***.Western has done several individual projects for *** *** through the years but assumes this complaint refers specifically to what the parties refer to as the "upper roof"Western did not contractually agree to provide a year warrantyCFS provided the year warrantyThere must have been numerous site visits, letters and communications regarding the upper roof between Western, *** *** and the material manufacturer, CFS, whom *** *** has also filed a Revdex.com complaint against in Minnesota seeking the same outcomeFollowing the site visits, CFS provided a detailed report with their findings from the investigation of the upper roofBased on the CFS report, Western has no liability for any of the complaints by *** *** on the upper roofCFS determined any need for repairs were due to the faulty maintenance by *** *** and excessive foot traffic, water spraying and scraping of bird droppings on the upper roofCFS determined there is only 0.203% ponding water on the entire roof and such miniscule ponding will not adversely affect a properly maintained roofCFS suggested *** *** may elect to install additional drains on the roofWestern did not have any contractual obligation to install drains
Notwithstanding Western's lack of liability and in an effort to resolf this matter, Western has offered a spefified settlement to *** *** of the upper roof contingent on *** *** honoring a separate settlement agreement signed by *** *** in August of on a separate roofWestern performed under the August settlement agreement and Western is still owed over $170,from *** *** per that settlement agreementThe settlement offer on the upper roof has been rejected by *** ***
