In approximately April, 2015, [redacted] and his wife inquired about purchasing a home from JKB Living in Oakdale CaliforniaAn offer was written by [redacted] , their real estate agent to purchase a residenceThe offer was never accepted by JKBThe property was encumbered by an easement along the back property line for a French drain systemThe existence of the French Drain System was disclosed to the Penningtons in a site plan emailed to them in April, Again, there was no contract between JKB and the PenningtonsThere is no evidence that a pool could not have been installed in the backyard of the property that the Penningtons were interested in purchasingIn March, 2016, the Penningtons selected and submitted an offer for another lot that had no easement, however they could not produce to JKB Living a lender qualification letterAs a result, JKB did not contract with the Penningtons for the sale and purchase of a JKB homeThe home in question (Lot 66) is under contract with a relative of the Penningtons (effectively March 31, 2016)We do not have permission to disclose the relative’s nameThis is the first time JKB had a contractual obligation to furnish/build a home in which the Penningtons had an indirect interestThe plot plan that JKB furnished for Lot showed a back elevation with a flush back wallThis plot plan was furnished in errorThe City of Oakdale had approved a home for that lot with a back elevation that had a four foot elevation differentiationJKB modified the plan with the City of Oakdale, which delayed the commencement of construction by to weeksAs a result, the close of escrow that was anticipated was delayed from October, to February JKB upgraded the upstairs laundry room free of charge as a partial accommodation and has been negotiating possible additional considerationThe Penningtons have demanded a payment of $35,In JKB’s view, this is entirely unreasonable

11/29/17- Mr*** came out and told me that it would be $verbally to fix my leaking sinkHe showed up on the Wednesday afternoon with another man in another truckHe didn't bring a light with himI asked him to give me a referral for a furnace and air person and he gave me a number but said to call him first, which made me uncomfortableWhen he fixed the sink he said it's $and I didn't argue because there was another guy thereI never sent thank you lettersHe put up a light for me and charged $I paid $for a door that I found for $He said the door would take 4-weeks, but I saw online at the library that it would ship in 2-daysHe lies about everythingI sent him a Happy Easter card that said I'm sure you would do a good job not that he did a good jobHe's done this to other single ladiesThe woman at the door factory said that I'm entitled to a warrantyI know my money is goneI don't want it to happen to someone else thoughI want the $back, the warranty for the door, and the difference for the door in priceDon't leave a message on my phoneMediator called back and let the Consumer know that the case will be closing

The customer who submitted this complaint on 7-25-has twice sent me 'Thank You' notes for jobs well done with additional praise of work and price. As a courtesy for this third job, I did not charge a service fee for the initial visitMy quote was $for parts plus the service charge
for one to two hours.On the second visit for this third job, the final charge was $for parts and $for one hour minimum service charge totaling $175.00.the check is written to my name because the company is not incorporated.We are always friendly and honorable toward our customers.Our fees are lower than most other companies, and we do our best to satisfy our customers

11/29/17- I replaced her lightShe told me about a story where she worked for *** *** and then had to leave the state because someone was trying to kill her and she just returnedShe talked about how her neighbors were taking advantage of her as an older woman with their cigarette butts and dog poopI think the cops even got calledShe said ***, her landlord, took advantage of her too because her mobile home should've had a dishwasher in itShe called me back to do her plumbingWhen I did the initial visit I said it would be $in parts and probably two hours of workWhen we looked at it the second time we saw that there wasn't anything wrong with it except a loose seal, so we put some glue on it to stop the leakingI didn't charge her much because that was simple, but we have a $minimum that includes $in travel and $90/hr rateShe sent a letter that I took advantage of her and at first I was going to give her her money back to be done with it but she seems like she's always crying wolf so I want to defend the next person she does this toI don't want to give her any money, not even halfI'm not seeking a resolution because I didn't do anything wrong

First with lot I have attached my paperwork ,the contract, which I was told is what I was signingI don't see where the easement is disclosed or the French drain also see attached plot planI found out about easement on my own through the city where I live.Lot 66- see attachment My father in law and I have both signed all paperwork from beginning with no problem from JKBFather in law produced loan paperwork when asked but then gave different paperwork couple of weeks later per JKB request If giving us site plan an error why was it given to me wrong twice and and site plans show date 5/2015.Laundry room was because JKB changed design of room and had to replace cabinets after deleting cabinets from change that was done after we started our process.I was led to believe by *** with JKB this whole time that I was going to be compensated by Jkb for them delaying constructionI was asked by *** to bring in my calculations of loss after discussing numbers $was discussed not demanded Our losses include lost equity, invalid price increase and rent payments while out of contract

It's intimidating when two grown men are in your home, you're not going to argue with them, I know for a fact he does this to female seniors, two guys and two trucks, it has got to be stopped. I believe the IRS would be interested in him, the checks are made out to him personally.

In JKB’s view, this is entirely unreasonable.

I am rejecting this response because:

Lot 31:  Mr. [redacted] provided Revdex.com an offer he submitted to JKB.  The offer is signed only by him.  The offer was never accepted by JKB.  There is no signature by JKB indicating acceptance of his offer.  There was never a binding contract relating to Lot 31.  There was no obligation to disclose anything to any person making an offer unless there is an acceptance.Lot 66:  The contract was between Mr. [redacted]'s father in law and JKB.  Mr. [redacted]s name does not appear in the contract.  The contract expired and rather than executing an addendum to renew the contract, Mr. [redacted]'s father in law) submitted a new contract with a $35,000.00 price reduction.  See Attachment.JKB has no obligations whatsoever to Mr. [redacted] or Mr. [redacted] at this time.  Mr. [redacted] was never a party to a binding contract that required him to sell his  home.There was consideration offered to Mr. [redacted] for the delay in construction of the home on Lot 66.  The delay was caused by an error in a plot plan prepared by JKB's engineer.  The error required a submission of plans to City of Oakdale.  JKB anticipated closing by October, 2016, but the home was  not ready until March, 2017.In consideration of the delay, JKB offered to pay all of Mr.[redacted]'s closing costs (the precise amount was unknown because Mr. [redacted] never submitted his lender information to Escrow) Typically, closing costs can run from $3,000.00 to $10,000.00)  In response to this offer, Mr [redacted] submitted a new purchase contract seeking a $35,000.00 purchase price reduction. See attachment.To the extent Mr. [redacted]'s name appeared on any documents subsequent to the execution of a contract between Mr. [redacted] and JKB, it was done as a courtesy and treating Mr. [redacted] as an agent of Mr. [redacted]
