Westamerica Bank (WAB) approved a merchant account for Braids & Boutique (Merchant) in February 2014 to accept credit card payments for hair care services. In signing the agreement she represented that her business would be 100% card swiped and of low risk. Our merchant agreement states the merchants must only sell product/services that Westamerica Bank has approved as agreed to by the each merchant. The Merchant presented a "split transaction" (two amounts, the same card) totalling $1,200.00 which was outside of the normal parameters and was flagged for investigation. The Merchant was contacted by our investigator and the transaction described by the Merchant represented a Money Gram sale. The merchant was advised of the violation of their merchant agreement and was advised to enter a credit back to the card processed, which was done. In subsequent conversations, the Merchant then claimed the transaction was for product. Westamerica Bank would not have approved the merchant account had the merchant disclosed that they intend on acting as a Money Service Bureau. Money Service Bureaus must be registered with Visa and MasterCard prior to a transaction entered into the payment system. Once the Merchant processed the return (credit) for the money gram transaction, the merchant account was closed for violation of the merchant agreement, prohibited product. The terminal had three additional transactions that the Merchant refers to, these transaction were not charged to the card holder when the account was closed. As a courtesy to the Merchant, WAB reentered the transactions and will hold those transactions until the chargeback liability period ends as we do not have a clear understanding of what was purchased due to the circumstances above. Should any of those transactions be disputed by the card holders, the Merchant will need to pursue the card holders outside of the payment system, also as outlined in the merchant agreement. This letter is in response to a complaint from Mr*** *** *** contacted Westamerica Bank and said he did not receive money during an ATM transaction at our Madera, CA location on August 3rd

Westamerica bankOn August 3rd, Westamerica Bank instructed Mr*** to open a Reg Eclaim with his bank (U.SBank) to be reimbursed for the fundsOn August 13th, a follow up call was placed to Mr*** to assist him with properly filing a Reg E claim with his bankThere has been no response back
Westamerica's ATM department reviewed the transaction in question and was able to validate the machine did malfunction with the transaction in questionThe industry follows a standard that non-customer ATM claims are not resolved by reimbursing with cash, over the counter, to non-customer claimants for missed-dispensed ATM transactionsMr*** will be reimbursed via his bank (U.SBank) when he opens a RegE claim with them
