Initial Business Response /* (1000, 12, 2015/10/14) */
I read the complaint, and there is no demand, so I am not sure what further information I need to provide. Despite that, I am aware of Ms. [redacted]'s situation, and for clarity, we did not wreck her car. We were delivering her vehicle back to...

her, free of charge, and a third party ran into her vehicle. The third party had insurance, so she should have been made whole. Due to privacy laws, I cannot speak to that remedy as I am not privileged with that information.

As to the statement that the fabric protection was not applied, I cannot speak as to the competency of the person stating it was not applied. As explained to her, certain stains are impossible to remove. It is an incorrect statement to assume because a stain cannot be removed, the protection was never applied.

Initial Consumer Rebuttal /* (3000, 14, 2015/10/15) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I would have never bought the car if I was informed that the stains were impossible to get out & they told me they would take care of it. It was less than one month & the stains have came back & I don't understand why I even bought the envirogaurd because it hasn't done anything to protect the fabric in my car. I guess it was nothing but a sale at closing when I bought My Car.
Final Business Response /* (4000, 19, 2015/10/16) */
Have her call Bill [redacted] my service manager, at XXX-XXX-XXXX. He's expecting her call. We will replace the stained material with new material from the factory, so it will be like new. That was an original stain, present prior to her purchasing the car, therefore her warranty won't cover it. Under the circumstances though, I want her happy and will gladly replace it at my cost.
Final Consumer Response /* (4200, 21, 2015/10/20) */

I really don't want to take it back to the dealership to have it replaced. Is there anyway I can take it too another dealership to have it replaced?

Initial Business Response /* (1000, 5, 2016/08/06) */
I spoke to Mr. [redacted] personally, and informed him that in no way would a transmission flush be the cause of his transmission failing. I cannot speak for the competency of the other technicians he sought advice from. He does in fact have a 10...

year old Chevrolet Cobalt with over 150,000 miles, with an unknown service history prior to Mr. [redacted] ownership. Unfortunately, the life expectancy of the transmission is coming to an end. Out of good faith, I offered to refund the transmission flush cost, as well as diagnosis his transmission issue free of charge. I spoke to him about his situation with his new employer, and the driving requirements. I offered to do the transmission at cost, as well as discount the labor because he does need reliable transportation to his new job. We have completed over 5,000 transmission flushes, and doing so would not ruin a transmission. I do not feel Mr. [redacted] will feel the same, and I am sorry for that, as he is a very nice gentleman in a bind from a transportation perspective.

Initial Consumer Rebuttal /* (3000, 7, 2016/08/08) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I do not accept the response from the business. I disagree with this response and there is a false statement written in the response above. First off, Mayes Automotive Group should of never recommended a transmission flush on a car that has an unknown service history. They were fully aware that I didn't know the service history of my vehicle and they still made the recommendation. That verifies that the individuals employed at Mayes Automotive Group were out for the almighty dollar. Their service consultant was well aware that there was a risk involved with this particular service and he still made the recommendation anyways. I have spoken to several transmission shops around the area, and they all stated that a car with over 100,000 miles on it should not have a transmission flush performed on it. Certified mechanics at shops such as [redacted] Transmission Service, [redacted]'s Auto and Truck Service, AAMCO Transmissions & Total Car Care, Ace Transmission Service, and more shops all stated that there should of never been a transmission flush performed on my car due to it having over 150,000 miles on it. Furthermore, Mayes claims that the life expectancy of a cobalt transmission is around 150,000 miles. With them knowing that, why did they make the recommendation that they did ? Sounds fishy to me, and proves that they were after money. In addition, [redacted] stated in his response above that he spoke with my new employer. That is a lie, [redacted] never spoke with my new employer about my current predicament. With that being said, he is being dishonest and made a false statement above. His dishonesty proves that they are wrong and he is trying to squeeze out of this particular matter. Also, his dishonesty proves that Mayes Automotive Group is a crooked place and took advantage of me. To add too matters, I have yet to receive a check in the mail for the transmission flush. A whopping 160 dollars, which will not cover the cost of a new transmission. I put my trust in Mayes Automotive Group to take care of my car properly and they took advantage of me. The owner, service consultant, and service manager know that they are wrong and they refuse to stand behind their work. Mayes Automotive Group in Aurora, Missouri owes me a brand new transmission for their wrong actions. A vehicle with over 150,000 miles on it should never have the transmission fluid flushed out of it and they knew this. Professional mechanics stated that their practices and business was wrong and this incident should have never occurred. My transmission was running perfectly fine before Mayes touched my car. As soon as my car left their car lot, it started acting up. That alone verifies that their practices were wrong. Additionally, I spoke with a District Manager of Firestone in the Joplin area about my current situation. He stated, "A transmission flush should not be performed on a car with over 110,000 miles on it." This just adds credibility to my case and proves this practice should of never been done in the first place. Mayes Automotive Group treated me unfairly and ruined my transmission because they made a recommendation that should of never been done. I was a customer of theirs and they treated me unfairly. Their service manager treated me rude over the phone and mocked me. Everybody at Mayes AUtomotive Group is out for the almighty dollar, and they don't care about their customers at all. I've heard stories from other people that they got treated wrong by Mayes as well, so this is not the first time that they treated a customer of theirs wrong. Their owner was dishonest in the statement above, so what makes you think that he is completely honest with his customers. This entire situation is messed up on so many levels and Mayes should be reliable for their actions. Mayes Automtive Gorup owes me a new transmission and I am very unhappy about this situation. Mayes should replace my transmission for free or pay me the value of a new transmission. Mayes owes me money (value of a new transmission) or a new transmission. I will not settle for nothing less than that. Mayes Automotive Group needs to be held accountable for their wrong actions and correct their mistake. It's pretty sad to see a business like this manipulate a college kid just so they can make extra money. I was treated wrong and expect Mayes to be held accountable for their actions.

Final Business Response /* (4000, 9, 2016/08/16) */
I dispute and disagree with Mr. [redacted] statements. The unfortunate fact is he has a 10 year old car with 150,000 miles, with an unknown service history. I respect his situation, but stand by the fact that we did nothing wrong, and only tried to help prolong his vehicles life expectancy. We use the absolute highest quality equipment, and the flush was performed by a GM Master Technician. Not sure that Mr. [redacted] and [redacted] Automotive will find any common ground in this particular case. As stated, I do respect his situation, thus refunded the cost and did the diagnosis free of charge.
