I am the director of West Coast Fabulous Faces and I received a $non-refundable from *** *** on March which was originally a deposit for a preliminary pageant they were attendingOn March I received an email to move the $
deposit to our State pageant that is being held on May 27-so she could take advantage of an Easter special we were running for the State pageant (below is the correspondence regarding moving the deposit to State) In our state paperwork it clearly states that the $is a non-refundable deposit stating: "Deposits are non-refundableIf you can not attend for any reason you must notify us hours before the pageant and you will receive 1/your deposit towards a future pageant.NO EXCEPTIONS!" She did receive an email with the pageant paperwork with the rules about the deposits on March and March that my constant contact email reports has record of her opening upTomorrow I will mail you a hard copy of this paperwork that state very clearly our rules reading the deposits as well as the email correspondenceThe deposits are non-refundable because we do purchase many things for the contestants in advance-every contestant is crowned with a crown, they get a gift bad full of gifts, a photo plaque and we use the deposits towards production costsWith regards to the claims that she was dissatisfied with the competition itself we judge on facial beauty (points) and personality (points) only -modeling and attire is not a factor with our scoring systemWe don't claim that we are a natural pageant we are a semi glitz pageant and contestant can wear mabecause of the lights but we just don't want them over done like a full glitz pageantI talked to the year olds mother that was mentioned and she said she only put on lip gloss and blush on her daughter and she did not have any hair pieces so I am not sure why she thought she had caked on maand fake hairBut I did respond in an email to *** *** when she requested her non-refundable deposit to be sent back to her that we do not refund but she can use 1/the deposit towards another pageant and she can still use the deposit towards the State pageant

The director did not address the fact that I never signed any paperwork for the State Pageant, therefore never agreeing to the rules

The paperwork does not need to be signed in order for the rules to still apply - paperwork that clearly states that the refund is non-refundable was sent a couple times before deposit was sent so they knew if they committed to entering their child in the State pageant by moving their deposit to the State pageant the deposit is lost if they decided not to come
