Wenger Construction, Inc

Review: Entered into an agreement with Wenger Construction, Inc. for the remodeling of [redacted]. on 4/3/2013. The estimate for time and materials was $126,000. A deposit of approximately 10% was ask for and given in a check of $13,000 that day. Early in the process it was decided to change the heating source and an estimate of $10,000 was given for this change. Despite asking frequently how the budget was throughout the project the homeowners where never given the impression that the end cost would be $182,055.08 In fact the homeowners were ridiculed for being "obsessed" with the cost. There were changes made on the homeowners part that would increase the end cost but when ask for an estimate of the change it was never given in writing and quoted as "a wash" or $250 and one time $1000. The homeowners did what they could to keep down cost including demolition, clean up, painting. Purchasing directly the paint, faucets, lights, appliances, sinks including pedestal and kitchen. Sacrifices where made also to delete the under counter lighting, cheaper flooring, allowing the old hardwood floors to remain to use as a subfloor. All of these things the contractor said would help keep the end cost down. When the contractor submitted his 3rd bill the homeowners said that they were out of money he said that all the materials were bought and we only had to pay for the remaining labor. His labor ended 2 weeks later. He then submitted a total of $59,341.97 of bills after that date.Our complaint is that the contractor spent more money than the homeowners had or agreed to without their permission or knowledge. The homeowners have already paid the contractor $149,493.11. This is over $13,000 more than what was expected.Desired Settlement: We believe the remaining $32,561.97 should be absorbed by the contractor for making false claims and not communicating with his clients so that necessary adjustments could be made.

The "Customer's Statement of the Problem" is filled with inaccuracies and untruths. Customer entered into a signed agreement with contractor to complete all work on a Time and Material basis, Customer was fully aware and agreed upon all changes throughout the entire job. The invoices submitted accurately reflect the work customer requested contractor to complete.
