I am rejecting this response because:
This business owners defense is faulse. The police did not refuse.As a matter of fact they called in a supervisor, who was unsuccessful in getting the keys back. Then, they called in ANOTHER supervisor. FOUR police total.The police requested he return my keys and he would not. I can provide the police report. They police actually  gave me a ride back to the police station to file a car theft report. This business owner is in fact using a mechanics law which doesn't apply. He referenced himself as a lawyer and readily had available this mechanics lien statue.He also failed to mention, that my friend approached his employee and explained the problem. The problem in which we paid for a "gold service wash" and my car came out dirty. When was asked for them to rectify it.. The employee said which package did you get, and he replied gold. Then , his employee sent it through the car wash( it goes on a conveyer belt and you need to exit your vehicle. It's not a self serving car wash) then the owner was called over and said we had to pay. He would honor a $5 discount which is the coupon value we had used. In addition, my friend [redacted] didn't call me. I called him to check in and he relayed the message. I also didn't threaten him. I advised him that if he charged me for the re-wash, I would never return as a customer. I also advised him that social media is a powerful thing and that I would be sharing my story.the police acknowledged my car was still dirty. This man is infact a "debarred" laywer. Public records show he is in fact admin ineligible. The word "debarred means "ineligible".over 750 people have shared this story and hundreds of comments have come forward of this mans poor practice,horrible customer service.rude behavior ,theft by deception,violation of civil rights, and now wrongfully withholding my property.

Review: I brought my car in for an oil change and car wash to Wayne Auto Spa. After receiving my oil change I noticed that the hood latch was sitting on the floor of my car. After asking one of the employees what had happened, he said he needed to get the person who worked on my car. The employee that came over said that the hood latch was already on the floor of the car when he got in there and he had to use a pair of pliers to pop the hood. This simply wasn't true and I explained that they are responsible for fixing it. The employee attempted to reattach it, but after requesting he pop the hood, he broke it right off again. This happened a few more times until he said it was fixed again and I drove my car around to the car wash to drop it off and find the manager and tell him about the situation (just as the hood latch fell to the floor again).

After dropping off my car I asked the woman at the front desk for the manager. After arriving, I explained the situation to him and he went to speak with the employees in the auto shop portion of the business. While he was speaking with them, my car got out of the car wash, I got in and immediately noticed the front windshield was then cracked. I pulled the car to the side to wait for the manager. As I waited I also realized someone had turned the air conditioner all the way up on the windshield setting.

When he came back over, I waited for him to fix the hood latch, and he did as far as I can tell. And then surprisingly he remarked that my windshield was cracked, and I noted that yes it was, and it wasn't like this when I brought in the car earlier that morning. He said that this happens all the time with windshields when you turn the air conditioner on, on a hot day. And I remarked that I didn't turn the air conditioner on, but he said they were not responsible.

Out of sheer frustration and disbelief I left. My mother went back an hour later to file a police report.Desired Settlement: The fact of the matter is that when I brought my car in for a car wash, the windshield was not cracked. And when they gave it back to me there was a crack almost twice the size of a dollar bill on there. I would simply like to be reimbursed for the cost of replacing the windshield.

The customer's windshield was chipped prior to bringing the car to our facility. Chips to windshields compromise the integrity of the glass, and cracks will run emanating from the chip for a variety of reasons: vibration from driving, temperature changes, etc. But for the chip in the windshield, the windshield would not have cracked from a normal car wash. The police officer who responded to the call observed the chip in the windshield and pointed it out to the customer and noted that the chip, which was not caused by Wayne Auto Spa, was the cause of the crack. We are experts in windshield repair and work for all of the auto insurance companies to repair windshields for their insured drivers and can state with confidence that the cracked windshield was the result of the pre-existing chip. Further, our warning/disclaimer sign, posted at the entrance of our facility clearly disavows any responsibility for chipped windshields.Finally, the customer admitted on the phone with me that this crack wasn't our fault and nevertheless told me that I should refund his money anyway, or he would trash me online and with the Revdex.com.As to the broken hood latch, the bottom line is that we repaired it. It was broken before it was brought in but rather than debate the details, we were able to fix it easily for the customer and we were happy to do it.This customer refuses to take responsibility for his failure to promptly repair the chip on his windshield and now he wants us to pay for the subsequent problem that we have no responsibility for. Not only is that unreasonable, his threats were nothing less than extortion.

Review: [redacted]I am rejecting this response because:At no point in the conversation did I ever state this was not their fault. And the conversation actually ended because we went in circles about who should be responsible. Yet another lie he told, was that I said would ‘trash’ him online, and that I ‘threatened’ him on the phone. I simply stated, that I would report him to the Revdex.com if he did not take responsibility for the damage they had done to my vehicle, and write a review online as I didn’t and still don’t feel nor from a legal standpoint do I think this is my responsibility. And how he handled the situation was simply in poor taste. Had the windshield cracked when I had possession of the car, of course, I would take responsibility and fix it. I was and am simply exercising my right as a consumer to report a business of wrong-doing to the proper authorities. It was him who said he would pursue legal action if I wrote a review online that did not explain the situation how he described it, trying to scare me out of my given right as a consumer. It is clear after reading the reviews on this company on Yahoo!, Yelp, and Google that the owner denies any wrong doing of his company or staff at any point a negative review is written or he does not respond at all. Companies like this one need to be stopped from taking advantage of consumers and denying any sort of responsibility for damage of property or lack of service. The owner also states that “Further, our warning/disclaimer sign, posted at the entrance of our facility clearly disavows any responsibility for chipped windshields.” I do not recall seeing this sign at the entrance of the facility, and I didn't physically sign anything, that's for sure. In reading into some legal examples of this, I found the idea of bailment, it basically says you transfer possession of your property to another person/company for a service, and if they do something outside of the standard service, they are at fault. The fact of the matter is my windshield was NOT cracked when I brought it in and was cracked after it came out of the car wash. Whether there was a chip in the window prior to me bringing it in or not, I am not sure, nor do I think any other party can definitively state that case. As the owner stated, a crack will run from a chip because of a change in temperature. So if there was a chip, I paid them to provide me with an oil change, and to clean my car (which at that location consists of vacuuming it, wiping down the inside, putting it on a track to be cleaned automatically, and dried by towels) not turning the air conditioner on full blast on the windshield setting and create a crack in the glass when the windshield is extremely hot from the sun.As for the broken hood latch, this is just yet another example of him denying ANY wrong doing by his staff, and blatantly lying. I’m hoping this bureau can do something about how this business is treating people, and in the process, solve the issue I have with them as well. In previous years, they have always provided a somewhat decent service, but it has truly gone downhill.Thank you.Regards,[redacted]

My original response remains a true, correct and complete explanation of this situation. Its unfortunate that this customer refuses to acknowledge that his previously chipped windshield compromised the glass and his failure to repair the chip made it susceptible to further damage. Chips in windshield result in cracks if they are not repaired. The customer refuses to take responsibility and is trying to get me to pay for his negligence. Again, even the police officer who came when the customer called explained this to the customer and confirmed that with my manager.
