On September 17th I called Mrs*** I had received an email which is identical to the file you sent me I was leaving town the next morning so we set an appointment to meet together at 11:am today She arrived for the appointment with her daughter and she met [redacted] as well as [redacted] , one of the owners of the business [redacted] sat in on the meeting that I had with Mrs [redacted] and her daughter We discussed the situation with her She briefly told again from her perpective what took place I told her that the salesperson has said that he was not informed that Mr [redacted] was unemployed at the time he came in and purchased the vehicle He did tell the salesperson that he had just finished a job in another state and was going to be starting another job at a different location He took that to mean that it was is often in the oil field business that one project finished and he was relocating to another project We also told her that we had never given the salesperson a price to tell her we would buy her vehicle for We were contacted by two other dealers who were calling us for buy bids when they were asked to bid on the vehicle We ahve never given anyone a Buy Bid at this point I explained our process in taking credit applications and submitting them Our salespeople take the inforamtion for the application from the customer and give it to the sales manager The sales manager then enters the inforamtion into Dealer Trac and prints a hard copy That hard copy is then given to the finance manager to go over with the customer The length of time on the job could not have been left blank for we could not put anything in the field To protect our dealership and the customer, we have the finance manager go over the credit application and have it signed by the customer without the salesperson being present We explained to Mrs [redacted] we adopted that practice after we hired some sales people who had worked at another dealership where it must have been a custom to change infomation given by the customer The finance manager always asks if this the the right information, this is who they work for, the length of time on the job and the amount they make that will pay for the vehicle they are purchasing If they agree that the information is correct, we have them initial next to the amount of income they are declaring to acknowledge that to be correct They also sign the credit appliation We told her that if she were to get a copy of the credit application sent to the finance source, it would show his initial I also told Mrs [redacted] that I was not present when the transaction took place but I was sure that our process showed that we had not put inforamtion down that the customer had not given us and agreed to The issue at this point is for her to get the most she can for her vehicle We have cancelled the Service Contract and will send the refund to the lein holder It was flat cancelled so there was not any earned premium It will be a full refund of $ We discussed that we would get her several "Buy Bids" for the vehicle There is no used car value guide on the vehicle because it is a We also told her we would do research to see if there are any used ones we can find that would help establish a retail price We told her that if she wanted, we would take it on consignment and try and sell it once a retail price could be established and one she would agree on The advantage of a "Buy Bid" is she sells it now but the price would be a wholesale price If she consigns the vehicle, there is not a time frame as to when it will sell and if the price is too high, it would never sell We would try our best to get what a market price would be if it can be established so she could make a decision We will take the next few days to do the research and then we will get back together I told her she would need to keep insurance on the vehicle and the only charge we would make would be for a sales commission and we would keep the expenses for that at a minimal This is if she decides to consign the vehicle We would not charge a percentage of the selling price but would work with her so she got the most available for the vehcile if that is what she decided to do I will give a further update when a course of action is determined after our research [redacted] * [redacted] Sep
