I Rent a short term rental owned by West End LLC for 4 separate stays during May through October of 2020 in *** Totaling a rental fee of 4450.00 with a refundable deposit of 1000.00 in January of 2020...I made an initial payment of 2225.00 towards rental and 500.00 toward deposit by check on January 12 2020. At the announcement of the pandemic I reached out via email to West End LLC to voice my concern ....and was told to wait a few weeks ...let’s see what happens....I did that I then reached out again on 4 15 2020 to cancel my reservation due to the virus that fact that I have a compromised immune system and General “impracticability “....On 4 19 2020 I received a email from the owner *** ..that he was sorry but he did not have the money to refund me...and if he rents the unit he can refund.....The short term agreement I signed has no cancellation clause .
We received a complaint from *** wanting to cancel a reservation for a property rental. The tenant-to-be had signed a lease for 4 periods of time that are not currently dates with rental suspensions due to the coronavirus. The tenant-to-be is seeking to break the lease agreement and wants a full refund. In normal circumstances, I do not offer a refund for cancelled reservations. Due to the circumstances, I have granted the cancellation of the reservation and have begun refunding the tenant. The tenant has used draconian threats and quickly filed a small court claims within 1 week of email request to cancel reservation. I responded to the initial emails from the tenant and have stated to him multiple times that I had full intention of doing the right thing and that I was doing my best to gather the resources and work the situation out. We have been in business successfully for over forty years - a part of our success has been due to the ethical, honest practices by the owner and staff.
