My company represented Ms. [redacted] under a buyer's agency agreement.  She was a lead that came in through our online lead generation system.  My agent [redacted] wrote a couple offers for her, but we were unable to get her to closing because her financing did not go through....

 As far as her dealings with Vinson Mortgage we did make the introduction but from there we do not get involved with financing do to privacy laws we do not have the details on her loan.  Our job as agents to work the transaction and work with the lender and buyer to do everything we can to get the deal to closing.  We do know Mr. [redacted] was working on ways to keep the deal together, but at the end of the day he could not get her the financing she needed as things had changed from the time we went under contract to the time of loan commitment.  It is our understanding that she contacted another lender that could not do it as well.  AS far as the transaction on [redacted].  Mr. [redacted] did everything an agent was supposed to do in representing her.  On June 4 she sent an email terminating Mr. [redacted] but he continued to work the file under our agency agreement to make sure the client was covered until we had a formal release.  We found out before the loan commitment date that she was not going to get the financing, Mr. [redacted] wrote up a Mutual stating the earnest money should go to Ms. [redacted] and sent it to her to sign, she signed it and sent it back and we sent it over to the listing agent.  During this time frame Ms. [redacted] started working with another agent and that agent started contacting the listing agent.  The listing agent and seller thought something didn't make sense so they are requesting the earnest money to be given to them, so they sent over the a Mutual Release to us stating the earnest money should go to them.  It is our responsibility to forward that on to our client and that is what we did.  In that email that was sent on July 6 along with that mutual release Mr. [redacted] requested that Ms. [redacted] contract me in regards to her earnest money.  I never heard from Ms. [redacted].  In my opinion she should get her earnest money back as we were within contract when the mutual release was sent over.  Unfortunately I cannot make the other side sign the mutual release.  I was hoping Ms. [redacted] would contact me so I could give her some options but she never did.   If you need any additional information please do not hesitate to contact me.  Best Regards,[redacted]Broker/OwnerWeichert, Realtors-Ellsworth & Associates[redacted]
