Contract clearly states deposit is NON REFUNDABLE

Review: On 6/20/15 I purchased a new 2015 Ford Escape for $33,200.00 because Ford advertised 23 mpg city and over 30 highway, after the first 3 days of driving the vehicle I was only getting 12 mpg, I immediately called the salesman to complain and told him if this is how this car performs I do not want it and want a different model and he said ok but before we do that it might take a few gas tanks to calibrate.. I was told by him and the service dept to drive it for a while because it takes time to calibrate, I called him 3 more times because it only got worse. The service dept looked at it and said nothing was wrong but they cant explain why I am only getting half the advertised MPG. I went to the dealer today 8/22 to exchange the car for a different model based on the conversation I had with the salesman 3 days after I bought it and was told they would only give me $28,000 for it. Why should I have to lose $5000.00 for a car that does not perform as advertised and that I did in fact contact them 3 days after the purchase. All I want to do is trade the car for a different model but I expect to get what I paid for it and not have to take a loss. The fact that I have been in constant contact with them immediately after the purchase seems to not a make a difference to them. The car does not perform anywhere near as advertise and I have pictures of the gauges to prove it. I just want a new car for what I paid for this one especially since I told them 3 days after purchase that something is wrong.Desired Settlement: I want a different model car, and be able to use the $33,200 I paid for this car towards the new one. I should not have to lose $5000.00 especially since I informed them 3 days after purchase that something wasnt right with the car. I contacted them multiple times beginning immediately after the purchase.

Good Morning,I was away for your first email so I apologize for not responding earlier. We have investigated the complaint and have not been able to verify the validity of it. The average miles per gallon display on the vehicles dashboard is clearly displaying over 6 miles per gallon more than what he states he is averaging. We checked all the diagnostic systems and all systems where within Ford's guidelines. Wayne Ford stated that they would be more than happy to address any mechanical issue that is verifiable. We would also be willing if the customer would like to fill the tank and track it with our mechanic driving the vehicle. The customer stated that unless we moved him into a new Ford EDGE with a full refund on his ESCAPE he would write disparaging blogs, call the Revdex.com, and do everything he could to destroy our 50 year reputation. Wayne Ford is not denying that he may or may not have a concern but all work to date include all computer print readouts and average fuel economy readouts are stating over 18.4 miles per gallon. We would again be more than happy to assist the customer with any concerns he has with the Escape but there are channels such as normal warrantee guidelines and if not Lemon Law which need to be followed.

Review: I placed a 500.00 dollar deposit on a car I wanted to purchase on a credit card. When I got home a short while later, I had a large bill that took precedence. I immediately contacted the dealership to cancel the pirchase. I now see on my bank statement that they have charged my credit card. I contacted them again and are refusing to refund my deposit.Desired Settlement: I want my credit card to be refunded the 500.00 dollars. Thank you.

Regards,

Review: I went into the dealer in good faith to obtain a new vehicle. I was upfront and honest that my credit score was an issue. Salesperson negotiated terms on a lease, filled out an order for the specific vehicle with VIN #, lease terms attached. It was signed by myself and the salesperson. I left a 1000.00 deposit with the agreement to bring an additional 2500.00 two days later. I had a cashier's check for 2000.00 made out to them and 500.00 cash. When I called to ask what time to come in, the salesperson said they would call back with an answer. I had to call back and ask someone else to have the salesperson call me. When he did, he said I needed a co-signer. That was not part of the deal that was signed two nights prior, but after some thought, I decided to go ahead with the cosigner. I had a cosigner and submitted all the paperwork. The dealer then held it for over 24 hours stating the finance dept. had only 1 person in, and they were busy. The next day, the story was the finance person didn't come in until 2pm. Finally I get a call stating there may be a problem. When they called back later in the afternoon, the salesperson stated he couldn't get it approved. I asked what the problem was, and they said the cosigner had to live with me or we would have had to have joint credit on something together. I was also told, "Frankly, no one wants you on a loan." I was mortified as this comment is unnecessary and unprofessional. I asked for my 1000.00 back and they said to give them card #, exp date and security code on the card I had used. I went to get it and when I got back, no one was on the phone. I tried calling and when I do, the person on the other end keeps saying "hello, hello...." as if they can not hear me. I feel the dealer made a mistake somewhere along the line and had no intention honoring the deal THEY signed. No where on the agreement does it say it is contingent upon anything.Desired Settlement: This is not the outcome I had hoped for. I was raised where a signature and a written agreement signifies a deal. The handshake on the deal obviously is a formality, but it holds traditional meaning. Right now, all I want is an apology for the rudeness of the last statement and my money back.
