Weichert Agent's Admitted Negligence Leads to Clients' Loss of Life Savings
A NJ Weichert agent had told her clients that she was "having problems with her business email account" and gave them her personal account, yet she continued to use both accounts to send and receive contract and other information from all involved in the transaction. She also neglected (and admits to this) to include her agency's required Wire-Transfer Warning Form along with the purchase contract for her clients to sign and return. She did not notice, either, that her clients had not returned that signed form. This agent did not provide guidance, education, advise or continuing monitoring egarding the procedures and dangers of wire transferring closing money. All she told her clients was that they would need to pay cash for the property PRIOR to the closing date of Sept 1, 2017 -- that the seller had to have the money in its account before her clients went to the closing procedures with their lawyer and the seller's lawyer. A few days before closing the clients received an email with wire-transfer directions from whom they though was their attorney. The email had all the information except it had a scammer's bank account. The clients did not know they sent money to a scammer until 2 days later when they say with their attorney and the seller's attorney. The Weichert agent's "problem email" may have been the focal point for a 3rd part scammer to enter into the email chain and then enter into the clients' email to provide the false information. The agent did nothing to advise, educate, warn her clients about these types of scams -- this happened back in 2017 and 6 years later- Weichert says it had no legal obligation to warn their clients even though they required a warning form to be a part of the contract. Weichert and the agent are being sued for negligence.

This is the exact same story I got last timeI do not have the email anymoreI forwareded it to ***As any more I get from this company I will do the sameMaybe I the government gets involved companies like this will be prosecutedIt is not my responsibility to waste my time trying to stop what they should not be doingThere is no doubt in my mind this comes from AIG, not some invisible emailThe respond to email was AIG, click on the link went to AIG, It said on the bottom of the email it came from AIGThis is just another excuse to put the blame on sombody else & not take responsibility for their own actions

Hi, Regarding this complaint let me start by just saying it was unfortunate that the buyer wasn't familiar with the process in NJ and wasn't understanding what my agent was askingIn NJ it's customary for a buyer to put down an initial deposit of $1,when they make an offerMy agent was simply
asking for him to either bring us a check to present the offer, or have his attorney put in writing that they would wait until the short sale was approved before giving the Earnest Money Deposit which is what he kept telling my agent that his attorney was advising him to doSince we had a signed contract indicating a $1,EMD we needed either a check or an addendum changing the termsIn the interim of going back and forth a higher offer came in and my agent did the ethical thing and presented the new, higher to the sellers even though it wasn't her offerWhen she called the buyer to let him know about the higher offer she said the buyer hung up on her before she had the chance to ask him if he wanted to make a higher offerI hope this explains what happened and please feel free to call or email me if there's anything else you think I need to do or explain
