The title company incorrectly input the hone sale figures in the incorrect column, thus resulting in an unfavorable outcome. This was realized after me signing the preliminarys. I was not made aware of their error until after the hone closed and I received my final documents. Upon calling [redacted], she informed me they made the mistake and they wouldn't take care of this problem as because u already signed the preliminary. I told her I would NOT have signed if they had done their job correctly, and I was aware of the actual figures.Product_Or_Service: Title company servicesDesired SettlementThe error resulted in over an 800.00 amount. I would not have sold my house had they done their job correctly and not input figures into the "wrong colum".

Western Title accepted my escrow money as the buyer, when there was no obligation for me or western title abide by a contract that is contingantOn October 2013, my wife and I received a prequalification home for A VA home. There is no credit checks at this point. We picked a home that we felt we could afford and liked at the time. We gave the realtor $2000, because we are out of the state buyers. A purchase agreement was drafted and accepted by the seller. Only one thing, We (the buyer), can't qualify for the loan because of credit scores. The loan officer and I agreed that, there was no need to file an application. Meanwhile, end a short amount of time, my father passes away, and my wife becomes dangerously ill, while we are attending funeral services in Michigan. The furtherest thing from my mind is buying a home. Well, 2 months pass, my wife is better and now my credit score is eligible for a VA Loan. The new lender indicates wen can now, look for a home and the amount we should actually be looking for. The first home we placed the $2000 earnest money into escrow, hasn't had an inspection nor a loan application. The seller has had no restrictions in selling or taking offers according to the purchase agreement. The seller has no lost or damages, in fact, we are the only potential buyer that showed interest, and as of today the home still remains in a active status. Now because we refuse to look at the home, and have a secured lender, the seller is using western title to hold my escrow fees hostage. In fact, there's a demand by the seller, asking for $1000 of the escrow, when the buyer never received or was notified by western title, there was such a demand by the buyer. But yet western title states "it was a neutral party".Desired SettlementI'm seeking my full escrow fees returned. We've contacted the current lender, and expressed our concerns with 1st, opening a second escrow account with western title. Despite the terms outlined in the purchase agreement, western title ignored the terms and it's duties to comply with the terms, making the agreement none enforceable for the buyer, and allows the seller to manipulate the agreement in favor of the seller, without the knowledge of the buyer.Business Response Contact Name and Title: [redacted], PresidentContact Phone: [redacted]Contact Email: [redacted]This is the first receipt of any complaint filed by [redacted]. Please make sure that your records reflect the address below. [redacted] was opened in October 2013 for the property commonly known as [redacted]. This escrow sat dormant with no contact from [redacted]. Cancellation Instructions were drawn by the seller's real estate agent asking that the EMD of $2,000.00 be split. The explanation on the instructions indicated that the sellers or their agents had had no contact from [redacted]. This would co-incide with his statements regarding his absence. Once a letter from his lender was obtained indicating that he could not qualify for a loan, new Cancellation Instructions were drawn refunding the money to [redacted]. This was signed by [redacted] on March 10, 2014 and the sellers on March 15, 2014. Since then, we have opened a new escrow for [redacted] to purchase other property known as [redacted]. The $2,000 has been transferred into the new escrow file and will remain there until we close or receive mutually executed instructions to cancel the transaction. The overall confusion may be caused by the parties not understanding that as an escrow holder, we are not in a position to determine the disposition of funds held in an escrow. If we do not receive mutually executed instructions, we are not able to step in and decide who should or should not be entitled to funds. We are a neutral third party and must receive mutually executed instructions prior to releasing any money held in escrow. If there is a dispute, our ultimate course of action is to cause an Action in Interpleader with the courts. This action is paid for from the funds held. There are other remedies under the NRS. In this case, it appears that it has been worked out between the parties and the funds have been transferred to the new purchase escrow.
