[redacted] ***, is a previous buyer I represented as a real estate broker, not a home inspectorMy job was to oversee the transaction, but not inspect or guarantee the condition of the home or its components See Buyer Material Issues form attached The home was built in 1950, remodeled in and a list of updates/changes were given to the her Ms [redacted] closed on her house on June 3, Ms [redacted] was told on different documented occasions during the transaction that I do not do home inspections nor do I guarantee the performance of inspectors, services, products or repairs made by the seller See Buyer Material Issues form #4, B, signed by Ms ***Also refer to same form letter D about disclosure of information by brokerThe residential purchase agreement #18, B, describes the sameRPA page 9, #23, specifically states brokers do not guarantee performance of vendors even if referred to buyer and “Buyer and Seller may select ANY providers of their own choosing.” See attached formThe home inspector does not work for me, and buyer was free to pick any home inspector that she wishedThe RPA also states on page 5, #that property is bought and in its current conditionSee attached formOn the buyer inspection elections form, Ms [redacted] chose to go with only the home inspection and the pest inspectionSee attached formThe seller purchased a 1-year renewable home warranty that would cover air conditioner repairs or replacement, if required, that Ms [redacted] decided not to use See attached confirmation sheetAlso months ago Ms [redacted] wrote on the internet, while calling me a liar, “All my plumbing has been replaced and my AC.” So, was her AC already replaced and this is another attempt to slander my name or was she being untruthful back then as well? See attached documentationWith these facts in place, I never inspected, diagnosed or gave my opinion on the HVAC systemThe people who made any claims about the hvac condition were the home inspector and the seller The seller gave her an in-depth repair list of items and #mentions the HVAC ducting was repaired/replaced See attached disclosureMs [redacted] is incorrect when stating the HVAC “went out” on the day she received keys The HVAC capacitor failed, so the compressor would not kick on to blow cold air, but the HVAC unit itself did not fail Ms [redacted] called me, and I had [redacted] respondHe hard started it because it was the weekend, and he didn’t have a replacement capacitor I paid $for this HVAC service out of my pocketSee attached invoice The reason we used [redacted] versus the home warranty was timing It was hot, and we didn’t want her family to go 3-days without air conditioning Later when the capacitor stopped working, I went to the parts store and bought one for [redacted] to installAgain, an out-of-pocket expense to meI have attached several text message conversations I had with Ms [redacted] that show I responded promptly, reasonably, and provided guidance even late at night to help herOn July 5th at 9:pm, Ms [redacted] reached out to me about a huge water leak under her sink instead of using her home warranty I responded at 10:pmBy 10:pm, I had a contractor set up to go to her house at am on July 6th and fix the problemI paid $out of my pocket to fix this issue without a simple thank you from Ms*** See invoice, parts list, and text messages On July 6th at 1:pm, I messaged Ms [redacted] about the plumbing repair being completeAt 4:pm she messaged me saying the air conditioner wasn’t blowing cold airWe had a text conversation from 4:pm – 4:pmI offered options, use her home warranty, or I could have [redacted] come out againBy 4:pm, I coordinated with [redacted] to come outShe responded to me at 10:pm with “we got it fixed.” She said the issue was a high-pressure switch See attached text messages On Aug at 4:pm, Ms [redacted] messaged me again about an air conditioning issueShe said she previously had “someone come quick fix it,” and wanted my hvac guy to come back out I called the home warranty company and spoke with Tara Wells who said the air conditioner should be covered under the home warrantyAt 5:pm, I messaged Ms [redacted] with this information and asked her why she wasn’t using the home warranty? At 5:pm she responded with “I just didn’t want to deal with them, but now I’m thinking about it, I will call themThanks though.” At 5:pm, I told her that using the home warranty is the smarter move because if there is a bigger issue then they will handle itSee attached text messagesThat was the last I heard from buyer until this Revdex.com complaintI’m sorry Ms [redacted] had a bad experience with her hvac "after" closing on her home However, I did nothing w***g in the performance of my jobI represented her professionally during our transaction and even provided guidance and support afterwardsMs [redacted] bad mouths me and calls me a liar on internet and social media sites, then reaches out to me, and I continue to respond and help her I have spent money to help fix her HVAC and have told her on documented occasions to use the home warranty that was purchased to cover this issue Instead, she used other people, who may or may not be licensed, to make “quick fixes” to the HVAC unitNow she believes it is my faultI also paid $for the plumbing leak she wanted fixed without a simple thank you Today, after months of owning the home Ms [redacted] says I am responsible for her hvac because she failed to use the tools in place to cover these issuesWhen does she become responsible? Did she renew the home warranty? My job was the real estate broker representing her during her home purchaseI oversaw her transaction, which I did both professionally and thoroughlyI am not the home inspectorI do not guarantee the condition of her home or hvac nor am I responsible for condition or repairs per our state contract, which we discussed and she acknowledged on multiple occasions Bottom line is I care deeply for all my clients, and I want to help them in any way possibleI continued to respond and spent my money to help Ms ***There are very few, if any, real estate agents who will do what I have done for her I have been more than reasonable in my actions especially after all the unsubstantiated and derogatory things she has put out on the internet about me She continues to bad mouth me, write untrue statements and ratings about my service while failing to mention what I have done for her, and the money I have spent on her repairsAfter reviewing the facts, I hope the Revdex.com sees the malicious intent of this complaint, and immediately clears my name and reputationI can make time to meet with the Revdex.com in person to discuss this issue and facts involving this transaction [redacted]
