Westfield Insurance is in receipt of your letter dated December 30th, along with a copy of Ms [redacted] ’s complaint The file has been carefully reviewed and the following is our response:This is an automobile accident loss in which [redacted] , is an insured under a commercial auto policy with Westfield Insurance The loss occurred on December 10th, and was reported to Westfield on that same date The file was assigned to Jim M [redacted] to investigate the facts of the loss and determine liability Jim contacted our insured and Ms [redacted] on December 10th and was able to confirm and accept liability on the part of our insured A rental vehicle was authorized for Ms [redacted] with Enterprise Rental that same day On Friday December 11th, Ms [redacted] ’s vehicle was dispatched to our outside property damage specialist, Gary G [redacted] who inspected the vehicle on Tuesday December 15th, and determined the vehicle was a total loss Gary made a settlement offer of $12,to include Tax and title fees to Ms [redacted] on December 15th Ms [redacted] refused the offer and said she wanted more as she recently had put new tires on the vehicle Gary asked for proof so we could reconsider our offer Upon receiving proof from Ms [redacted] , on December 17th, Gary increased our settlement offer to $12,to include the newer tires.Ms [redacted] again refused this offer and was advised by Gary that if she did not wish to accept our offer she could pursue through her own carrier and have them subrogate Westfield for the damages At this point, Ms [redacted] had not given us permission to move her vehicle from the tow yard to a salvage yard which gave the impression she would be going through her own carrier Gary G [redacted] had concluded his handling and the file was transferred to our Total loss unit to await the subrogation paperwork from Progressive as Westfield’s offer had been declined On December 29th, the total loss adjuster, Jerilyn M [redacted] again went over our settlement offer of $12,with Ms [redacted] who again stated she did not agree with our offer The Total loss adjuster even called Ms [redacted] ’s Insurance carrier to try and explain our settlement offer amount The Progressive adjuster stated they use the same evaluation tools as Westfield and felt our offer was very fair and the same amount that they would offer Ms [redacted] for her vehicle The Progressive adjuster stated he would talk to Ms [redacted] to advise that our offer was fairOn December 30, 2015, Ms [redacted] accepted our offer of $12,and authorized the moving of her vehicle from the tow yard to the salvage dealer Ms [redacted] ’s lienholder has been contacted and her payoff requested Once this is completed and we have secured Ms [redacted] ’s required Power of Attorney, our settlement checks to the lienholder and Ms [redacted] will be issued It is not uncommon for Insurance companies to have several adjusters handling the same claim We are sorry that Ms [redacted] did not like having to talk to more than one person regarding her claim, but certain adjusters specialize in different aspects of a claim to ensure that the best possible person is completing the evaluation and settlement In this case, liability was confirmed and accepted on the date of loss A rental vehicle was offered to Ms [redacted] on that same day and her vehicle was inspected and a settlement offer made within working days Our final settlement offer was made within working days There were no delays in the handling of this claim by Westfield.When Ms [redacted] rejected our last offer, it was the Total Loss adjusters understanding that Ms [redacted] was going through her own carrier to handle her total loss vehicle settlement We apologize for any misunderstanding or confusion between the Total Loss Adjuster and Ms [redacted] on who was handling her vehicle damage claim The matter has now been settled and the vehicle damage will be concluded shortly We hope this satisfies your inquiry into this matter and allows you to close your fileSincerely, Irene R [redacted]
