12/29/2015To Whom It May Concern,I am responding to the recent complaint filed by Mr [redacted] of Charlestown, MassWe were contracted to perform work at the family residence in Charlestown in Late May of Unfortunately, almost immediately we experienced an issue with the owner in regards to the initial deposit to fund the projectThe owner reneged on providing the funds as agreed per the contract and so began the flow of things to followWe had several situations where the rules evolved or changed at the owners discretion to suit the owners needsI believe that every service provider can attest to that one customer that they have had an awful experience with and this was definitely oursAt first glance the owners seemed professional, fair, well educated, well spoken and of financial means to be able to afford the project that they were undertaking and while we had a contract with a provision of terms that outlined the manner of progress and the expectations for payment, it did not play out as dictatedWe were constantly put in a position to perform additional work outside of the pre determined agreement and although we had signed change orders for each instance indicating the owners approval for additional costs, when the total cost of the project came close to the original estimated total cost we experienced terrific difficulty obtaining further payments, to make paymentsThere were several instances where owners made written agreements to make payments to venders upon pre determined milestones in progress that came and went without being honoredThis put us under tremendous financial strain as we effectively began to finance the project completelyEventually things became so difficult that we agreed with the owner that we would step out of the equation while instructing our subs to continue to finish the project under the owners supervision dependent upon the owner paying them directlyIt was with incredible reluctancy that we agreed to step back from the project but it was presented as the best solution to get the project complete without enduring additional radical misrepresentation or inappropriate coordination from the home owner, it also seemed to be the smartest decision to protect our sub contractors to ensure that they were secured directly to the homeowner, further guaranteeing them payment in the event of a complete breakdown in relations between our company and the homeownersUnfortunately, the owners lack of experience with onsite supervision and our removal from the project resulted in a number of issues that the home owner was not prepared forAlso, the home owners statement regarding the debris in the rear yard does not reflect the fact that the rear yard was under 4-feet of frozen snow, the gutters were not installed as the decks were still mid completion, siding was incomplete around a door that was special order and required a 50% deposit to put into fabrication and the choice of materials utilized for the deck finish was a materials that was selected and designed by the architect and the homeownerThis was not a design build by us, this was simply a contract build for a client, Wellbuilt had no input as to design or materials specifiedThat information was issued by home owner and architectAlso, there were certain aspects of the project that were not designed, drawn or specified like the stairs to the deck, the rear yard fencing or basement bar area that could not be completed due to a lack of direction and the weather conditionsThe homeowner believed it was fair to personally speculate a value for this portion of work as a credit without any professional advise or guidanceThis happened on numerous occasions that the homeowner would demand considerable financial credits for scopes of changed work or unspecified work without any rhyme or reason or indication of how they arrived at this amountIt is a combination of speculated costs of such and additional change orders that were signed and agreed that incorporate the ludicrous dollar amount that they are requestingLastly, just for the record we would like to mention that we are still currently employing the same sub contractors for the most part that were hired during the mentioned renovation regardless of the fact that the home owner has reneged payment in part for some of their services after our removal from the projectThis is only possible due to the fact that we treat our subcontractors with the upmost respect and we have always harbored a fair working environment for everyone on all of our projectsAs a matter of fact our glass shower door installer recently informed us of his horrible experience with the same homeowner and the fact that he is still not paidThis element of the work was outside of the original contract allowance for the bathroom construction and was contracted outside of our supervision and involvementAlthough we are regretful for the circumstance in which the owner contracted with the installer and neglected to make payment we are also considerably out of pocket as it stands with costs that were lumped on us from breach of contract with this clientAt this time we have taken this as a learning experience in such to avoid projects in the future that present red flags at the early stages and promote difficult situations from the offsetIn this business it is not uncommon to hear the horror stories about disconcerting contractors or unreasonable homeowners with dishonest intentions, and it is worth keeping in mind that when planning a project or renovation it is more important to budget within your means as opposed to ordering a caviar menu with a buffet budgetWe are providing an initialed reference from the actual contract to represent the actual agreementYou will note that the contract states the initial deposit in the 1st line ( This was not upheld )It also dictates how the payments should proceed, the 2nd paragraph explains how the price was a total estimated of 350K with the builders fee of 10% of costs ( again, this was not upheld ), the 3rd paragraph explains the process to follow if homeowner chose to cancel the scope ( this was neglected at owners discretion ) and in the final paragraphs it represents that additional work would be at the request and approval of the homeowner and in turn the financial responsibility of the homeownerAt this time it is important to add that we only wish the best for these clients and their families, we truly hope that they are settled in and comfortable and that they have arrived at some element of closure on this entire experienceWe also would like to put this episode behind us and move forward with the experience and knowledge that we earned and in closing, we wish this family the best in the future

Most egregious statements that the principals made which are false: "The owner reneged on providing the funds as agreed per the contract..."; "We are still currently employing the same subcontractors..." and the most misleading statements of Wellbuilt's responses are: "when the total cost of the project came close to the original estiamated total cost we experienced terrific difficulty in obtaining further payments" and "it was with incredible reluctancy that we agreed to step back from the project".
