Review: We brought our vehicle in to the dealership on February 14, 2013 at 12:30pm to assess an issue with the transmission and determine whether or not the repair would be under warranty. We agreed to a diagnostic charge as well as a rental car during the "1 day" they told us it would take to make the determination regarding warranty status. Their customer service department went completely dark for 6 days and performed none of the due diligence they committed to, including obtaining the necessary documentation from another dealership that had performed previous work on the vehicle. The did not contact us, did not return 5 phone calls (all documented via mobile phone records), or return an email for 6 days, at which time we returned to the dealership and demanded our vehicle back. The gave us a bill for the diagnostic fee and charged us all 8 days of the rental car, despite the fact that 7 of the days the rental car was necessary was due to their non-responsiveness. When we refused to pay it, they refused to return the vehicle. We had no choice but to pay it and file this complaint to have 7 days of rental fees returned.Desired Settlement: 7 days of rental car fees @ $35/day + tax.

Enclave Checked & Diagnosed at our Dealership. She called for an

appointment, refusing to go to Buick GMC Cadillac for repairs, since they had

not addressed her concerns previously.

She signed & initialed the Repair Order giving us authorization to

diagnose her vehicles concern, knowing the 2008 Buick Enclave was out of

warranty. At this time she requested a rental vehicle being advised that it was

to be customer pay. She was advised that if it was not a warranty repair then

it is/was her responsibility to cover the costs of the diagnosis or repairs. At

the time of completing diagnosis and giving Mrs. [redacted] the estimate, she

requested help from GM. Calling her back after GM declined assistance she

requested we get her previous Repair records from the other Dealer. After 4

trips to the Dealer no one had records showing previous concerns. She then took it upon herself to contact GM

Customer Assistance. The Service Consultant suggested completing repairs or to

drive the vehicle until she could get an answer from GM to have them assist.

She refused driving her vehicle and chose to continue to stay in the

rental. With No assistance given she

then decided to pick up her vehicle. At this time Mrs. [redacted] is responsible for

the rental vehicle, which she rented on her own, for the sum of $245.00, plus

the diagnostic fee of 46.89.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

The only reason the rental vehicle had to remain in our possession for so long is due to the inactivity and unresponsiveness of the dealership that had our car. Rather than telling us that they had made "4 trips" (which is a highly dubious claim to begin with) to try to obtain the vehicle's service records, they simply refused to return calls or emails, for both if which we have documentation available. When they finally did respond, we were able to retrieve the records ourselves in a matter of hours. We refuse to be responsible for charges associated with a rental beyond the originally agreed upon timeframe of the 1 day they said they needed to attempt to retrieve the vehicle's service history. The fact they chose to do nothing, including simply respond to our messages regarding a delay, for an additional week does not make us responsible for the extended cost of the rental.
