After several intents to solve the issues with the personnel and/or staff of Andalucia Villas Apartments we wrote this letter to explain the reasons why we made the decision to execute our tenant’s right to terminate this lease with Andalucia Villas Apartments without any liability from us but with our right to receive back the security deposit that we fulfilled at the execution of the lease Noises and disturbs due to construction above my dwelling We have been deprived of our quiet enjoyment of the premises due to the excessive noise result of the landlord’s construction or remodeling above of our dwelling We did not receive any notice of remodeling and/or construction by the leasing office of Andalucía Villas Apartments The noises are extremely annoying and prevent us to sleep appropriately causing us substantial disruption in our daily routine in a high degree of mental distress(See audio attached) I work night shifts and for me is very important to come home

I am writing to you in regards to an Andalucia Villas resident complaint you received on December 13th 2014, with an assigned ID of ***I apologize for the delay in responseI was out of state for approximately one week; in addition, our *** offices were closed several days last week due
to inclement weatherHowever, it is to my understanding that I am given a chance to refute this resident complaint *** ***’s complaint: “Since I have moved in this establishment it has been a nightmareFor starters our first days here we received an eviction notice for nonpayment of a garage and carportAt the time both were still occupied by a prior tenantI, myself, eventually had the vehicle and items from the garage removedAt that point I went to the office and told them I would pay for the month, but at a prorated rateSo she took dollars off dollarsI thought it was wrong but had just moved to town and there are not many housing optionsThere is insufficient parking here also, and we were told after hours you could park in any spots long as it was gone by the start of the following business dayMy fiancé received a ticket but we were able to get it thrown out through the legal systemIt is extremely loud, and people fly through the parking lots hours a dayThe black marks everywhere are a clear sign of thatThe property manager by the name of *** is very rude and of no help to anyone hereShe walks around smoking and fraternizing with the other male tenants dailyAs for parking I was in a designated spot with a sticker for the complex and was towedThey have a tow truck riding around towing at their leisureI still have a huge crack in my window that has been there since I moved inI even had an employee park in my spot and after complaining to the office and calling the tow company the person ran out and moved it after being warned by the officeMy mail key didn’t work for weeks and I was told it would get doneI had a 10,dollar check that I really needed in the boxI finally got a reissued check after about weeksThere are many other issues that could be listed but I believe I have made my pointIf you would like you could look at the reviews.” Parking is very limited, many non-residents were taking up residents’ parking, and there were little to no garages/carports available for rentIn an effort to make parking more efficient and less troublesome, my team I came together to implement a new parking systemWe created an official letter as to exactly what this system entailed and the repercussions that followed for breaking itThis letter (please see attached) was sent out to every single resident on October 22nd 2014, and specifically stated that the new policy went into effect on November 1st Mr*** moved into Andalucía Villas on October 3rd, meaning they did in fact receive our new parking policy letter via email, mailbox, and front apartment doorIn addition, the garage and carport that was rented to him Mr*** was given the correct prorated concession as a way of apologizing for any inconvenience Also, when Andalucia Villas has an issue with a mailbox lock/key, permission of the mail carrier to open the mailbox with the USPS master key is required firstWe do not open any individual’s mailbox ourselves unless the mail carrier is presentIn addition, Andalucia Villas’ maintenance staff must be present to physically replace mailbox locksAs you can imagine, designating a meeting time between the mail carrier and the Andalucia Villas maintenance staff is very difficult In regards to the eviction notice that the resident received for non-payment of reserved parking: per the Andalucia Villas lease contract, any individual who refuses to pay rent, fines, or any other fees in a timely manner is subject to an eviction noticeRegardless of whether a resident owes two dollars or two thousand dollars, we treat all residents the exact same and are in full compliance of the Fair Housing ActWhat we do to or for one resident, we do for all othersTherefore, even though it may sound excessive to serve an eviction notice for non-payment of reserved parking, it is indeed required that we do so I apologize to Mr*** if I may have come across rude, and not able to help himIt is my goal to make Andalucía Villas a pleasurable place to call home and sincerely do care about the residents In conclusion I feel that Andalucía Villas does not owe Mr*** $for reimbursement due to his vehicle being towed by ARS TowingIn the event he feels his vehicle was wrongfully towed he can contact ARS at *** to seek resolution Best regards, *** *** Community Director
