you are utilizing the tools available to you.  Fortunately, the Revdex.com not only protects the consumer but also protects Small Business Owners like myself from consumer’s that wish to not fulfill their obligations.   Unfair business practices would be something that my company did not honor or uphold to anyone that signed a contract at the address in which the contract was signed.  Texas State laws are in place to protect both of us and not reading a contract is not a plausible argument in the court system.  Our contract specifically states in bold by where the contract is signed that “you the buyer, may cancel this transaction at any time prior to the midnight of the third business day after the date of this transaction.”  The terms of the agreement are printed on both sides of the page and this 3-day cooling period is why the state allows customers to cancel in case they read something on the contract that they were/are not in agreement with.                 Mrs. Villarreal, I’m sorry that you fell ill and accumulated some bills but I too run a small business and have a family that I need to support and keeping my customers happy is the only way we can do that.  Whenever we get an order, we must make sure we have enough inventory on hand because we do have some customers that want us to deliver equipment to their current house while their new home is being built, or they call us from one day to the next that they would like their equipment installed.  Your equipment has been ordered since you signed your contract waiting for install.   On the contract you signed, you also stated that you wanted us to install your new filtration system next to your swimming pool equipment.  We were sending our employees out to inspect the house periodically to make sure the plumbing was correct so that your entire house (hot and Cold) would have softened/filtered water.  We also looked to see where we can set up your reverse osmosis you requested.                  The contract was signed on [redacted] and we patiently waited, with all your equipment stored at our facility, for your house to be completed.  As to your statement about you having time to decide-- was based on how you were going to finance the equipment after you closed on the house, not on if you were going to proceed with install.  You were going to let Aqua Clear Water Solutions know the financing terms you wanted to pick, once you closed on the house, not on whether the contract would be enforced.  When the house was completed, the office manager called you on [redacted] to let you know we would be installing equipment; however, you did not mention anything about medical bills.  You did say you were living there and you had not closed on the house, which is against the law and a violation against your mortgage company policy.  You also stated you had too many expenses and would like to cancel and possibly install later.  My office manager notified you, [redacted] Villarreal, that you were obligated under contract and that if you wanted to cancel you had the right to if you paid your restocking fee of [redacted] (section 8 on the back of your contract).  The restocking fee is below what the law says we can charge and our attorney’s feel it is enough to recoup our losses should our customers decide they can’t fulfill their obligations.  Please note, we have the right to execute the full contract and when you spoke to the owner of the company on [redacted] they advised you of the same thing.  All your phone calls were returned in a timely fashion and we have notes that messages were left for you.  Our inbound phone calls are recorded so we can see exactly when you called in.  Aqua Clear Water Solutions has given you plenty of time without bothering you with debt collectors or placing a mechanics lien on your property.  We maintain that you keep your fiduciary responsibility as stated in the contract that is binding by Texas State Law.   If we don’t hear back from you within two weeks, we will start the necessary proceedings to enforce the contract for the full amount of [redacted]  Attached are the signed copies of our contractual agreement between Aqua Clear Water Solutions and F[redacted] Fresh copies will be mailed out to you via certified mail. Once again, thank you for taking the time to engage in trying to resolve the matter and we look forward to 1. Installing the equipment, you promised to pay for or 2.
