[redacted] contacted me in the September or October of about rebuilding this motor, and he finally got the motor out and to me in November of At that point in time I asked him for a deposit of $that I would use to pay for the sublet labor (because of financials and the economy I was forced to move my shop to my home and work out of my garage) so therefore I have to sublet the workAt the time of the drop off, [redacted] did not set any completion date and told me at several meetings later 1:hat he was not in a rush and not to worry about the completion date and he ordered and purchased his own parts for the engine, I was not supposed to supply any parts, and we were taking our time with the engineHe did not buy the Cambearings, so I purchased those and had them installedAfter I got the Block back from the other shop, I started to assemble; at this point in time there was a problem with the aftermarket Camshaft that [redacted] boughtWhen I tried to install the aftermarket Camshaft, it would not fit into the block, I thought there may have been a problem with the Cambearings that I had purchased and installed, and when I went back to the stock Camshaft that was in the Block, this one fit in, because I tried it, since the stock Camshaft fit in, then I started measuring Camshaft Journal sizes and found that the aftermarket Camshaft Journal was larger than the stock one, at that point, I contacted [redacted] and explained that we had a problem, and he got mad at me, and after the cleaning was done, [redacted] told me that he was unhappy with the block because there was rust in the water jacket, he claimed that the freeze plugs weren't pulled out [redacted] sole reason for getting mad at me is because, I was taking too long months and he ran out of his defective parts return privileges, (I was not informed of this) up to this point [redacted] did not complain about the length in time and I asked him several times and he was not concerned about the time frame [redacted] came to my home on August 13, 2016, I was not home, but my wife was home and she spoke to him an• explained that I would not be able to refund his deposit because I had no funds, and I could ayments and he said no, it is his hard earned money that he has lostHe told my wife that he wanted some collateral, to make sure that I would pay him in a week [redacted] also told my wife that he doesn't want to go to court because it is too expensiveI have closed my business, because I am in school, being retrained for another field [redacted] came to my home on August 14, to pick up his engine and the components and ask for a refund of his deposit, I explained that I was unable to [redacted] took for his collateral, Eldelbrock Aftermarket Performance Cylinder Heads.I explained to [redacted] that he would not be receiving a full refund; he would be paying for outside labor and for the work that I had done and I explained to [redacted] that I could pay him in payments and he has refused and he told me that he wanted the refund in six days [redacted] would return the Elderbrock Cylinder Heads when I paid him, and since I could not pay him, [redacted] has kept the Eldelbrock Cylinder Heads in lieu of payment, and he has not contacted me since this letter from you[redacted] returned with Letters of Agreement that state, a return payment of $will be given in cash within days (August 20,2016) of agree date August 14,2016, I signed the letter and [redacted] also signed the letter, which I have attached for your review.If I am required to pay [redacted] the $as stated in the Letter of Agreement, I am going to require that the Eldelbrock Aftermarket Performance Cylinder Heads be returned to me as they were removed by [redacted] .Sincerely, [redacted] Owner of Western Machine
