING OUTTHAT HE WOULD KEEP AN EYE ON THIS AND TRY TO SCHEDULE IT IN WITH HIS OTHER CUSTOMERS THAT HE HAD TO PROVIDE SERVICE TOO.I TRIED CONTACTING A NUMBER OF TIMES WITH NO CALL BACK.THE POOL LINER HAS NOW SAT TO LONG IN THE WEATHER TO REUSEI CONTACTED A DIFFERENT COMPANY TO HAVE THEM LOOK AT MY POOLI WAS TOLD IT WAS INSTALLED IMPROPERLYTHE WHOLE ONE SIDE IS UNLEVEL DUE TO NOT PROPERLY LEVELING THE GROUNDI SHOULD NOT HAVE TO PAY FOR IN IMPROBER INSTALLATION FROM THE TIME IT WAS INSTALLED.I JUST WANT THE COMPANY TO HONOR THE PRODUCT.NOT TO TRY TO GET OUT OF WHAT IT RIGHT OF THEM TO DOIF NOT PROPERLY FIXEDI WILL CONTACT LEGAL ACTION ON THIS MATTER.IF THIS HAS TO GO THAT FAR TO BE DONE RIGHT.WILL BE ASKING FOR MORE THEN JUST THE PROPER INSTALLATION OF THE POOL I FULLY PAID FORVERY DISSATISFIED WITH THE WHOLE SITUATIONI ALSO HAVE PHONE RECORDS TO PROVIDE THE CALLING DATES..THANK YOU

Pool was purchased 6/27/13 no problems with pool that season. We do not do landscaping or drainage around pools. Buyers were told to install proper drainage. Location of pool against bank creates a lot of water run off. We were told of problem last fall I told them that it was caused by insufficient...

drainage. The only problem they had at that time was uneven bottom. As a customer courtesy we would drain and pull up liner and even sand on May 2nd of this year. As you know it rained almost every day in May making it impossible to do. I called and explained this to Mr. Adkins he agreed it couldn't be done till everything dried up. He said he would keep us informed about when ground dried. They emptied the pool not us and not on our advise. Never has there been any mention of pool off level. We have installed pools since 2004, never having set one un level. If there would have been a problem with bottom or pool it would have been evident from the day it was install not 2 years later. The pool owners failed to install proper drainage at time of install. We hold no liability for their failure. Gary Wiseman Water Works Pools & Spas
