West Texas Peterbilt Reviews (2)

Complaint: 10808666
I am rejecting this response because:
1) My wife and I disagree with Mr. B[redacted]'s arbitrary assertion
that our claim is "absurd."  2) Mr. B[redacted] has made no effort whatsoever to explain why he
should not reimburse the full $1761.33 that we have requested.
We would like to clarify a few facts connected with Mr.
B[redacted]’s now stopped check, discussed in our original complaint and his
response. We never considered Mr. B[redacted]'s check for $662.50, on which payment
has been stopped, a reasonable reimbursement. We did not cash the check when it
was sent because of an e-mail (uploaded under the title Ace 3-2-2015 to
3-3-2015) in which Mr. B[redacted] wrote "With your cashing of the said above
mentioned check, I will consider this matter closed, and any said or implied
warranties cancelled." We did not want to imply, by cashing the check,
that we were waiving any right to full reimbursement.
The envelope that contained Mr. B[redacted]'s check is postmarked
March 11, 2015, though the check itself is dated March 3. In his response to
the Revdex.com, Mr. B[redacted] states that "after 30 days the check was not cashed
and I did not hear from the client. I then sent them another letter, certified
return receipt." In fact, we contacted Mr. B[redacted] long before he posted
his final return-receipt letter. On April 14 we sent him an e-mail (text
uploaded) to request that he refund us $927.50 in addition to his check for
$662.50. Out of courtesy to Mr. B[redacted], we indicated in that e-mail that we
would wait for a response until April 21 before filing a complaint with the Revdex.com
or taking other action to recover our money. Only on April 22 did Mr. B[redacted]
post a certified letter (also uploaded) in which he ignored our e-mail of April
14, informed us that he was canceling the check for $662.50, and wrote that he
would welcome a "reasonable counter offer." He may consider our Revdex.com
complaint with a request of reimbursement of $1761.33 to be such an offer.
I have uploaded our correspondence with Mr. B[redacted] and a copy
of our check to Mr. B[redacted], and I will be happy to supply further documentation
upon request.
Regards,
[redacted]

[redacted]As Stated by the Business. Yes I did some work for these clients, and feel this claim is absurd. I at one time offered them a partial refund of the repairs for approximately $650. I even sent them a check which I have proof of delivery. However after 30 days the check was not cashed and I did not...

hear from the client. I then sent them another letter, certified return receipt, informing them I needed to assume one of two things, either the check had been lost, or they did not accept my resolution to their concerns and was therefore placing a stop payment on the check and considering the matter closed. I also informed them at that time I had just filed Bankruptcy, which I have. If you need support paperwork from me, I can work on that over the weekend and email it to you next week. Sincerely,  *. *.Ace Handyman Service
