I deeply apologize that I did not get this information to you on the date we requested. We are a small company but very busy.
I am sending you this letter in response to Mr. [redacted]'s allegations that services rendered to him where...

not done correctly therefore his case had to be reset and reserved.
I would like to give you the facts of the situation, as we both know there are always two sides to every story. But this is a serious accusation and we are not taking it lightly. Our company has been in business for over 20 years and this is the first time we have been reported to Revdex.com for bad service.
On June 09, 2015, Mr. [redacted] called our office in which I spoke to him and explained to him our Process Serving Procedures as I always do with our prospective clients over the phone when they call asking for information.
Our Policy for process serving is as follows. We do unlimited attempts as long as the address Plaintiff provides us is correct. If they send two addresses we will attempt both, if one of them is either a no contact or is a bad address. It is the responsibility of the client to make sure the address(s) sent to us are correct (no missing or wrong numeral's etc...). But, we also understand that if it turns out to be a bad address the Defendant could have moved and new people could now be living in the home. Once claim is served our server signs and sends it back to our office, in which at that time we send our clients an Unconformed Copy and we prepare it to go to court. We always mail Proofs of Service to court sending a copy so the court can return it to us, for our records, in which at that time we will also send a stamped filed copy to our client for their records.
The Law does not allow us to serve at the USPS (Government Owned) Post Office, but we can serve at a UPS Store, Postal Annex, Mail Boxes Etc.., where the Defendant is renting a P.O. Box, we just have to confirm with the store management that they do own a box there. On 6/10/15 @ exactly 10:00 am Manager [redacted] did in fact confirm with our server [redacted] that Defendant, [redacted] dha Raynforest, Inc. was at that time a box holder at the Postal Annex at [redacted] Rd, Ste XXX XXX, Carlsbad, CA XXXXX. He at that time left the documents with her and filled out the Proof of Service accordingly. Box. B for sub-service. Please see copy of the Proof of Service. We sent Mr. [redacted] all necessary copies for his records.
On July 13th, 2015 @ 5:38 pm the day the case was to be heard, Mr. [redacted] called our office in which I, [redacted] answered. He proceeded to say that he had went to court and that the Judge did not accept the Proof of Service because it was not served correctly.
When I asked Mr. [redacted] why the Judge said it was served incorrectly he proceeded to tell me that he doesn't carry paper to take notes as to why. I explained to him that we have done these types of services on many occasions in the past and that it seemed odd that the Judge didn't accept it. I was not in any way insinuating that Mr. [redacted] was lying but I needed to know why it wasn't accepted and had to be served again so taht I could do 2 things.
1. Offer to re-serve it again at no charge.
2. Let my server know that it needed to be reserved and to not make the same errors if in fact there was one made by our server.
I tried to offer No. 1 to Mr. [redacted] but he wouldn't hear what I had to say, he was angry saying we supposedly didn't do our job. Now, there have been times where the Judge may not accept it because of an error in the name buy it depends on the Judge. If they don't accept it, it's not our fault. We will always work with our clients because their satisfaction is our No. 1 goal. We always offer to re-serve their case at no additional charge and still have to pay our servers for going back out to attempt. In the end we don't make money because we just to make our client's happy. Our company is based on Loyalty and Satisfaction. Many companies come to us for process serving because we will get it served.
We do Process serving for many companies across California such as, Aladdin Bail Bonds, California Deposition Preporters, Alliance Environmental Group, Inc., [redacted] Federal Credit Union, Don Roberto Jewelers, Puente Hills Nissan, Crown Toyota, Able Restoration and the list goes on. We also work with Lawyers like [redacted] Zide & [redacted] Harrell Pailet & Associates in Dallas, Texas for Small Claims, Summons & Complaints, Judgement Debtor's Examinations, 3 Day Notices, and other documents our client's need our services on.
Had Mr. [redacted] given a response to my original question, "What did the Judge say was not good service", we would have gladly re-serverd his case at no additional charge. We need to know the problem so we can help to fix it.
I hope the following gives an explanation of what happened on that day.

Similar to before, this organization relies upon lies and not facts. This is just more of the same. I clearly offered details on why the judge ruled that the service was invalid. The claim that I said anything to the effect of "he doesn't carry paper to take notes as to why" is simply more ludicrous lies.
To be clear, and prevent Wenhawk Court Services from claiming they didn't receive my response, here it is: The judge ruled the service invalid because the party that was "served" had no relationship to the defendant. The defendant was able to argue that the document was never received and judge agreed.
Furthermore, I would never want my case re-served by the Wenhawk organization because it failed to follow the law in the previous service attempt. The idea anyone would be interested in having them re-serve again is just ridiculous.
I asked for a REFUND because the service was NEVER LEGALLY COMPLETED. Regardless of [redacted]'s vast legal knowledge, I have to side with the judge and assume he is right when it comes to the letter of the law.
At this time, I feel it is most prudent for me to contact local print newspapers and report the incident.

I do not accept their response because it's clear Wenhawk Court Services, Inc. refuses to accept responsibility for their mistakes. The fact that they can tell anyone they know the law better than a judge is laughable. Thus, I'm lodging these complaints with the Revdex.com in hopes it can prevent others from making the same mistake I did when I gave these scam artists my money.

Based on their last response, it's that they have nothing real to say because they have resorted to throwing personal insults - how professional. It's amazing that now they record their calls, how convenient for a company that has been doing this for "25 years."

To be clear, I don't want any refund at all nor do I "Obviously need the money." Again, I am pursuing this because Wenhawk Court Services, Inc. lied. They misrepresent themselves, the facts, and upon the attention of the Revdex.com, they resort to personal insults. The fact that they can even call themselves a company is ridiculous.

I am not accepting any offer of a refund, partial or full from [redacted] or company; however, I am going to do my best to make sure no one else gets scammed the way I did. That is why I am vehemently pursuing this issue.

I accept responsibility for not researching them fully, and I believed the lies they publish in their marketing material. Their promotional material looks legitimate ... obviously looks can be deceiving.

I just hope my story being published on the Revdex.com will make people stop and think before giving this scam organization their money. If I had stopped and read the honest Yelp review from another dissatisfied customer, I would have gone elsewhere.

Businesses like Wenhawk Court Services, Inc., give process servers a bad name. They lie in their marketing materials, and they lie in their responses. It's a shame they are even in business. I appreciate the Revdex.com's attention on this matter, and I will be contacting both the Bureau of Security and Investigative Services as well as the San Diego Union-Tribune.

In closing, if you need "Reliable Process Serving, " then Wenhawk Court Services, Inc., shouldn't even be considered. The facts are clear. Rory Wendell will lie to you, Carmilla Wendell will lie to you, and their employees are obviously told to lie to you. Save yourself money, time and headache by taking your business elsewhere. They are not professionals. They are nothing more than aging scam artists looking forward to stealing your money by peddling lies.

First off WE NEVER say nor have we said we KNOW THE LAW BETTER THAN ANY JUDGE. As a matter of fact WE NEVER give legal advice for that same reason. We have made many attempts to resolve this matter and like I said before, had we of known the exact reason his case was not accepted in the first place we would have GLADLY done the re-serve for free. We always try to resolve matters because our Business has always and will continue to run on Honesty, and Integrity. We do unlimited attempts, as long as the address provided by the client is correct-WHAT COMPANY DOES THAT?? We file proofs of service with the court so our client doesn't have to. Obviously, the proof was not accepted by the Judge, therefore the client should have told me over the phone when I asked him what did we do wrong so we can fix it because it was a routine serve. The way it was done was a normal job for our server. But instead the client was angry and only spoke of getting hi money back, but we have to know why in order NOT to make the same mistake. Once again, we will refund $44 of the $69 to the client. The comment THAT "HE GAVE HIS MONEY TO THESE SCAM ARTISTS" is actually funny, if we were that we would not be in business for this long over 25 years. But our clients return to us because THEY KNOW WHO WERE ARE! We build our relationships with our clients and we will go above and beyond to get the job done for them.
