How long do we have to wait before we take this company to the small claims court? We have been waiting over a year for them to go over our caseEvery time we call they just keep saying that they will get to it

I am currently dealing with Wawanesa Insurance to settle a claim opened last weekWith the heavy rainfall and flooded streets in areas of the city, my car underwent damages, leading the the engine needing to be replacedThey are stating that because my car has "so many km's on it" (Its a *** with 65,000) they will not put a new engine in my vehicleI have used Wawanesa for years, never needing them for anything kind of pay out or help and I get this kind of service I getIn no way are they trying to work with me to try and help me out more, trying to extend the amount of time for the warrantyNothingIts not the point of getting whatever kind of money I can get out of themI want to make sure I feel safe driving my vehicleThe USED engine they told *** they will cover to put in my vehicle will only have the amount of warranty as determined by the company *** buys the engine fromIf its a month warranty....thats all I getAnd then what? If something happens I need to pay the cost of repairing my car or being left with not being able to afford it and then Im left trading in or selling my car to have to turn around and make monthly payments on a new or used vehicleA new engine would cost $8000, they are covered the used engine which is $3,plus the cost of labour and other added taxes and costs which will be an overall amount of I believe 5,I even told them that instead of paying a $deductible that I would pay $if it meant them changing their mind and putting a new engine inAnd no budgeSo IM the one putting in a claim and desperately need my insurance company to help meIM the one willing to pay $MORE than I need to to bridge the gap in the cost and they cant even see where Im coming from because they keep using the reason "because you car is so old" speech One of the part of my job as a health and safety administration is stat reporting so when people feed me lies I back that up with factsThe average driver puts 20,kms on their vehicle per year which over a year spand would be 120,and my vehicle which is years old and was bought BRAND NEW has 65,and they are trying to let that be their reasoning for not putting a new engine inWhen I told *** (the girl I was dealing with with Wawanesa) that I was definitely not accepting the fact that a used engine would be put in my vehicle, I told her I wanted to deal with someone else, and have another adjuster go out to look at my vehicle, to which she replied "Well we can get someone else to contact you but we wont be sending someone else out to look at your car againMy supervisor is aware of the situation and they are sticking with that decision" So after my long winded speech THAT is nail that sealed the coffin for meI'm pretty sure that I have a right to ask for another Representative AND for another adjuster to look at my vehicleNo differently than if they didn't like the price *** was offering for a used engine, they'd shop around and look for another priceAs soon as I can be done with them I will definitely be taking my business else whereI have never filed a complaint with the Revdex.com before which goes to show how outraged, disappointed and helpless I feel right nowMy vehicle is how I get to work, how I commute to see my family and friends, even having them in with me from time to timeI will never feel fully secure and have faith in my vehicle knowing this company didn't do everything possible to make this already horrible experience for me better and one that I would feel grateful for and knowing all my money paid to them for the past years has been worth it

A contract for insurance can only be cancelled one of two ways: by the Insured on request (signature required) or by registered notice by the Insurer, either mailed or hand delivered.
The first we were made aware of the sale of the property and required cancellation was February 6, 2014 when we received a call from [redacted] Ltd. We requested the Broker obtain supporting documents from the customer regarding the sale of the home to reverse our registered letter termination and provide further credit. There was no previous signed request for cancellation received from the customer - by the Broker, or our office.
Documentation was received showing sale and adjustments & disbursement dated December 7, 2011.
We reinstated the policy and terminated the existing term August 2, 2013 to August 2, 2014, full term premium $1230.00, back to the inception of August 2, 2013.
We had collected six payments: July 2, 2013 $105.53, August 2, 2013 $105.59, September 2, 2013 $105.59, October 2, 2013 $105.59, November 2, 2013 $105.59, December 2, 2013 $105.58, January unsuccessful
We issued refunds of $613.90 and $19.57 totalling $633.47 for all payments taken to the address on file: [redacted] High Prairie, AB. [redacted]
We also terminated the previous term of coverage August 2, 2012 to August 2, 2013, full term premium $1281.00, back to the inception of August 2, 2012.
We had collected the following payments: July 2012 $109.91, Aug 2012 $109.96, Sept 2012 $109.96, Oct 2012 $109.96, Nov 2012 $109.96, Dec 2012 $109.95, Jan 2013 $109.95, Feb 2013 $109.95, Mar 2013 $109.95, Apr 2013 $109.95, May 2013 $109.95, June XXXX XXX.95.
All payments were refunded, cheque totalling $1319.40 and mailed to the address on file: [redacted] High Prairie, AB. [redacted]

The customers mail was returned by the post office to our Winnipeg Head office. The new address of [redacted] Okotoks, AB [redacted] was obtained and the cheques were redirected as received: $19.57 resent March 26, 2014, $613.90 resent March 27, 2014, $1319.40 sent April 11, 2014. Hopefully, all cheques have now been received by the customer.
Backdated transactions are not processed on insurance contracts as customer instructions & amendments are requested and issued as they occur. In this case we allowed credit as far back as our system would permit. Prior contract terms were not available on the system as renewed and past expiry dates.
I have now been able to retrieve the archived contract term from August 2, 2011 to August 2, 2012. The full term premium was $910.00. Unearned premium from December 8, XXXX XX:XX am to August 2, 2012 would be a 64.9% return, or $590.59. I am willing to issue a further refund in that amount ($590.59).
The original signed authorization for payments on the contract is effective until cancelled by the customer. It would appear the Insured failed to terminate the Insurance contract properly when they originally sold the property and moved. The Broker did not have updated contact information for the customer. Unfortunately, we had no opportunity to resolve this issue earlier.

After 7 months of attempting to reason with them, Wawanesa has paid me back $2000 of the $2400 they owe. I am done. As they initially stated I would only receive $600 back this new total satisfies me and I will not be chasing them for the remaining $400.
Every contact with them was ignored or flat out denied when I finally got thru to someone and to receive this new chk a couple days ago I was elated and know it is because of the Revdex.com's inquiry! Thank you so much for your help.
