Hi [redacted] , After we spoke on the phone regarding the complaint registered by Mr [redacted] , I forwarded the issue to our CEO, who conducted the closing in questionI received her response, which I am including belowThe bottom line here is the $1,earnest money referenced by Mr [redacted] was a completely outside deal from the sale we closed and insuredMr [redacted] was told repeatedly prior to the closing that we would have nothing to do with collecting the $1,side-deal that he made, and that he must make his own arrangements to collect the money he claims was owed himHere is her full response: West Title was hired by the buyer of a property to handle a closing on his behalfThe Buyer (Assignee) was assigned the purchase agreement from Minneapolis Real Estate LLC/ [redacted] (Assignor) by an Assignment of the Purchase Contract Outside of this Agreement, Minneapolis Real Estate LLC/ [redacted] (Assignor) made an additional deposit of $to the Seller of the property This additional deposit was not disclosed to the Assignee until a draft of the settlement statement was distributed to the Assignor and SellerThere were negotiations at the time of closing between the Assignor and Assignee due to the non-disclosure of the additional deposit made after the contract was assigned The Assignee specifically told the Assignor not to involve West Title in the $dispute and that the Assignor was to work with the Assignee to resolve the issue after closing if the Assignor wanted to proceed I was put on a speaker phone call with the Assignor, Assignee and another third party ( [redacted] ***) and the Assignor agreed that he would work it out with the Assignee and I was to proceed with the closing After the closing, the Assignor sent a few emails requesting that I send him the $additional deposit even though he agreed on the conference call to work it out with the AssigneeI did forward those email requests to the Assignee and did not hear of the outcome until I received this complaint from Revdex.com

We are not surprised by his rejectionMr***'s actions throughout this matter have been completely self-serving and exhibits an extreme bias against our companyAs I stated previously, we made it abundantly clear we would have nothing to do with the earnest money in question, we held up the closing until BOTH parties were in agreement that the earnest money issue would be resolved between the two parties and would not involve West TitleI would also like to point out there were other people in on the conference call that heard Mr*** agree to resolve this matter outside of the closing conducted by usThere is no purpose in arguing this matter further; Mr*** has made it clear that nothing short of total capitulation to his egregiously untruthful statement of events will suffice, and since we completely reject his version of how things transpired there is no point in engaging him furtherWe have done our best to answer all questions regarding this closingMr*** is free to believe as he wishes, but we will not expend any more time or effort on trying to discuss this rationally with himWe consider this matter closed

I am rejecting this response because: We mentioned to Michelle already that the earnest money have been deposited by us. Michelle was biased. She made the decision in favor of her client. I also discussed the same with my attorney and he said she was supposed to give us the earnest money back to us not to the buyer. I also talked to other title agents in my area and they all said the earnest money will come back to us. We never said her to give earnest money to the buyer. She is just making this up, to get away with her mistake. I have attached all the email conversation which have disclosed the earnest money in the contract that were sent to Michelle prior to closing. Michelle was going to give that earnest money to the seller. I made her fix that mistake. The gave a vague reason for it. She said she was very busy. What she finally did was she gave that earnest money to end buyer. So all that effort we put in to save our earnest money went in vain. I am going to tell everyone about my experience and will share it on other websites as well.
