Dear Ms [redacted] :Thanks for taking your valuable time to speak with me on the phone recently in regards to complaint ID [redacted] It saddens me when clients resort to tactics involving your fine organization in hope of securing the outcome they desire instead of simply paying an unpaid invoiceHere are the factsThe paintiffs were client of ours from May through April We provided lawn care and some simple other tasks at their requestI was contacted by the palintiff wife concerning trees in their orchard that needed pruningShe explained and showed me what she wanted done and I delivered a ladder and soon thereafter my employee began pruningShe is a certified arboristI personally made trips to check on progress, even loaded bags of rotten leaves and disposed of them for the plaintiff on one occasionOn the third trip his wife asked me to discontinueShe gave no explanationI removed ladder and asked my employee not to returnI then sent the invoice the first week of May At no time do I recall a phone call or correspondence in regards to this invoiceTo state the work wasn't done is a lie and preposterous! At no time did I ever state "take pride in suing customers for nonpayment"I have never sued any client in years in business| urge you to reconsider this case and printing any of this here say and nonsenseAs a U.SVeteran and former Federal Law Enforcement Officer I have worked to hard in life to have someone make accusations against me and our organizationRespectfully, C Aaron Racey

I am rejecting this response because:MrRacey's "facts" do not match the evidenceThere are no "accusations" or "here say and nonsense," except from MrRacey himselfPlease review the attached email where we informed MrRacey that no work had been done on our orchard, and that he was not to send us an invoiceThis email was sent about two weeks before he sent us an invoice.The day we received the first invoice for these services not rendered, I called MrRacey and left him a voicemail asking if he made a mistake in sending the invoiceHe did not return my callA few days later, we received another invoiceIt seems to me that he was trying to send a messageNot once did he attempt to contact us to resolve this, even on the occasions where we tried to contact himWe have all of his invoices and their envelopes if you wish for me to scan and upload them.MrRacey's "certified arborist" spent all of her time expounding on the theories of arborism and wandering around looking up at the sky, rather than actually doing any workAs mentioned in the attached email, our neighbor actually asked us what this person was doing in our orchard, as he didn't actually see any work being doneThe crew we hired a week later to do this work commented to us that no trimming or pruning of the trees had occurred prior to their starting their workThis crew and our neighbor are both willing to sign an affidavit and/or testify to that effect, if necessaryOn this third trip mentioned by MrRacey where he removed the ladder, MrRacey did not speak to either my wife or I as he claims; we just happened to notice that the ladder was gone one morningThis was before I called MrRacey on the phone and terminated his services
As you can see from MrRacey's response, we were reliable customers for two years for lawn care, and we always paid on time and in full (we have the cancelled checks to prove this as well)For his services, we had paid him a total of $3,over that two-year periodObviously, our refusal to pay this far-lower amount is not a case of us trying to avoid paying "an unpaid invoice." I have more important things to do with my time than to argue with MrRacey over this; however, I believe it is important to take a stand when things like this happen.In summary, we tried to resolve this directly with MrRacey, but he insisted on continuing to invoice us for work not done, then went on to send this to a collections agency thereby threatening my credit ratingIn my opinion, MrRacey's behavior has not been ethical and appears to be escalatingBecause of these issues, I have had to "resort to tactics involving your fine organization" to try to resolve this matter.As a four year US Army Infantry veteran and having worked in law
enforcement myself subsequently, I fail to see the relevance of
MrRacey's veteran status and law enforcement history to this issue
