Complaint: [redacted] I am rejecting this response because: To clarify, our dispute that we have brought to the Revdex.com is only about the misrepresentation of the property by the realtorThe claims by the Respondent in regards to the washer/dryer and Fire Marshal are: (1) factually inaccurate, as Complainants did not tamper with the fire alarms, COdetectors, or window air conditioners, and (2) irrelevant to this complaint, which is based solely on the representation of the status of the cooling system in the home by the broker.Attached are multiple listings by Weichert Realtors, including the listing relied on by the Complainants, where the house is held out to have a central cooling system When Complainants inquired with Respondent at the showing of the house, the specific answer given was that the previous tenant preferred to use the window units in certain rooms, and the window units were there to “supplement” the central air system Complainants were not informed that the central air system did not function whatsoever.Complainants reviewed the lease prior to signing and in review, Complainants noted that the lease referenced “window AC units” and asked Respondent via e-mail for clarification that the house did indeed have central air The response was that “there are window AC’s to take the load off the system in summer,” which, while unclear, suggests that the central air was functional and the window units were to assist, but not replace This reasoning was also in-line with the explanation provided at the second showing of “supplementing” the central air system Complainants were, again, not informed that the central air system did not function whatsoever.The lease itself is silent as to central air conditioning for cooling, which is specifically why the Complainants asked for clarification, as they were only interested in renting a house that had central air conditioning Sincerely, [redacted] and [redacted]

Review: My girlfriend and I rented a home that was listed by Denise B[redacted] at Weichert in [redacted]. The home was advertised as having central air conditioning. When we moved in, we discovered that the central air did not function, although the ductwork exists, as the compressor is broken and needs to be replaced. As an agent of the landlord, Weichert improperly held out the home to have functional air conditioning when it did not. We rented the house based on this reliance, which was false.

We attempted to contact Weichert [redacted]'s principal broker, Maria R[redacted], to remedy the issue, who had one conversation with us and then ceased returning our calls or e-mails.Desired Settlement: We are paying rent based on a home that was warranted to have central air. Accordingly, I see three possible resolutions:

(1) That the house is repaired and brought up to the condition that it was represented to be in - namely, that the central air conditioning be fully fixed and fully functional, as well as all other listed utilities and appliances be repaired and kept fully functional. Our rent should be adjusted for the period we have been living in the house without the warranted air conditioning.

(2) To nullify the lease and consider it void, as the house is not in the condition it was represented to be in when we signed the lease. Our security deposit should be returned in full. Our moving expenses for both our move in and our move out, including but not limited to, the installation/transfer of utilities ([redacted], etc.), materials, and the movers' fee, should be reimbursed and covered in full. We would find a mutually agreeable date for us to exit the premises and in the interim we would continue to pay rent.

(3) We should find a mutually agreeable rent price that the house should have been listed at, and adjust our rent to that price, including back-dating what we have been paying since moving in.
