To Whom It May Concern,I represent [redacted] (“Association”)The Association requested me to contact you regarding the above-mentioned complaint in response on behalf of Wessex Commercial Management (“Wessex”).Factual History [redacted] is a commercial office condominium complexThe Association is run and operated by a Board of Directors elected by the Members of the Association The Association hired Wessex to handle the management of the office condominium, which includes maintaining its common elementsIn fulfillment of its managerial responsibilities, Wessex acts on behalf of and as an agent of the Association, under direction of the Board of Directors of the AssociationThe Association and [redacted] (“ [redacted] ”) own neighboring properties [redacted] ’s backyard property line is shared with a portion of the Association’s east property line [redacted] ’s property is within the [redacted] Homeowners Association, a residential homeowners association There are four (4) residential properties and a [redacted] Homeowners Association common area tract that run along the eastern boundary of the Association’s property lineWhen the Association was under development, the [redacted] of [redacted] required that the [redacted] install and maintain trees along this eastern boundary in order to provide an adequate shelter of the commercial development to the residential owners In the plans reviewed and approved by the [redacted] of [redacted] , the required trees to line the property line are eucalyptus treesIn the [redacted] approved plans, there are no other allowed treesSeveral years subsequent to the [redacted] of [redacted] approving the Association’s landscaping plans and the trees installation, [redacted] purchased his property when the eucalyptus trees where at a mature height with a mature canopyThe Association provides common element maintenance on a routine basis and has a professional landscaping company that provides maintenance and guidance on maintaining the trees located on the Association’s Common ElementsThe eucalyptus trees along the eastern property line are properly and routinely maintained by the Association’s professionalsIn the past, the Association has received complaints from its residential neighbors when the trees have been trimmedHowever, these complaints have only been to the effect that the trees have been trimmed and thinned out too much, resulting in too much visual of the commercial property from the residential property [redacted] Complaint It has only been very recently that the Association has received any complaint from its neighbor, [redacted] [redacted] has recently made complaints to Wessex, the Association’s management companyIn response, Wessex has worked with the Association’s landscaping professionals to trim back the trees that are directly behind [redacted] ’s property in hope to satisfy his complaints, but not create additional complaints from other residential neighbors while keeping compliance of the [redacted] of [redacted] ’s requirementsWessex further has notified and kept the Association up to date regarding [redacted] s’ concernsThe Association has taken serious consideration of [redacted] ’s dispute and concerns and has sought to work with [redacted] while acting within all its legal boundaries, in good faith and striving to be a good neighborIn [redacted] ’s most recent correspondence to the Revdex.com, he states that “properly maintained” is a subjective statementHowever, it is notThe Board of Directors and the [redacted] of [redacted] inspect the Association’s common elementsThe Association, with its professional landscapers has determined the trees are properly maintained [redacted] alleges that the trees have been improperly maintained for years; however, it has only been recently that the association has ever received a complaint from [redacted] The Association cannot respond to a complaint not madeAs further noted by [redacted] , once the Association received his complaint, the Association immediately responded, as a good neighbor, to provide additional maintenance to the tree and trimmed it further backAdditionally, in [redacted] ’s recent complaint to the Revdex.com, [redacted] alleges that [redacted] , a manager for Wessex, agreed to remove the treesHowever, it appears that [redacted] incorrectly heard Mr [redacted] ’s response that in order for there to be any chance for the trees to be removed, the [redacted] of [redacted] would have to provide a variance Pursuant to Mr [redacted] , [redacted] was never instructed that the trees would be removedIn fact, as the trees are located on Association property, it is only the Association’s Board that has the authority to pursue the process to consider removing the treesFurther, eucalyptus trees are widely accepted tree and permissible under [redacted] of [redacted] codeThe trees currently are required to be in their present location under the Association’s [redacted] approved landscape plans [redacted] has concerns regarding his dog healthHowever, neither Wessex nor the Association have acted inappropriatelyWessex, acting on behalf of the Association, has acted in the best interests of the Association and has attempted to address [redacted] ’s concernsAlthough [redacted] doesn’t approve of trees, their presence doesn’t give rise to a Revdex.com complaint against WessexWessex has attempted in its best efforts and ethically to resolve [redacted] ’s complaints [redacted] has not provided any allegations or evidence to substantiate otherwiseAccordingly, this complaint should be promptly dismissedThank you for your cooperation regarding this matterPlease contact me should you have any questions or concernsSincerely, [redacted] [redacted]
