An investigation of this matter indicates...

that Midland Credit became the servicer of account number [redacted] on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on June 30, 2014.  Information provided by the seller, [redacted]., at the time of acquisition indicates this account was originated on November 23, 2007, as a [redacted] credit account number ending in [redacted] in the name of [redacted], under the last four of the social security number [redacted].  Subsequently, the account was charged-off as an unpaid delinquent-debt on June 13, 2014.  The balance at the time of purchase was $308.48.  Final payment for the account was received on March 16, 2016.  [redacted] has no further financial obligation for account no. [redacted].
 
Midland Credit became the servicer of account number [redacted] on behalf of purchaser, Midland Funding, on December 17, 2015.  Information provided by the seller, [redacted]. (“[redacted]”), at the time of acquisition indicates this account was originated on September 3, 2010, as a [redacted] number ending in [redacted], in the name of [redacted], under the last four of the social security number [redacted].  Subsequently, the account was charged-off as an unpaid delinquent-debt on May 29, 2013.  The balance at the time of purchase was $197.79. 
 
[redacted] states that she was working with a debt consolidation program to resolve the balances for the above-referenced accounts.  She expresses a concern that she was given wrong balance information for account number [redacted], and believes that Midland Credit has charged interest on the account.
 
Regarding account number [redacted], a review of Midland Credit’s business records indicates that the account was charged-off with a balance of $574.15.  Additional payments to [redacted] after the charge-off date resulted in a balance at the time of purchase of $197.97.  Midland Credit received five payments forwarded by [redacted] totaling $103.00, which were made directly to [redacted] between January and May of 2016, resulting in a remaining balance of $94.79.
 
Please note that Midland Credit management has not charged any interest toward the balances of your accounts.  In keeping with its Consumer-First policy, Midland Credit made the business decision to consider the amounts paid satisfactory to resolve the balance for account number [redacted].  [redacted] has no further financial obligation for the above-referenced account.
 
[redacted] also states that she requests a refund for any interest paid.  As noted above, Midland Credit has not charged any interest on account numbers [redacted] or [redacted].  Please note that due to overpayments received on account number [redacted], two refunds were issued in April and May of 2016 for $4.92 and $10.24 respectively.  If [redacted] has any documentation or information about any additional refunds due, Midland Credit respectfully requests she submits such information so that Midland Credit may investigate the matter further.  In the meantime, [redacted] has no further financial obligation for either account.

Ms. [redacted] states that she has not received the documentation that she has requested.  Midland Credit’s business records indicate that it received the first dispute from Ms. [redacted], via online submission, on March 22, 2017.  In response, verification information provided by the seller was mailed to Ms. [redacted] on March 27, 2017.  Midland Credit subsequently received a notice of dispute from the credit reporting agencies on October 13, 2017. In response, Midland Credit appropriately verified the information that it is furnishing to the credit reporting agencies.  Additionally, verification information was once again mailed to Ms. [redacted] on October 20, 2017.
 
A copy of the verification information is once again enclosed for Ms. [redacted]’s records.  Please note that the verification information provided by the seller meets the requirements of the Fair Debt Collection Practices Act (“FDCPA”).  The original contract, complete payment history, and a full set of billing statements are not required under the FDCPA. A review of Midland Credit’s business records indicates that the account information it is furnishing to the three major credit reporting agencies is accurate.
 
Ms. [redacted] indicates that she is disputing the balance of the account.  Please note, the account was charged off on April 15, 2013 with a balance of $7,276.15.  The balance at the time of purchase by Midland Funding was $7,276.15, which remains the current amount due. 
 
Per Ms. [redacted]’s previous request, the above-referenced account will remain marked “Cease and Desist.”  While it remains due and owing, Ms. [redacted] will continue to not receive correspondence or calls from Midland Credit representatives unless a response is required by law.

I allegedly have two accounts with them showing on all three credit bureaus. I have asked them to show "validation" of these accounts by providing my signature as I do not believe these accounts are mine. They refuse to do so and state their validation is multiple bills that do not have my signature or anything like that on them.I would like this removed from my credit report or I will have to sue them as I have no contract with them and I have no signature on anything with them. They claim to have purchased an account from another company which I have in writing that company never sold anything to them.

However, I must take objection with his claim that his company has even the slightest bit of respect for the consumer. Midland Credit has caused far more than an inconvenience to me, their presence on my credit report has made it impossible for me to obtain any substantial line of credit, despite having an otherwise clean record. I have attempted to resolve the issue through proper channels but have not received an ounce of assistance on their part to reach a "positive solution" They have sent all correspondence to an address I have not occupied in 3 years. They never served me with a lawsuit which according to court documents was filed in 2015. I have recently been issued a wage garnishment execution. which again was conveniently sent to the wrong address. This execution also indicated an incorrect address for the place I work. The lack of due diligence and fact checking done by Midland Credit compared to the damage they have done to my credit score is truly disgusting. 
I am attaching emails I received regarding this account. The welcome email received in 2012, shows the original creditor as [redacted]. The last email, before the account being charged off was in August of 2013 acknowledging a posted payment and shows the creditor as [redacted]. The transition between [redacted] to [redacted] did not cause any interruption with my auto payments. I did not receive another email until March of 2014. At that time my balance due to compounding fees and interest had reached $529. Almost double the limit of the card. You can see the creditor now being [redacted]. I attempted to find out why my account had accrued such a high balance but [redacted] had already sold to the debt to a collection agency. 
I understand I am not innocent and a debt is owed. I am looking for however a solution in which I and Midland Credit are held accountable. I had sent a letter recently stating the intent to settle before an execution for wage garnishment had been ordered. In return I would like the negative information removed from my credit report. Midland has not responded to my offer. 
I will reach out once again the legal department to reach a solution. I am however steadfast in my belief that this company has zero respect for consumers. It is appalling that they are so freely allowed to conduct business with such disregard. [redacted]

An investigation of this matter indicates that Midland Credit became the servicer of the above-referenced account on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on March 28, 2016.  Information provided by the seller, [redacted] at the time of acquisition indicates this account was originated on September 22, 2014, as a [redacted] account number ending in [redacted], in the name of [redacted], under the last four of the social security number [redacted]  Subsequently, the account was charged-off as an unpaid delinquent-debt on February 28, 2016.  The balance at the time of purchase was $619.83.
 
[redacted] writes that he last made a payment to his [redacted] account in July 2015, and that the balance at that time was $135.00.  He requests information regarding why the balance is now $619.00.  A review of business records indicates that the last payment for the account was received on or about July 12, 2015, in the amount of $75.00.  The balance at that time was $260.75.  No additional payments were received.  Because no additional payments were received, [redacted] assessed interest and late fees to the balance of the account until the time of charge-off.  The account was charged off on February 28, 2016 with a balance of $619.83.
 
[redacted] also states that he has not heard anything about this account in over a year.  On April 22, 2016, Midland Credit mailed [redacted] a validation letter.  Please note that the letter was mailed to the same address listed within the [redacted]’s complaint via the United States Postal Service.  The letter was not returned as “undeliverable,” satisfying the notification requirements of the Fair Debt Collection Practices Act (“FDCPA”).  15 U.S.C. § 1692.  In that letter, Midland Credit provided the required disclosure of rights set forth in the FDCPA (15 U.S.C. § 1692).  
Midland Credit’s business records indicate that it did not receive any correspondence disputing the debt or requesting validation from [redacted] in response to the letter, and no correspondence was received directly from [redacted] prior to the complaint filed through your office.
 
[redacted] also requests that his credit report be corrected.  Please note that Midland Credit has not furnished information for the referenced account at this time.  [redacted]. as the original creditor may be reporting the account.  If [redacted] has concerns regarding the information being reported by the original creditor, he may dispute it directly with the credit reporting agencies.
 
A copy of the verification information provided by the seller is enclosed for [redacted]’s records. Ms. [redacted] expresses a concern that she received returned letter that was never opened.  While Ms. [redacted] did not indicate which address she sent a letter to that was returned, it appears that she attempted to send her letter to an address at which Midland Credit previously had a location.  Should Ms. [redacted] wish to contact Midland Credit moving forward, she may use the contact information on this letterhead.
 
Ms. [redacted] indicates that this account was placed in dispute even though she never notified Midland Credit of a dispute.  A review of Midland Credit’s business records indicates that on October 25, 2016, this account was placed with [redacted] Finance, Inc. (“ACF”) for servicing.  Midland Credit’s business records indicate that Ms. [redacted] sent a letter to ACF indicating that the account was disputed.  As such, Midland Credit appropriately updated its records to reflect Ms. [redacted] dispute of the account.  Additionally, as the account had since been placed back to Midland Credit for servicing, Midland Credit responded to Ms. [redacted] dispute on December 9, 2016 by mailing her a copy of the verification information provided by the seller.

I still stand firm in my statement that I do not owe any money to Midland Funding LLC.  They have never provided what I asked for which is a signed agreement or contract that I entered into with them (which would verify my debt WITH THEM) nor have I ever received any benefit from them.  I will look into continuing attempts for the relief of this debt with an attorney. 
 
 I am sorry but I recently replied to the message from Midland Funding and I discovered something pretty important.  I have gone over every bit of proof they provided, thoroughly, and the one thing missing is a contract.  They sent copies of some (what appeared to be) bills to verify my debt with them.  According to the Fair Credit Act, one thing they must provide me with is a signed contract with the person they obtained my debt from.  They have never provided me with a contract nor agreement between myself and anyone which would verify debt.  I would like to add to my reply that copies of something that appears to be bills does not verify a debt without a copy of the original, signed contract according to the Fair Credit Act.  They are illegally reporting this debt if they cannot provide that.  Is there any way I can add that to my reply?  Thank you, [redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I too take this complaint very serious as this is affecting MY credit and keeping me from purchasing a home and from getting specific jobs that I am qualified for so this is absolutely no inconvenience to anyone but myself. Midland has mailed me the following correspondence to my address in which I have attached. They STILL have yet to provide adequate proof to validate this alleged debt. Statements ARE NOT validation and the Bill of Sale with information blacked out or not means absolutely nothing and only looks pretty on paper. As previously asked...they were to send me a contract between myself, the original creditor, and midland that I have signed. I have NOT received this contract because they do not have it and it does NOT exist.  Also, midland doesn't have a notarized affidavit of verification from the original creditor. If a contract does exist, it would be between myself and the original creditor and NOT myself, the original creditor and midland. So, midland would NOT be a party with any interest to protect and therefore can NOT subrogate onto a contract without my request for them to do so. Midland would be a stranger to any contract and always will be. I am NOT obligated to pay for the alleged debt. The right of subrogation does not exist for a stranger to the transaction.  73 AmJur 2nd, Section 90.  Meaning, There is no right to substitute someone or some entity that was not on an original contract. It is not allowed. I have NOT signed a contract with Midland Credit Management nor do I know who they are. I have NOT nor have I EVER received services from Midland Credit Management.  I DO NOT owe a dime nor penny or anything more to Midland Credit Management. Furthermore, Midland states that the date of first default is January 2014.  The original creditor [redacted] is incorporated in Delaware and the statute of limitations for Delaware is "3 years". Based on today's date of July 26th 2017 3 years from the date of first default January 2014 has passed and it is now time barred. Case law says the collector (midland) are not allowed claim a better position than the original creditor. Midland you are completely and totally breaking the law and that is fact. I demand that  Midland fully and permanently cease and desist.  Midland agrees to have no contact in any form with me regarding this account now or in the future. I also demand that Midland remove the negative report against my ssn at any credit reporting agency, including but not limited to Transunion, Equifax, and Experian and that this debt not be resold to any other agency. Midland mails me a letter of confirmation that this account has been deleted from my credit file of the above listed reporting agencies. Lastly, they agree to remove my personal information from all accounts in their companies database. I request all of my demands are met IMMEDIATELY.

[redacted] continues to express a concern that he has not received validation of the debt.  As advised in Midland Credit’s previous response, the verification information provided by the seller meets the requirements of the Fair Debt Collection Practices Act (“FDCPA”).  The original contract, complete payment history, and a full set of billing statements are not required under the FDCPA. 
[redacted] states that the account continues to report even though the statute of limitations has passed.  A review of Midland Credit’s business records indicates that the statute of limitations expired on January 13, 2015.  However, please note that the passing of the statute of limitations does not extinguish the validity of a debt.  Rather, it eliminates litigation as a potential remedy.
The statute of limitations is different from the federal reporting period.  Similar to the statute of limitations, the expiration of the seven-year federal reporting period also does not extinguish a debt.  It only prevents the account information from being furnished to the credit reporting agencies.  A review of Midland Credit’s business records indicates that the seven-year Federal Reporting period for the above-referenced account does not expire until September 2018.

Thank you for your letter inquiry regarding [redacted]...

[redacted] complaint, which Midland Credit Management, Inc. (“Midland Credit”) received July 20, 2016.  Midland Credit appreciates the opportunity to answer your questions.
 
[redacted] expresses a concern that Midland Credit has been contacting him for the past 6 months in an attempt to reach another person, even after he advised that he was not the correct person.  An investigation of this matter indicates that Midland Credit is the servicer of an account belonging to another consumer.  During a search for the correct consumer, [redacted]’s phone number was provided to Midland Credit representatives by a third party.  In reliance on that information, Midland Credit attempted to contact the consumer regarding the referenced account.  Please note that the phone number provided by [redacted] in the complaint, [redacted], was disabled on July 20, 2016 and no calls have been placed to this phone number since.
 
[redacted] states that he had previously advised Midland Credit they have contacted the wrong person and is told by the representative that a note will be added, yet the phone calls continue.  A review of Midland Credit’s records indicates that only one phone call has been made to the phone number provided in [redacted]’s complaint.  Additionally, a review of Midland Credit’s records do not indicate that representatives were rude or unprofessional to [redacted], nor was the consumer’s personal account information disclosed.
 
Often a consumer will speak to someone from one collection agency and then erroneously believe that any subsequent collection calls, even those from another collection company, are from the same company.  Since [redacted]’s complaint states that he is receiving calls well in excess of those made by Midland Credit representatives, it appears that this has happened to him.
 
[redacted]’s phone number was marked “Do Not Call” in Midland Credit’s computer system and he will continue to not receive calls from Midland Credit representatives regarding the referenced account.  Additionally, [redacted]’s phone number has been added to an exclusion list to prevent it from being called in the future regarding the referenced account.
 
Please assure [redacted] that Midland Credit is a reputable firm, and that it is a member of the Revdex.com of San Diego in good standing.  With numerous scams noted in the media, it can be confusing for a consumer to discern which companies are operating within the law.
 
Midland Credit considers consumer complaints a serious matter and fully respects consumers’ rights.  Midland Credit apologizes for the inconvenience caused to [redacted]’s.
