Insurance Company ("StarStone") Policy Number *** (the "Policy")The Insured seeks resolution of Claim Number *** *** ("Claim")Wellington Claim Service, Inc("WCS"), the claims administrator for StarStone, is responding on StarStone's behalf.The Policy provides homeowners insurance coverage on the single-family dwelling located at *** *** *** ***, Tyler, TX (the "Property")The Property is a one story brick veneer/hardi-plank dwelling, encompasses 1,square feet and sits on a concrete slab foundationThe Policy, effective July 26, 2015, through July 26, 2016, provides a dwelling limit of $146,The Policy provides replacement cost coverage, subject to a $1,Wind/Hail deductible and a $1,All Other Perils deductible for covered losses.The Claim is for property damaged by a wind event that the Insured initially reported as occurring on April 22, 2016.On August 1, 2016, WCS received the First Notice of LossThat same day, WCS assigned the Claim to independent adjusting firm, *** *** *** *** ("AD")J&D spoke with the Insured on August 2, to schedule an inspection of the reported damages.On August 5, 2016, WCS attempted contact with the Insured to acknowledge the Claim and discuss the claim processContact was successful on August 8, 2016.On August 5, 2016, *** ***, the field adjuster for J&D, inspected the property with the InsuredAt the time of the inspection, the Insured provided Mr*** with a handwritten invoice from a MrJoe *** for $3,for the removal of two treesThe invoice was datedApril 16, (before the initially reported loss date), and contained no contact information forWellington Claim Service, Inc.*** *** ***, Fort Worth, TX Phone: *** • *** Fax: ***www.WellingtonInsGroup.com Mr***The Insured stated that Mr*** ran a local tree service, and that he hired him to cut a limb off of the rear slope and remove a tree in the front yard that was overhanging the dwelling as a result of the wind storm.During the inspection, Mr*** observed no wind damage to the dwelling roof nor was he able to inspect the previously removed damaged trees/branchesThere were no missing or creased shingles on any slopes nor was there evidence of any tree damageWind damage to the gutter guards on the front and rear exterior elevations was observedTwo metal panels on an outdoor shed were damaged by a tree limb laying on top of the panels at the time of inspection.In accordance with the inspection findings that there was no damage to dwelling roof from the impact of a falling tree, WCS concluded a partial absence of coverage pursuant to the following policy language:TEXAS HOMEOWNER POLICYAdditional ProtectionTrees, Shrubs, Plants and Lawns* *We will pay up to $for reimbursement of reasonable expense you incur for the removal of debris of trees at the address of the residence premises for direct physical loss caused by windstorm, hail, or weight of ice, snow or sleetThe fallen tree must have caused damage to the property covered under Coverage A-Dwelling Protection or Coverage B-Other Structures Protection.*The covered estimated damages of $287,to the dwelling (for the damaged gutter guards), and $to other structures, which did include tree limb and debris removal of $186.51, fell below the $1,deductible.On August 15, 2016, WCS discussed the findings and resolution of the Claim with the InsuredA copy of the estimate and partial denial of coverage were issued to the Insured the same day.On August 31, 2016, the Insured submitted an additional handwritten invoice and statement regarding the removal of two trees from off of the insured's houseThe statement was signed by the Insured and a Mr*** *** and stated that Mr*** and his crew, "*** *** ***", were paid $3,to perform the service on July 6, as a result of a storm that occurred on July 4, The statement indicated that while Mr*** received $3,as payment, the total amount charged for the service was $4,As shown above, the Insured did not provide information regarding this service during the inspection that occurred on August 5, Further, the loss date of July 4, was inconsistent with the originally reported date of loss of April 22, or the date of the first handwritten invoice (for the same amount) dated April 16, 2016.On September 6, 2016, WCS advised the Insured that the evidence did not support damage to the roof of the dwelling and we would be unable to consider any additional reimbursement for removal of debris of trees.The Complaint is our first notice of the Insured's request for a copy of his policyI have attached a copy for his review.The Insured references a prior loss that occurred "last year"WCS received notice of a wind loss occurring on April 6, 2016, sixteen (16) days prior to the date of the claim discussed aboveThe loss involved damage to a neighbor's house and carA tree on the Insured's property had been struck by lightning the year before and had not been removedDuring a windstorm, a large limb on the tree broke off landing on the neighbor's roof and carAn inspection found the tree was dead and needed to be removed to prevent further damage to the neighboring propertyThis was a third party liability claimAs part of the settlement, WCS paid the neighbor for their damages and to have the tree removed.I trust this responds to the Insured's complaint, however, should you have additional questions or comments, please I am rejecting this response because: I am sick & tied of the lies that this " D " rated insurance company that can not honor their BusinessI am changing company, so they can sent my refundPlease post this !
