that point, “if” this customers claims had even a shred of validity to them we would do everything we could to assist him. However, this customer’s claims are not only without merit but the damages he states are as absurd as his claims. Here are the true facts:1. The customer purchased the vessel on Oct 27th (day after Thanksgiving) without looking at it. We strongly recommended he come look at the boat but he said he could not because he was a TRUCK DRIVER that hauled Turkeys and it was his busy time of year. For this reason, we ADDED a paragraph into the sale contract that we offered to have him inspect the boat and he declined and required that he signed just below this statement. See attached signed contract.2. The vessel was a “1988” WellCraft 3200 St Tropez. To put this into perspective the new replacement cost for this vessel is approximately $130,000.00…. He paid $9750 plus his shipping and loading. We ADVERTISED the vessel AS UNFINISHED and to be sold ASIS WHEREIS. Please note the following statement in our advertisement: WORK WE'VE DONE & CONDITION ON THE BOATI just want to make it clear so there are no surprises, we've been in business 42 years and who we are and our feedback on eBay is priceless. I also don't want any first time buyers to get the idea that the day the boat arrives they will be able to jump in the boat and go for a ride. The buyer should not be surprised if they needed to do some minor work to make the boat ready 3. Back ground: The vessel was being refurb in 2012 when, due to personal circumstances, I stopped working on the boat. The boat sat for 3 years and I could not get back to it so I finally decided to sell it UNFINISHED. This was disclosed in our ads and in the sales contract the customer personally signed. 4. The customer was finally ready to ship the vessel in Feb. 2016. When the boat arrived to the customer he called saying:a. Would not Start: The customer wanted to SPLASH the boat and drive it to his slip. I reminded him that I repeatedly told him the boat was UNFINISHED AND THAT I TOLD HIM HE WOULD NEED TO WORK ON THE BOAT BEFORE HE COULD DRIVE IT. The ad also makes this statement. b. Scratch on the paint from shipping or loading: The signed sales contract explicitly states that we are not responsible for freight damage. It also states the customer is supposed to make a note on the Bill of Laden of any freight damage. That did not happen so unfortunately the customer lost his ability to file a freight claim.  Please see the attached photos when we loaded the boat on the trucker’s trailer before leaving our yard. FYI: The scratches in the photo sent to me were very minor and would cost less than $150 to repair.  5. Please see attached the SIGNED SALES CONTRACT. [redacted]
