On September 8th, 2014, I contacted Westfjord Shipping Ltd. by telephone about shipping some used tires to El Salvador. The company was referred to me by others who have done business with this company. The President of the company, Karen [redacted], is the sole director and officer of Westfjord Shipping Ltd. and all of my correspondence, regarding this matter was with Ms. [redacted] directly.

During our telephone conversation, Ms. [redacted] agreed to lower the shipping cost to $4,400 USD from their standard price of $4,700 USD because I was a new customer. The condition for lowering the price was that I needed to make a payment on the same day as the quote. I went to my bank (RBC) and I paid $4,400 USD by wire transfer as requested by Ms. [redacted]. The wire transfer was from RBC to her bank; for which she supplied the required information for BMO to complete the transaction via email. Ms. [redacted] agreed to send the container to be used in the shipment by September 12th, 2014.

On or about September 11th, 2014, I telephoned Ms. [redacted] to confirm that the container was on its way and that it would arrive on September 12th, 2014 as promised. Shet told me that the container would not arrive on September 12th, 2014 and that she needed more time to send it. She stated that the container would arrive on September 19th, 2014.

On or about September 17th, 2014, I had telephoned Ms. [redacted] again to ensure that the container would be sent on September 19th, 2014 as promised. I was reassured that everything was good and I would receive a call once the container arrived here in Edmonton, Alberta. I received no return call as promised.

On or about September 18th, 2014, I telephoned Ms. [redacted] again and was told there was no container available in Edmonton. She promised to send the container the following week.

To date, this company has not sent the container as promised.

On or about October 17th, 2014, I demanded that the company refund the $4,400 USD that I had paid in full due to the fact that I had not received the container. Ms. [redacted] promised to remit the funds via electronic funds transfer by October 31st, 2014. No refund was received from her on this date or subsequently.

I have made numerous demands to Ms. [redacted] to return the $4,400 USD that I had paid but she has persistently ignored and refused to refund the amount that I have paid to the company.

I plan on seeking repayment of the sum of $4,400 USD, which I paid to the company for goods and services that the she has failed to provide me with as agreed upon. Despite Ms. [redacted]'s agreement to repay me, which was confirmed by herself personally via email and over the telephone; for which to this very date, I have not received the refund.

In addition, I plan on seeking interest on the sum of $4,400 USD that I paid to the company, until the payment is received in full, pursuant to the Judgement Interest Act.

I am also planning on seeking costs of this action and any other special damages that may be proven at trial; if she doesn't respond to my demand letter by the end of November 2015 I will be filing a claim at Small Claims BC.

The conflict that arises from filing this claim is that I am located and live in Edmonton, Alberta and the transaction with Ms. [redacted] located and living in Vancouver, British Columbia. I made all correspondence and transfer of money from Edmonton and she received all correspondence and collected/deposited my money in Vancouver.

Please note that the damages that I am claiming (listed below) will be dispersed in USD funds as follows:

1. USD $4,400 (shipping container fee)
2. USD $1,400 (interest applied)
3. USD $47.13 (BC Registry Corporate Search)
4. USD $22.84 (Bank service fee)

So the grand total will be in USD funds of $5,869.97 if paid immediately; or else, total claim will be adjusted to reflect on the number of days required to receive full payment and/or when a Judgement has been registered by the Courts.
